Director of Public Works/City Engineer directed to have
the plans prepared, and the City Administrator in-
structed to develop a resolution to borrow $148 , 000 from
Sewer Line Construction Fund.
06-07-93 - Resolution No. 93-182 adopted authorizing a loan from
the Sewer Line Construction Fund, in the amount of
$187 , 000 .
09-07-93 - Plans approved and authorization granted to advertise
for bids .

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO ELI MANY, INC. FOR INSTALLATION OF CITY HALL LIGHTING
3 RETROFIT.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1 . Eli Many, Inc. is the lowest responsible
6
bidder for; Installation of City Hall Lighting Retrofit, per
7
Plan No. 8987 . A contract is awarded accordingly to said bidder
8
for the total amount of $80 , 032 . 00 , but such award shall be
9
effective only upon the contract being fully executed by both
10 parties. All other bids , therefore, are hereby rejected. The
11
Mayor is hereby authorized and directed to execute said contract
12 on behalf of the City; a cony of the contract is on file in the
13 office of the City Clerk and incorporated herein by reference as
14
fully as though set forth at length.
15 SECTION 2. This contract and any amendment or modifica-
16 tions thereto shall not take effect or become operative until
17 fully signed and executed by the parties and no party shall be
18
obligated hereunder until the time of such full execution. No
19
oral agreements, amendments, modifications or waivers are
20 intended or authorized and shall not be implied from any act or
21 course of conduct of any party.
22 SECTION 3. This resolution is rescinded if the parties
23 to the contract fail to execute it within sixty (60) days of the
24 passage of this resolution.

1 I HEREBY CERTIFY that the foregoing resolution was duly
2 adopted by the Mayor and Common Council of the City of San
3 Bernardino at a meeting thereof, held on the
