IDINO - REQUEST F R COUNCIL ACTION STAFF REPORT The attached Resolution is one of the formal steps required in the annexation process and therefore its adoption is recommended. A petition was filed with the Local Agency Formation Commission (LAFCO) , for annexation to the City of San Bernardino, for the territory located generally Northeasterly of Cal State Universitv. The area to be annexed is a part_ of a larger area proposed for development, known as Paradise Hills. Section 99 of the Revenue and Taxation Code requires that the distribution of property taxes, relative to the proposed boundary changes, be negotiated and agreed upon by all affected local agencies. The County Board of Supervisors shall negotiate with the City, any exchange of property tax revenues on behalf of all affected agencies, except as provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations between the City and County took place in 1980, when County staff and a committee of City managers agreed upon a formula for property tax transfers, and Resolution 82-325 was adopted June 7, 1982, requesting the Board of Supervisors to direct the establishment of a policy for the formula. The adoption of the attached resolution fulfills the City's compliance with said Section 99 . Isss• F : L C 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN 3 BERNARDINO AND THE COUNTY OF SAN BERNARDINO, RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFCO 2760, FOR THE AREA GENERALLY 4 LOCATED NORTHEASTERLY OF CAL STATE UNIVERSITY. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 6 7 SECTION 1. Recitals. The Mavor and Common Council of the City of San Bernardino hereby find and determine that: 8 9 A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation 10 11 Executive Officer, the governing bodies of all local agencies whose service 12 area or service responsibilities will be altered by a proposed 13 jurisdictional change will negotiate and determine by resolution the amount 14 of property tax revenues to be exchanged between and among such local agencies. 15 B. Except as provided in Section 99.1 of the Revenue and Taxation 16 17 Code, in the event that a jurisdictional change would affect the service 18 area or service responsibility of one or more special districts, the Board 19 of Supervisors of the County of San Bernardino shall, on behalf of the 20 district or districts, negotiate any exchange of property tax revenues. 21 C. The Mavor and Common Council of the City of San Bernardino and 22 the Board of Supervisors of the County of San Bernardino have determined the 23 amount of property tax revenues to be exchanged as a result of 24 jurisdictional change described by LAFCO 2760. SECTION 2. Implementation. 25 26 A. The amount of tax revenue to be transferred to the City 27 resulting from the above described jurisdictional change, is shown on 28 Exhibit "A" attached hereto and incorporated herein by reference, and is 09/29/93 1 RESOLUTION DETERMINING PROPERTY TAX REVENUE EXCHANGE BETWEEN THE CITY AND COUNTY OF SF 9ERNARDINO RESULTING FROM JURY 7TIONAL CHANGE DESCRIBED BY LAFCO 2760 RLLATIVE TO CITY OF SAN BERNARDINO ANNEXATION NO. 356. 1 hereby approved and accepted. 2 B. The annual tax increment generated in the area subject to the 3 jurisdictional change and attributable to the Local Agencies whose service 4 area or service responsibilities will be altered by the proposed , 5 jurisdictional change shall be allocated in the future years pursuant to the 6 provisions of Section 98 of the Revenue and Taxation Code. 7 SECTION 3.
