Recommended motion:
That pursuant to new changes to the Brown Act, that the City Council conduct two (2)
annual special meetings to hear comments and protests relative to increased annual
special assessments, such meetings to commence at 10.00 a.m. on the 4th Monday of May
and the 4th Monday of June each year.

STAFF REPORT
Due to recent legislation, it is now necessary to set a public meeting and a public
hearing for any increased annual assessments which affect any properties within our
assessment districts. Although no time limit is placed upon the public meeting, the
public hearing cannot be any sooner than 45 days from the date of mailing of the
notice. Historically however, we always provide at least 10 days notice of any public
meeting relative to the districts.
Not including the City-Wide district (which contains approximately 49,000 parcels), we
currently have approximately 5,896 property owners who could be affected each year.
Although not all of our district assessments increase each year, most of our landscape
maintenance districts will, if only due to increased costs of administration and/or
water and electrical .
In order to provide for these new meetings/hearings we must re-schedule our entire
administrative calendar to move everything back at least 30 days. In the same context,
we anticipate that we could have a considerable amount of owners appearing at the
meetings/hearings to air their concerns. To handle this, we are proposing that two
special Council Meetings be held to do nothing else but hear the protests for the
assessment districts, one (the meeting) on the fourth Monday in May and one (the
hearing) on the fourth Monday in June. If the City-Wide (AD 994) should be continued,
we would handle it and the others all at the same time . This scenario would allow us
sufficient time to prepare the annual rolls for submission to the County.
Something to keep in mind through this process is that if, for some reason, the
Council should make a determination to not increase an assessment, the City would have
to make up the difference as the total costs assessed are the actual costs incurred
and must be paid from somewhere.
We therefore recommend that the form motion be adopted.
City Administrator's Note:
The Real Property Division has recommended a public meeting and
hearing be held at an adjourned regular meeting rather than a
regular Council meeting due to the fact that notification is going
out to 32 districts. Since there are a number of districts
involved, it is anticipated that there will be a large number of
protestors.
