Bids for this project were received at 2 : 00 p.m. ,
Tuesday, 9-14-93 .
A total of 8 bids were received, ranging from $49 , 798 to
$57 , 324 . The low bid of $49 , 798 is 9 . 4% under the Engineer' s
Estimate of $70 , 500 .
Below is the estimated total project cost, based upon the
actual low bid price:

URGENCY CLAUSE:
These traffic signals are being installed in response to concerns
vnoiced by the Bankruptcy Court. Therefore, the signals need to
be installed as soon as possible, in order to address their
concerns .

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO HOVEY ELECTRIC, INC. FOR INSTALLATION OF TRAFFIC
3 SIGNALS AND HIGHWAY LIGHTING AT ARROWHEAD AVENUE AND SEVENTH
STREET.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . Hovey Electric , Inc . is the lowest
7 responsible bidder for: Installation of Traffic Signals and
8 Highway Lighting at Arrowhead Avenue and Seventh Street, per Plan
9 No. 8942 . A contract is awarded accordingly to said bidder for
10 the total amount of $49 , 798 . 00 , but such award shall be effective
11 only upon the contract being fully executed by both parties . All
12 other bids, therefore, are hereby rejected. The Mayor is hereby
13 authorized and directed to execute said contract on behalf of the
14 City; a copy of the contract is on file in the office of the City
15 Clerk and incorporated herein by reference as fully as though set
16 forth at length.
17 SECTION 2 . This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements , amendments , modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3 . This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.
