STAFF REPORT
Council Ralph Hernandez has requested an extensive and
comprehensive report from the City Attorney' s Office on the
confidentiality of a broad range of City files and information. We
are happy to provide such an analysis but felt that we should
advise the whole council that in order to do so it will necessitate
delaying other work and projects due to the all-encompassing nature
of the request. Since the request is general but asks that the
response be specific it will take a great deal of time and research
to determine if all the subject areas are covered. Even then the
final response in most areas is going to have to be that
confidentiality must be determined on a case-by-case basis taking
into account all the facts and circumstances of the situation.

Per your request, please provide information related to confidentiality as soon as
possible. Please cite the authority for each category.
1. Case Files - or files related to cases the City Attorney is involved in. Under v hat
circumstances can the Mayor, Council, City Administrator be allowed to review? Can the
City Attorney limit the review, especially when a settlement or outside counsel is required,
2. Investigative Files -When and to what level (Mayor, Council, City Attorney, City
Administrator, Personnel, Department Head) can information be released or withheld and by
whom? Particularly, focus on information accumulated on city employee/officials.
3. Personnel Files - Information pertaining to City employees, disability hearings,
Civil Service actions, financial data, rosters, lists, etc.
4. Depositions taken in connection with suits against the City or litigation the City
has filed.
5. Financial Files - Information pertaining to Accounts Payable Register, tax
information, revenue collection or appropriations.
Please provide as comprehensive and specific a report as possible so that Mayor and
Councilmembers will fully comprehend the who, what, why and how of the total process.
