1 . That the transfer of $25, 000 , from Account No. 129-309-57838 ,
"South 'E' Street, from Orange Show Road to Mill Street, " to
Account No. 129-309-57287 , "University Parkway, from College
Avenue to Kendall Drive, " be approved.

STAFF REPORT
Bids for this project were opened at 2 : 00 p.m. , Tuesday,
8-17-93 .
A total of 5 bids were received, ranging from $123 , 482 . 00
to $154 , 999 . 20 . The low bid of $123 , 482 . 00 is 16 . 3% over the
Engineer' s Estimate of $106 , 184 . 00 .
Below is the estimated total project cost, based upon the
actual low bid price:
Construction Contract $ 123 , 482. 00
Engineering & Inspection (W.O. 1490) 8 , 000 . 00
Sub-Total $ 131 , 482. 00
Contingencies (10%) ± $ 13 , 518 . 00
TOTAL ESTIMATED PROJECT COST $ 145,000.00
An amount of $120 ,000 . 00 was allocated in the 1/20 Sales
Tax Fund in the 1991/92 Budget, to finance the costs that will be
incurred for these improvements . Supplemental funds in the
amount of $25, 000 will be needed to fully fund the total esti-
mated project cost.
We recommend that $25, 000 be transferred from the avail-
able balance for rehabilitation of pavement on South "E" Street,
from Orange Show Road to Mill Street.
Due to the fact that 5 bids were received, it appears
that the low bid is the best that we can reasonably expect to
receive. Therefore, we recommend that a contract be awarded for
the low bid price.

1 RESOLUTION NO.
2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO SULLY-MILLER CONTRACTING COMPANY FOR STREET
3 IMPROVEMENTS ON UNIVERSITY PARKWAY FROM COLLEGE AVENUE TO KENDALL
DRIVE.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . Sully-Miller Contracting Company is the
7 lowest responsible bidder for: Installation of Street
8 Improvements on University Parkway, from College Avenue to
9 Kendall Drive, per Plan No. 8896 . A contract is awarded
10 accordingly to said bidder for the total amount of $123, 482. 00,
11 but such award shall be effective only upon the contract being
12 fully executed by both parties. All other bids, therefore, are
13 hereby rejected. The Mayor is hereby authorized and directed to
14 execute said contract on behalf of the City; a copy of the
15 contract is on file in the office of the City Clerk and
16 incorporated herein by reference as fully as though set forth at
17 length.
18 SECTION 2 . This contract and any amendment or modifica-
19 tions thereto shall not take effect or become operative until
20 fully signed and executed by the parties and no party shall be
21 obligated hereunder until the time of such full execution. No
22 oral agreements, amendments, modifications or waivers are
23 intended or authorized and shall not be implied from any act or
24 course of conduct of any party.
25 SECTION 3. This resolution is rescinded if the parties
26 to the contract fail to execute it within sixty (60) days of the
27 passage of this resolution.
