SUBJECT: Pioneer Memorial Cemetery

On March 18, 1996, the Mayor and Council authorized staff to
solicit bids for the sale of Pioneer Memorial Cemetery. One bid
was received for the property. The Loewen Group International,
Inc. , made the minimum acceptable bid of .$926, 513 .
However, the bidder proposed to pay this amount in terms that were
not in accordance with the bid specifications. Specifically, the
bid was contingent upon the City accepting payments over a series
of years, while the bid specifications stated that the entire bid
amount must be placed into escrow.
Because the bid was not made in accordance with the specifications,
it is not an acceptable bid. By rejecting this bid and
reauthorizing staff to again advertise for bids, the bid
specifications can be modified so as to allow the City flexibility
in payment terms with the highest bidder. The Loewen Group is
still very interested in purchasing the property, and has made it
clear to us that they will submit a bid if this action is taken.
Allowing the time legally necessary for advertisement, it is
anticipated that the new bids will be opened on May 23 , and the bid
awarded at the June 3 Council meeting.
It is recommended that the Mayor and Council approve the following
substitute motion:
1) That the bid as received for the sale of certain City-owned
property located at the corner of Sierra Way and 7th Street in
the City of San Bernardino (Pioneer Memorial Cemetery) from
the Loewen Group International, Inc. , be rejected; and that
the Public Works Department, Real Property Section, be
authorized to readvertise said property for sale.
