Dear Colleagues;
This letter is written to clarify misinformation that has been disseminated
about the Sexual Assault Response Team at Loma Linda University Medical
Center. Additionally, we propose that our original contract be accepted because
we are offering our low cost service excellence to the city by providing this
program.
The Emergency Services Division of Loma Linda University Medical
Center has established a Sexual Assault Response Team. The team consists of
Board Certified Emergency Physicians, Sexual Assault Nurse Examiners, and
Medical Social Workers that are immediately available 24 hours per day, seven
days a week.
A specially equipped room with state of the art equipment has been
allocated to this program. A direct contact number (909) 478-8027 is available
for the police to access us directly at any time. Law enforcement will experience
no delays in accessing our care.
With this clarification of services, please accept our original bid to
continue with the sexual assault forensic examinations. I look forward to your
support.

1. Brief bio on LLUMC (909)824-0801)
History:
From 1905 to the present, the story of LLUMC is one of steady growth and achievement. The original
Loma Linda became famous for its emphasis on natural healing and healthy lifestyle. The institution's
second medical facility was built in 1924 and reflected a more modern. traditional hospital. The building,
now known as Nichol Hall_ home of the School of Allied Health Professions and the School of Public
Health, provided extra space and advanced facilities for the burgeoning health-science programs at the
University.
The facility served as Loma Linda's hospital until the 1960s when Loma Linda University's Board of
Trustees voted to build a new major medical center for teaching, research, and patient care. The clover-
leaf-shaped medical center was completed in 1967. The state-of-the-art facility provided the infrastructure
for explosive development. By 1980, LLUMC had become the only state-designated, level-one regional
trauma center for four inland counties of Southern California, providing the highest level of care to
patients from one-fourth the state.
The opening of the world's first Proton Treatment Center at the Medical Center occurred in 1992,
ushered in a new era in medical treatment and defined a new modality for treatment of cancer and other
diseases.
The newest addition to LLUMC is a 224-bed Children's Hospital bringing the total bed capacity to nearly
800. The new facility is a response to the expanding need for specialized neonatal and pediatric care in
one of the fastest growing regions in North America. It is the only facility of its kind in the Inland
Empire and one of only seven such facilities in California. Presently, LLUMC is the third-largest
provider of children's health care in California.
The Loma Linda University Medical Center of the 1990's. a leading national hospital on the forefront of
medical science and human sen-ices, has emerged from its humble beginning in an isolated Southern
California valley. Its dramatic ston- has been possible because from its beginning, those connected with
Loma Linda have recognized that they are serving a purpose larger than thcrosch,cs. LLUMC was. is. and
will remain the creation of people who view medical care as an act of service to humanity.

2. Loma Linda Medical Center offers on call forensic services 7 days per week, 24 hours per day. Our
staff is available to meet the needs of the police department; this saving many hours of officer
downtime.
3. The Sexual Assault Nurse Examiners have been trained in the field of juvenile and adult sexual
assault examinations and evidence collection. Our Center has 24 hour emergency medicine,
physician services and pediatric emergency specialist available for consultation. In addition,Dr.
Claire Sheridan, an expert in the field of child sexual assault is available for consultation. Our Center
is prepared to meet the medical needs of the injured victim.
4. Our staff will provide SART examinations at our Center where the staff is immediately available and
the response time for other forensic services are within the required specifications of this bid.
5. Our personnel conducting examinations meet the guidelines regarding the State of California.
6. The Sexual Assault Response Team (SART) site is within a nine (9) mile radius, located at
Anderson/Barton.
7. provides for the analysis of sexually transmitted diseases. Testing includes chlaymdia. HIV, syphilis,
gonorrhea and pregnancy testing.
8. L.L.U.M.0 will furnish supplies necessary to conduct forensic services as outlined in the bid
specifications. Medical Wastes shall be disposed of in accordance with the appropriate safety
regulations of the Federal Gov. and State of California.
9. Please note that upon award of this bid, L.L.U.M.0 is prepared to provide all insurance
documentation requested by the City of San Bernardino.

SPECIFI CA TIONS
FOR
MEDICAL EVIDENCE COLLECTION SERVICES
1 . Vendor to provide qualified medical personnel to perform medical services
in support of the City of San Bernardino Police Department. Such services may
be needed 24 hours a day and seven days a week. Selected vendor will perform
all of the required services. There is no provision for partial termination, and
bids that DO NOT provide all requested services will be deemed non-responsive
and disqualified.
2. Services to be performed include, but are not limited to:
a. On-call services 7 days per week, 24 hours per day.
b. Duty roster of on-call nurse with name and phone number to be
provided to the San Bernardino Police Department with at least one
backup nurse identified.
C. Response time of 15-20 minutes for phlebotomist and 30 minutes
(ideal) to 60 (maximum acceptable) for SART exams.
d. All personnel conducting exams and collecting evidence shall be
certified to do so by the State of California. SART personnel are to have
received appropriate training in collection, preserving and securing
physical evidence related to sexual crimes. Before award, successful
vendor will be required to show proof of all required training and describe
procedure (chain of custody) for slides and charts.
e. Sexual Assault Response Team (SART) location must be within a
seventeen(1 7) mile radius of the Police Department. Vendor to have an
agreement with SART location at the time of bid, and state in miles how
far it is from the Police Department located at 710 North "D" Street in

FURNISHING AND DELIVERING OF
EVIDENCE COLLECTION SERVICES
FOR
THE CITY OF SAN BERNARDINO
NOTICE INVITING BIDS
Maximum participation by prospective offerors is highly encouraged.
It is not the intent to rule out or eliminate any prospective
bidder. If the service that you intend to bid does not comply with
our specifications as written, attach a complete explanation with
your proposal. The City may, at its discretion, consider any
deviation and make the purchase that best suits our needs. The
bidder shall not purposely bid a lesser quality that requires a
deviation from the specifications if the bidder is able to comply
with the minimum specifications.
It is the intent of these specifications to provide for complete
non-personal services to serve the needs of the Public as though
the City were providing the same itself. They are written with the
view of obtaining the best result and the most acceptable service
to the City. These specifications cover general requirements
relative to the type of service required. Minor details of
performance where otherwise not specified, are left to the
discretion of the contractor, who shall be solely responsible for
the performance of the contracted service.

f. Contracted party must have arrangements with a laboratory for the
analysis of sexually transmitted disease cultures which shall be performed
on SART exams. Testing must include chlamydia, HIV, syphilis,
gonorrhea, and pregnancy testing. Test results will be returned to the
San Bernardino PD.
g. Contracted party will supply the PD with needles for the drawing
of blood.
3. The contractor shall furnish all supplies necessary for the performance of
the contract, with the exception of blood vials, urine cups and evidence
envelopes. Evidence kits and any other supplies necessary for the collection of
evidence shall be approved by and in accordance with the San Bernardino
Sheriff's Crime Lab, California Medical Protocol for examination of Sexual
Assault Victims and the San Bernardino County District Attorney's Office.
4. Vendor to dispose of all medical waste.
5. In addition to the regular insurance requirements for general liability and
workers compensation found in the Services Agreement, contractor shall also
provide the following:
a. Commercial auto liability and property insurance covering any owned
and/or rented vehicles used by Contractor in the minimum amount of $ 1 million
combined single limit per accident for bodily injury and property damage.
b. Professional Liability insurance covering errors and omissions on the
part of the Contractor in a minimum amount of $ 1 million each occurrence and
in the aggregate on an occurrence form.
6. Bidder to complete and sign attached Services Agreement.
SERVICES AGREEMENT
THIS AGREEMENT is entered into day of
19 between ("CONTRACTOR") and
the CITY OF SAN BERNARDINO ( "CITY") .
WITNESSETH:
A. WHEREAS, CITY has need for Evidence Collection Services
within the CITY and,
B. WHEREAS, CONTRACTOR is competent, experienced and able
to perform said services: and,
C. WHEREAS, CONTRACTOR has provided the lowest responsible
bid for the providing of such services;
NOW THEREFORE, the parties hereto agree as follows:
1. CONTRACTOR shall furnish Evidence Collection services to
CITY in accordance with Bid Specifications F-98-13 .
2 . Over the term of this Agreement, CONTRACTOR shall be paid
for such services an amount in accordance with Bid Specification
F- 98-13 Bidder' s Proposal and Statement.
3 . CONTRACTOR shall provide the Police Department
with a monthly invoice in arrears and shall be provided payment
within thirty (30) days therefrom. CITY retains the right to
challenge all or any part of an invoice.
4 . The term of this Agreement shall be one (1) year from the
date first above shown. It may be extended for two(2) , one (1) year
extensions by mutual agreement. It may be cancelled by thirty days
written notice by either party.
S. CONTRACTOR shall indemnify, defend and hold CITY, its
officers, employees and agents harmless from any claim, demand,
liability, suit , judgement or expenses ( including, without
limitation, reasonable costs of defence) arising out of or related
to CONTRACTOR' s performance of this agreement, except that such
duty to indemnify, defend and hold harmless shall not apply where
injury to person or property is caused by CITY' s willful misconduct
or sole negligence.
6. While not restricting or limiting the foregoing, during
the term of this Agreement, contractor shall maintain in effect
Policies of comprehensive public, general and automobile liability
insurance, in the amount of $1, 000, 000. 00 combined single limit,
and statutory worker's compensation coverage, and shall file copies
of said policies with the CITY' S Risk Manager prior to undertaking
any work under this Agreement.
7. CONTRACTOR shall perform work tasks as directed by the
Police Department, but for all intents and purposes contractor
shall be an independent contractor and not an agent or
employee of the CITY.
8. In the performance of this Agreement and in the hiring and
recruitment of employees, contractor shall not discriminate on the
basis of race, creed, color, religion, sex, physical handicap,
ethnic background or country ;of origin.
9 . Any notice to be given pursuant to this Agreement shall be
deposited with the United States Postal Service, postage prepaid
and addressed as follows:

Nothing in this paragraph shall be construed to prevent the
giving of notice by personal service.

GENERAL SPECIFICATIONS
1 . Each bid shall be in accordance with Specification No. F98-13 .
All specifications are minimum. Bidders are expected to meet or
exceed these specifications as written. Bidder shall attach to bid
proposal a complete detailed itemization and explanation for each
and every deviation or variation from these specifications.
Conditional bids, or those which take exception to the
specifications, may be considered nonresponsive and may be
rejected.
2 . The City reserves the right to accept or reject any and all
bids and to award a contract to the bidder who best meets our
requirements. This may include waiver of minor irregularities or
discrepancies, or nonconformity to specifications in appropriate
circumstances. Purchase shall be on a best buy basis after due
consideration of all relevant factors, and suitability as well as
conformity to City needs and requirements. In all cases the best
interest of the City shall prevail in all contract awards.
3 . The City of San Bernardino reserves the right to purchase more
or less than the quantities specified, at unit prices bid.
4 . Bids shall be firm offers, subject to acceptance or rejection
within 60 days of the opening thereof.
5. Regular dealer. No bidder shall be acceptable who is not a
reputable provider of requested services as submitted for bid
consideration.
6. Contractor shall defend any and all suits and assume all
liability for any and all claims made against the City of San
Bernardino, or any of its officials or agents for the use of any
patented process, device or article forming a part of equipment
used to provide contracted service or any item furnished under the
contract.
7 . Each bidder must state in 'his bid proposal the guaranteed start
work date in number of calendar days from the date of contract
execution by the City of San Bernardino, time is of the essence
relative to this contract. Target start will be thirty days after
contract approval by the Mayor and Common Council of the City of
San Bernardino. Successful bidder (contractor) shall prosecute the
work continuously and diligently and shall deliver the bid items at
the earliest possible date following the award of the contract.
8 . Price shall be quoted F. O.B. San Bernardino (all transportation
charges shall be fully prepaid) , and shall include all discounts.
Where applicable bid shall include California sales tax computed at
the rate of 7 . 75% (this will normally be shown as a separate line
item on the bid sheet) .
9 . The services which the bidder proposes to furnish to the City
must comply in all respects with the appropriate safety regulations
of all regulatory commissions of the Federal Government and the
State of California, whether such safety features and/or items have
been specifically outlined in these specifications or not.
10. Time is of the essence.
11. Contract. Each bid will be submitted and received with the
understanding that acceptance by the City of San Bernardino of
proposal bid in response to this solicitation shall constitute a
contract between the successful bidder and the City. This shall
bind the successful bidder to furnish and perform at the
prices (bid) given and in complete accordance with all provisions of
Specification No. F98-13 . In most cases the basis of award will be
the City's standard purchase order that may or may not incorporate
this solicitation by reference.
12 . Prohibited interest. No member, officer, or employee of the
City or of any agency of City during his tenure or for one year
thereafter shall have any interest , direct or indirect in this
contract or the proceeds thereof. Furthermore, the parties hereto
covenant and agree that to their knowledge no board member,
officer, or employee of the City has any interest, whether
contractual, noncontractual, financial or otherwise, in this
transaction, or in the business of the contracting party other than
the City, and that if any such interest comes to the knowledge of
either party at any time, a full and complete disclosure of all
such information will be made in writing to the other party or
parties, even if such interest would not be considered a conflict
of interest under Article 4 (commencing with Section 1090) or
Article 4 . 6 (commencing with Section 1120) of Division 4 of Title I
of the Government Code of the State of California.
13 . one Document. These specifications, the request for proposal,
the contractor' s bid proposal, the written agreement executed by
the parties, the purchase order and all documents referred to in
the complete specifications and all modifications of said documents
shall be construed together as one document. Anything called for
in any one of said documents shall be deemed to be required equally
as if called for in all . Anything necessary to complete the work
properly shall be performed by the contractor, whether specifically
set out in the contract or not. All sections of the specifications
shall be read and interpreted as constituting a whole and not -
as an aggregation of individual parts, and whatever is specified in
one section shall be construed as applying to all sections.
14 . The City of San Bernardino reserves the right to accept or
reject any and all bids .
15 . Prompt Payment. Each bidder may stipulate in the bid proposal
a percentage prompt payment discount to be taken by the City in the
event the City makes payment to the contractor within ten ( lo)
working days of acceptance of service and approval of invoice . For
the purpose of this provision, payment is deemed to be made on the
date of mailing of the City check .
16 . Inquiries . Direct all inquiries to the purchasing manager at

384-5043 . The answers to material questions will be provided to
all potential offerors .
17 . Bid forms . No bid will be acceptable unless it is made on the
Proposal forms furnished herein. Deliver all bids, signed and
sealed to the Purchasing Division, Finance Department at 300 North
"D" Street, 4th Floor City Hall, San Bernardino, California 92418 .
CLEARLY MARK THE SPECIFICATION TITLE AND NUMBER ON THE OUTSIDE OF
THE ENVELOPE.
18 .Time. All. bids must be received in the purchasing office by
3 : 00 PM on June 301 1997 . Any bid may be withdrawn prior to the
above scheduled time for the receiving of bids. Any bid received
after that time and date specified shall not be considered.
18 . The City of San Bernardino intends to award one contract for
furnishing and delivering of all services in all categories.
19 . By submitting a bid to a public purchasing body, the bidder
offers and agrees that if the bid is accepted, it will assign to
the purchasing body all rights, title, and interest in and to all
causes of action it may have under Section 4 of the Clayton
Act(U. S. C. Sec. 15) or under the Cartwright Act(Chapter 2 ,
commencing with Section 16700, of Part 2 of Division 7 of the
Business and Professions Code) , arising from purchases of goods,
materials, or services by the bidder for sale to the purchasing
body pursuant to the bid. Such assignment shall be made and become
effective at the time the purchasing body tenders final payment to
the bidder.
31. MBE/WBE . . .Good faith effort must be shown in the event of any
sub-contracting opportunities for Minority or Women owned
businesses.
