Recommended Motion: SEP 15 1997 1. That a determination of Ballots and/or protests filed , relative to the formation of the Mill and Dallas Area Landscape Maintenance Assessment District(AD 1020)be made and the Public Hearing be closed. Description) DEPOSITS Finance: Council Notes: Res 97-3 o 0 'L✓ 10-06-97 Agenda Item No. Z� _CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT On 11/1/96, this office received a petition from the developer/owner of Tract No. 15652, located on Mill Street at Dallas Avenue, for the establishment of a Landscape Maintenance Assessment District. This petition is a result of a requirement of the development for the installation of landscaping along Mill Street. The establishment of an Assessment District for provide funding for the ongoing maintenance. The developer has deposited the amount of $4,000 to cover the cost of proceedings. There are 13 single family lots within proposed district boundaries. The first year's assessment is estimated to be $240. All potential home buyers within the district will be given a disclosure of the assessment, by the developer. On August 18, 1997, the Engineer's Report, which is on file in the office of the City Clerk, was preliminarily approved and Resolution of Intention No. 97-251, declaring the intention to form the assessment district and setting a Public Meeting for September 15, 1997 and a Public Hearing for October 6, 1997, was adopted. Notices of the meeting and hearing were mailed to the property owners and the Resolution of Intention was also published in the Sun newspaper. In compliance with Proposition 218, Assessment Ballots were also mailed with the Notices. Property owners may return the ballots, may file letters of protest, or both. Protest letters and ballots will be tallied separately. The Public Meeting was held on September 15, 1997, and any protests were carried over to the Public Hearing on October 6, 1997. At the conclusion of the Public hearing, the results of the Assessment Ballots and any protest letters will be tallied and presented and a determination made. If protest letters representing 50% or less have been filed and ballots representing over 50% support, than the formation of the district may proceed, otherwise proceedings must be abandoned. We recommend that a determination of protests and ballots be made, the Public Hearing be closed and that the attached Resolution establishing the Assessment District and confirming the 1998/99 Assessment Roll be approved. Description) DEPOSITS Finance: Council Notes: Previously - # 7 — 09-15-97 Agenda Item No. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT On 5/27/97, we received a petition from the developer/owner of Tentative Tract No. 15777, located on Coulston Street , West of Elm Avenue, for the establishment of a Landscape Maintenance Assessment District. This petition is a result of a requirement of the development for the installation of landscaping along portions of Coulston Street and along portions of Elm Avenue. The establishment of an Assessment District for provide funding for the ongoing maintenance. The developer has paid the required deposit of$4,000 to cover the cost of proceedings. The tract is being built in 2 phases, with the first phase being built at this time (Tract No. 15777-1). The landscaping will be installed, and assessments levied as each phase develops. The initial proposed assessment will be $190 per single family lot. Once the development is fully built out,the additional 48 lots will be included in the assessments. Although additional landscaping will be added, the inclusion of the additional lots will reduce the assessment amount to an estimated $148. All potential home buyers within the district will be given a disclosure of the assessment, by the developer. Part of the formation proceedings includes the preparation of an Engineer's Report, which has details regarding the improvements, method of determining benefit and assessment amounts. A copy of the Engineer's Report is on file in the office of the City Clerk, and was preliminarily approved on August 18, 1997. Resolution of Intention No. 97-252, declaring the intention to form the assessment district and setting a Public Meeting for September 15, 1997 and a Public Hearing for October 6, 1997, was adopted on August 18, 1997. Notices of the meeting and hearing were mailed to the property owners and the Resolution of Intention was also published in the Sun newspaper. In compliance with Proposition 218, ballots were also mailed with the Notices. Property owners may return the ballots, may file letters of protest, or both. Protest letters and ballots will be tallied separately. The ballots and protest letters will be tallied at the conclusion of the Public Hearing on October 6, 1997. Ballots will be weighted by the assessment amount for each respective parcel. Since the petitioner still owns all, of the properties involved, we do not anticipate a majority protest. We recommend that the Public Meeting be closed and protests, if any, be carried over to the Public Hearing on October 6, 1997.
