No.) (Acct 11-scrintion) Finance: Council Notes: Agenda Item No. CITY OF SAN BERNARDINO—REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Public Hearing 10:00 a.m. and Resolution Creating Underground Utility District No. 29, located along portions of 3rd Street and Viaduct Boulevard between"K" Street and 2nd Street. BACKGROUND: On November 20, 2000, Resolution No. 2000-324 was adopted, noticing a public hearing relative to the formation of Underground Utility District No. 29 and authorization to proceed with the establishment of said district, was given. The Underground Utility Committee relative to the rehabilitation of the Santa Fe Depot and the overall San Bernardino area surrounding the Santa Fe Depot recommended this district. The district integrates with the City's community preservation activities, which include an anti-blight plan and a business attraction and retention program. All affected property utilities and property owners were given mailed notice of the hearing. San Bernardino City Municipal Code 13.36 provides for the formation of the Underground Utility Districts for the removal of overhead utilities such as power, telephone and cable TV. The funding for the electrical portion of the undergrounding of these utilities is typically funded by Rule 20A Funds. These funds, which are mandated by the PUC (Public Utilities Commission), set aside by the various power companies for the purpose of undergrounding, and are then allocated annually for use by various cities and counties within a power company's service area. Under recent Rule 20A changes, any necessary conversions to be done on private property will be paid for with Rule 20A funds, without any cost to property owners. No City funds are used for Rule 20A projects. Presently, the City has approximately 2 million dollars allocated for various underground projects. This project is estimated at .5 million dollars, leaving a balance of 1.5 million dollars for future projects. The actual amount may differ, since finals costs on current projects (namely the 40`h Street project and the Mt. Vernon project) may be more than or less than the estimated amount when completed. Presently, the City's allocation is approximately $500,000 per year, which is added to the existing funds available. Based on current schedules, Edison has projected the completion of this project by July 31, 2001. FINANCIAL IMPACT: None. PP tY 16 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 17 OF SAN BERNARDINO, AS FOLLOWS: 18 SECTION 1. It is hereby found and determined pursuant to Chapter 13.36 of the San 19 Bernardino Municipal Code of the City of San Bernardino, and to definitions contained 20 21 herein that the public necessity, health, safety and welfare require the formation of 22 Underground Utility District No. 29, located along portions of the south side of 3`d Street and 23 the east side of Viaduct Boulevard from the centerline of "K" Street to the north line of 2nd 24 Street, within said City, extensively used by the general public and carry a heavy volume of 25 vehicular traffic, in order to remove utility poles, overhead wires and associated structures 26 d to underground utilities along said portions of said 3`d Street and Viaduct Boulevard. 27 28 11/29/00 1 RESOLUTION CREATING UNDERGROUND UTILITY DISTRICT NO. 29, LOCATED ALONG PORTIONS 1 OF 3RD STREET AND VIADUCT BOULEVARD BETWEEN "K" STREET AND 2ND STREET IN THE CITY OF SAN BERNARDINO. 2 3 SECTION 2. An underground utility district to be known as Underground Utility 4 District No. 29 is hereby established in that area along portions of the south side of 3`d Street 5 and the east side of Viaduct Boulevard from the centerline of"K" Street to the north line of 2nd 6 Street, more particularly shown on Drawing No. 10167 in the Engineering Division, 7 8 Department of Development Services, City of San Bernardino, on file in the office of the City 9 Clerk of said City, a copy of which is attached hereto as Exhibit "A" and made a part of this 10 description. 11 SECTION 3. All poles, overhead wires and associated overhead structures lying 12 within 50 feet southerly of the centerline of said 3`d Street and easterly of the centerline of 13 Viaduct Boulevard shall be removed and underground installations made in said underground 14 utility district within the following times: 15 16 a. Underground installation by utility companies and property owners and 17 reconnections not later than June 30, 2001 . 18 b. Removal of poles, overhead wires and other associated structures not later 19 than July 31, 2001. 20 Said dates, however, may be extended by the City Engineer to facilitate coordination with 21 he various property owners and utility companies. 22 23 SECTION 4.
