SUBJECT
A resolution of the City of San Bernardino approving a side letter to the Memorandum of
Understanding (MOU) between the City of San Bernardino and employees in the police safety
employees' bargaining unit represented by the San Bernardino Police Officers' Association (SBPOA).
BACKGROUND
The adoption of this resolution will approve the attached side letter, which amends the Memorandum
of Understanding between the City of San Bernardino and the San Bernardino Police Officers'
Association.
The Mayor and Common Council previously approved the implementation of the 3% @ 55 retirement
benefit, effective 7/1/01 as a means of attracting and retaining quality police officers. In exchange for
this benefit the SBPOA agreed to defer from discussing the 3% @ 50 retirement benefit until 12/31/04
and agreed to extend the term of the current MOU to 12/31/02. A PERS contract amendment
implementing the 3% @ 55 benefit will be presented to the Mayor and Common Council in the near
future.
Additionally the City and SBPOA had previously negotiated the adoption of the PERS EPMC program
that allowed the City to convert the 9% City paid member contributions to earnings and to report this
as compensation earnable under the PERS guidelines. The language for these provisions was
forwarded to PERS for approval. Upon examination by PERS it was requested that that the City
make some revisions to the language. The City requested and was granted an extension to correct
the language when the MOU's were reopened. The negotiations for the 3% @ 55 benefit provided
the opportunity to revise the language and the Mayor and Council previously approved this correction.
The side letter formally adopts the aforementioned changes and incorporates them into the MOU.
FINANCIAL IMPACT
Estimated first year dollar costs for 3% @ 55 retirement benefit for all safety employees was
$1,716,660 at the time that PERS initially cost the benefit. The actual cost for FY 2001 — 02 and
future recurring cost will be will determine upon completion of a valuation by PERS.
RECOMMENDATION
Adopt resolution.

12 Article VII, General Provisions, Section 4, Term of Memorandum of Understanding, a
13 copy of which amendments are attached hereto and incorporated herein marked Exhibit
14 A.

SIDE LETTER TO RESOLUTION NO. 99-155
FOR POLICE SAFETY EMPLOYEES
The following sets forth the Side Letter to Resolution No. 99-155 for full-time,regular, active
Police Safety Employees.
Article III, Compensation, Section 2 PERS --Retirement Plan
A. The City shall continue to participate in an employees' retirement plan for Public Safety
Officers, by contract with the California Public Employees' Retirement System (PERS)
under the current 2% at age 50 formula. Effective July 1, 2001, the City will
implement the 3% at 55 formula. The Union agrees that it will defer any discussion
of the 3% at 50 benefit for two (2) years beyond the proposed contract extension
date or until December 31, 2004.
E. The City shall adopt a resolution with an implementation date of January 1, 2000,
for paying and reporting the value of the Employer Paid Member Contribution
(EPMC) under the guidelines of Government Code Section 20636(c)(4) pursuant to
Section 20691. The City will report the 9% Employee Contribution as Special
Compensation under the current PERS laws.
For purposes of determining overtime compensation and other salary payments, including
but not limited to, payoffs of sick leave, vacation accruals, holiday accruals and comp
time balances, the aforementioned nine percent(9%) shall not be considered.
Article VII General Provisions, Section 4 --Term
This MOU will be in effect for the four-year period commencing January 1, 1999, and ending
December 31, 2002.
