On 12/20/99, the Commission adopted Resolution No. 1999-48 approving the preliminary report for the 40th Street Redevelopment Project, and directing transmittal of the preliminary report to affecting taxing agencies. On 12/20/99, the Commission adopted Resolution No. 1999-49 approving the draft Redevelopment Plan for the 40th Street Redevelopment Project, and authorized transmittal of the proposed plan to affected taxing agencies, and persons and organizations within the project area, and submittal to the Planning Commission for report and recommendation. On 12/20/99, the Commission adopted Resolution No. 1999-50 approving draft owner participation rules for the 401h Street Redevelopment Project. On 12/20/99, the Commission adopted Resolution No. 1999-51 approving a draft Method of Relocation for the 40th Street Redevelopment Project. On 03/20/00, the Mayor and Common Council and the Community Development Commission were at impasse and failed to adopt Resolution consenting to and calling for a Joint Public Hearing. On 03/21/00, because of the Mayor and Common Council and Community Development Commission impasse, the Planning Commission continued its hearing on the Environmental Impact Report, determination of consistency with the General Plan and adoption of the Redevelopment Plan for the 401h Street Redevelopment Project until May 2, 2000. -------------------------------------------------------------------------------------------------------------------------------------------- GVO:SMM:1ag:05-01-00 40th St Joint PH COMMISSION MEETING AGENDA Meeting Date: 05/01/2000 Agenda Item Number: r ECONOMIC DEVELOPMENT AGENCY STAFF REPORT --------------------------------------------------------------------------------------------------------------------- Resolutions Consenting To and Calling For a Joint Public Hearing 40th Street Redevelopment Project BACKGROUND The Community Development Commission of the City of San Bernardino ("Commission") has undertaken proceedings for the adoption of the Redevelopment Plan for the 40th Street Redevelopment Project. On September 20, 1999, the Commission adopted Resolution No.1999- 34 approving the Preliminary Plan for the 401h Street Redevelopment Project. The adoption of this Resolution also directed the preparation of a redevelopment plan for the Project Area and the noticing of affected taxing entities of the proposed adoption of the Redevelopment Plan. To date, the required notices pursuant to Sections 33327 and 33328 of the California Community Redevelopment Law, Health and Safety Code Section 33000, et. seq. ("CRL") were transmitted to affected taxing entities on September 22, 1999, and the following documents were prepared in connection with the Project Area for Commission receipt at the Commission's regular meeting on December 20, 1999: 1) the draft Redevelopment Plan; 2) draft Rules Governing Owner Participation and Re-entry Preferences to Property Owners, Operators of Businesses and Business Tenants; 3) draft General Relocation Rules (Method of Relocation pursuant to Section 33411 of the CRL); and 4) the Preliminary Report. Pursuant to Section 33344.5 of the CRL, the Preliminary Report was transmitted to all affected taxing entities on December 23, 1999. The draft Environmental Impact Report ("BIR") has been prepared by Culbertson Adams and Associates, Inc., our environmental consultant, and has been transmitted to all affected taxing entities and other agencies pursuant to the requirements of the California Environmental Quality Act. This document has also been available for public review as of December 20, 1999. Additional Commission actions include holding a public information meeting on March 9, 2000 to provide a forum for interested citizens to learn more about redevelopment and provide their input. Notice of the public information meeting was mailed via first class mail to all property owners, residents, businesses, community organizations and residents in the Project Area on February 17, 2000. Notice of this meeting was also published in the San Bernardino County Sun on February 24, 2000. At this meeting, City staff and consultants provided oral presentations and written material on the redevelopment process, and made copies of the draft Redevelopment Plan available. -------------------------------------------------------------------------------------------------------------------------------------------- GVO:SMM:lag:05-01-00 40th St Joint PH COMMISSION MEETING AGENDA Meeting Date: 05/01/2000 Agenda Item Number: Economic Development Agency Staff Report Public Hearing - 40' St PAC April 26, 2000 Page Number-2- --------------------------------------------------------------------------------------------------------------------- CURRENT ISSUE The proceedings to adopt the Redevelopment Plan are nearing the final step in the process. Prior to City Council consideration of the final Redevelopment Plan and adoption ordinance, a public hearing must be held to hear all testimony for and against the proposed Redevelopment Plan and related EIR. The CRL provides that when a city council serves as the governing board of the redevelopment agency, or in this case, the Community Development Commission of the City of San Bernardino, both bodies may hold a joint public hearing to receive testimony on a redevelopment plan. Further, the CRL stipulates that the notice of the joint public hearing: 1) be published in a newspaper of general circulation not less than once a week for four (4) consecutive weeks prior to the hearing; 2) be mailed to all affected taxing agencies via certified mail, return receipt requested; and 3) be mailed to all affected property owners, businesses, and residents at least 30 days prior to the hearing via first-class mail. Originally, the subject Resolutions were placed before the Mayor and Common Council and Community Development Commission at their March 20, 2000 meeting. During the meeting, the City Attorney's office expressed opposition to adoption of the Redevelopment Plan since it would create additional housing set-aside funds resulting in need to increase the supply of low and moderate income housing. Representatives of neighborhood groups and residents also spoke in opposition to this requirement. As a result of the controversy, the City Council and Commission could not agree on a course of action and failed to adopt Resolutions setting a Joint Public Hearing. Because of the Council/Commission impasse, the Planning Commission continued its hearing until May 2, 2000. Subsequently, Project Area Committee meetings (PAC) were held on April 4 and 18, 2000. In attendance were Agency staff, consultants, Agency Special Counsel, representatives of the City Attorney's office and area residents. Discussions centered on concerns about low-income housing, senior apartments and use of housing set aside funds. At the April 18, meeting the City Attorney committed to working toward resolving concerns about low income housing while preserving the intent of commercial revitalization through redevelopment. Consensus is now to eliminate any residentially zoned property from the project area by changing the proposed boundaries. This would insure that only commercial redevelopment activities would be undertaken. Further, it is recommended that language be inserted in the Redevelopment Plan which directs any housing set-aside funds derived from the new project area to use in the Northwest Project Area and other areas in the Sixth Ward. The above concepts are to be presented to the 40th Street PAC and Planning Commission on May 2, 2000. By adopting the attached resolutions, the City Council and the Commission will be merely setting the time and date of the joint public hearing, not taking any formal action on the Redevelopment Plan. No formal action will be taken on the adoption of the Redevelopment Plan until the joint public hearing. This is simply an administrative procedure required by California Community Redevelopment Law. FISCAL IMPACT None. RECOMMENDATION Staff recommends that the Mayor and Common Council and the Community Development Commission adopt the attached resolutions consenting to and calling a Joint Public Hearing on the proposed Redevelopment Plan and related Environmental Impact Report for the 40th Street Redevelopment Project. t.
