Staff Report
Subject:
Resolution awarding contract to Trautwein Construction for repair of failed box culvert at
various locations per Plan No. 9975.
Background:
The Departments of Public Services and Development Services have identified a number of
box culverts that convey storm water under street intersections, which have failed due to aging,
and traffic load over the culverts. This failure caused the culverts to clog up during recent
rainstorms.
Plans and specifications for Phase I of this project are complete and it is ready to be awarded.
This project consists of removing and replacing existing concrete deck of the box culverts in
the street and parkway.
The estimated project costs are as follows.
Construction Estimate $37,400
Contingencies 5,800
Design, Inspection and Contract Administration 5,800
TOTAL $49,000
This project was advertised locally; the following companies responded (successful bidder is in
bold type).

Funding for this project in the amount of $134,900 was approved in the FY 1999/00 CIP
Storm Drain Construction Fund and all costs incurred will be charged to Account No. 248-
368-5504-7139 (Repair failed box culverts citywide). The remaining funds will be carried
over for the next phases.
Recommendation:
That the Mayor and Common Council adopt the Resolution awarding a contract to Trautwein
Construction for repair of failed box culverts at various locations.

BERNARDINO AWARDING A CONTRACT TO TRAUTWEIN CONSTRUCTION
3 FOR REPAIR OF FAILED BOX CULVERTS AT VARIOUS LOCATIONS PER PLAN
4 NO. 9975.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

7 SECTION 1. Trautwein Construction is the lowest responsible bidder for repair of
8 failed box culverts at various locations per Plan No. 9975. A contract is awarded
9 accordingly to said bidder in a total amount of $37,400, with a contingency amount of
10 $5,800, but such award shall be effective only upon being fully executed by both parties. All
11
other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to
12
13 execute said contract on behalf of the City; a copy of the contract is on file in the office of
14 the City Clerk and incorporated herein by reference as fully as though set forth at length.
15 SECTION 2. This contract and any amendment or modifications thereto shall not take
16 effect or become operative until fully signed and executed by the parties and no party shall be
17
18 obligated hereunder until the time of such full execution. No oral agreements, amendments,
19 modifications or waivers are intended or authorized and shall not be implied from any act or
20 course of conduct of any party.
21 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute
22 it within sixty (60) days of the passage of the resolution.
