Recommended Motion: That the Mayor and Common Council close the Public Hearing and adopt the Ordinance of the City of San Bernardino amending Section 13.08.55 of the San Bernardino Municipal Code and Section 19.30.320 of the San Bernardino Development Code, and amending Section 15.73.065 of the San Bernardino Municipal Code relating to deferral of certain development fees. Recommendation: That the Mayor and Common Council close the Public Hearing and adopt the Ordinance of the City of San Bernardino amending Sections 13.08.055 and 15.73.065 of the San Bernardino Municipal Code and Section 19.30.320 of the Development Code relating to deferral of certain development fees. Background: On March 18, 1996 the Mayor and Common Council adopted Ordinance MC-961 for the deferral of certain development fees. This ordinance expired on April 1, 1997. The fees recommended for deferral are: •Sewer Line Connection Fee - Resolution No. 89-510 •Storm Water Drainage Fee - Resolution No. 93-381 •Traffic Systems Fee - Resolution No. 88-140 •Verdemont Infrastructure Fee - Ordinance No. 15.73.065 *Park Development Fee - Development Code Section 19.30.320 Attachment A contains the proposed guidelines that were previously developed and utilized to implement the program. Attachment B indicates the number of developments that utilized the previous fee deferral program. There has been an interest in the development community to reinstate this fee deferral program. Based on this interest, the appropriate ordinance and resolution are being proposed for your consideration By amending the expiration date of this ordinance we hope to continue to spur housing growth and thereby the local economy. Resolution 96-79 which adopted an Administrative Fee for the program is still in force and effect. A fee of $81 per lot or parcel is collected at the time of payment of the deferred fees to offset administrative costs. The accompanying Resolution 88-140 and this ordinance cover what is necessary to extend this program. Financial Impact: There is no financial impact to the City. ATTACHMENT A CITY OF SAN BERNARDINO GUIDELINES FOR DEFERNIENT OF DEVELOPMENT IMPACT FEES The following guidelines have been established by the City of San Bernardino for the deferred payment of development impact fees: 1. The only development impact fees which shall be deferred are the Sewer Line Construction Fee; Storm Drain Construction Fee; Traffic Systems Fee; Verdemont Infrastructure Fee; Park Development Fee. 2. New single family construction projects only will be eligible for participation in this program. 3. Prior to the issuance of the building and other permits required for new development, the amount of the development impact fees for the project will be determined by the City. All required fees other than fees listed in #1, will be paid prior to the issuance of the permits. 4. The payment of the development impact fees may be deferred until prior to the release of utilities, prior to the close of escrow on the sale of the property, or eighteen (18) months from the issuance of building permits, whichever occurs first. If the deferred payment of development fees is preferred, the developer shall sign a statement acknowledging the amount of the total impact fees to be paid and committing to pay all impact fees within the established time frame. The City shall record such an agreement as a lien on the parcel. 5. The program will terminate one year from the date of Mayor and Council approval unless otherwise extended by this body. 6. An administrative fee has been established to cover the City's costs in administering this program. 7. The amount of the deferred fees paid to the City will be the amount due at the time the fees are actually paid. 8. Under all circumstances, the required development impact fees shall be paid prior to the release of utilities, prior to the close of escrow for the sale of the property or eighteen (18) months from the issuance of building permits, whichever occurs first. There shall be no provision made for any extension of the impact fees beyond this time. Failure to comply with these guidelines will be grounds for prohibiting the developer from future participation in this program.
