Description) Finance: Council Notes: Agenda Item Previously - # /i/o 3117 Mc- /©0 Cfl"-y OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT The State of California, under various statutes and titles, requires local governments to adopt and enforce the State Building Standards Code. The State has updated its building codes by adopting the 1994 editions of the Uniform Codes, which became effective throughout the State on January 1, 1997. The adoption of these codes as part of the City's Municipal Code provides for local enforcement and administration. The California Health and Safety Code, Section 17958 provides that local jurisdictions may make amendments to these Codes based on specified local conditions. As in the past, our philosophy has been to keep such amendments to a minimum. Most of our amendments are therefore administrative in nature. The 1994 edition of the Uniform Codes includes an entirely new format from its earlier predecessors. This new format incorporates a decimal system as well as other organizational changes which more closely align it with the format of the other model code groups. Therefore, the majority of the changes to Chapter 15.04 of the Municipal Code are editorial in nature, reflecting revised references to the appropriate 1994 code sections. A summary of those substantive changes which are not purely editorial follows: Section 15.04.020: Adopts by reference the latest editions of the Model Codes. UBC Appendix Chapter 4, Division I addresses barriers for swimming pools, spas and hot tubs located on the premises of Group R, Division 3 Occupancies. These requirements are intended to limit access by small children to such bodies of water to prevent drowning accidents. This division includes detailed requirements for pool enclosures and other approved barriers. UBC Appendix Chapter 31, Division I provides requirements for Flood-Resistant Construction for buildings located in flood prone areas. These requirements are based on the Federal Emergency Management Agency (FEMA) and National Flood Insurance Program regulations. NFPA 99C Standard on Gas and Vacuum Systems, 1993 Edition provides detailed regulations on the installation requirements for medical gas and vacuum systems. Section 15.04.065: This new section amends the wording of UBC Chapter 1, Section 106.4.4 by adding the provision that failure to obtain an inspection and to demonstrate substantial progress within any 180 day period is Prima Facie evidence that the work has been abandoned and the permit has expired. Section 15.04.075: The wording of this section has been changed to no longer require building permits for fences six feet or less in height except for concrete or masonry fences greater than three feet in height. Amends UBC Chapter 1, Section 106.2.2. Section 15.04.105: This new section amends the wording of UBC Chapter 4, Section 410 to include reference to NFPA 99C for the installation requirements for medical gas and vacuum systems, and also places authority for permits and inspections of these systems under the jurisdiction of the Planning and Building Services department. Section 15.04.116: This new section amends the definitions in UBC Appendix Chapter 4, Section 420 to coincide more closely with the City's Municipal Code Section 15.48 and other State language. Section 15.04.118: This new section amends UBC Appendix Chapter 4, Section 421.1 by adding language that in the case of outdoor pools, a listed, electronic, tracking pool cover meets the minimum barrier requirements of this section. Section 15.04.119: This new section amends UBC Appendix Chapter 4, Section 421 by adding language that in the case of spas and hot tubs, a listed, locking "safety cover" meets the minimum barrier requirements of this section.
