This is a two part program: A. Provide low-income persons/families with rehabilitation to their residential single-family homes. B. Job specific skills training and hands-on work site experience for at-risk youths. The first part of the program will be providing housing rehabilitation to low-income homeowners who cannot afford to maintain their homes by rehabilitating their existing single-family residential dwelling. The goal is to eliminate blight, health and safety hazards to provide decent safe and sanitary housing; to provide suitable living environment; stimulate economic development opportunities, to preserve, maintain and enhance the existing housing stock. i The second part of the program is to job train young people of this community with hands-on work site experience in the diverse areas of the construction, remodeling and home repairs towards the long-term goal of employment. Qualified instructors in the field of construction must train these youths. The closing date of the RFP was dated July 21, 1997, a two week time frame for submittals. On this date the Agency received only one proposal, from the Westside Community Development Corporation(CDC). The Commission on August 18, 1997 approved an extended contract with reappropriation of $7,200 in funds to cover the extended contract period to the CDC until October 6, 1997. Prior to this time a letter was received from Neighborhood Housing Services requesting an extension of time to submit their proposal. The Commission approved the request for time extension on the RFP and on August 14, 1997, staff also reissued the RFP with a new deadline of September 15, 1997. Staff also initiated a broader range of marketing the RFP by placing ads in the Press Enterprise, El Chicano, The Sun, Highland Community News, The Black Voice and the Business Press. ------------------------------------------------------------------------------------------------------------------ REW:lag:11-17-01.cdc COMMISSION MEETING AGENDA MEETING DATE: 11/17/1997 Agenda Item Number: I Economic Development Agency Staff Report Housing Rehabilitation and Job Training Program November 4, 1997 Page Number-2- ------------------------------------------------------------------------------------------------------------------ On September 15, 1997, the RFP closed and three (3) proposals were received. These proposals were rated by four(4) qualified individuals from;the City's Planning and Building, Code Enforcement, EDA Accounting and an outside Redevelopment Manager from the City of Santa Ana. The interview panel included a score sheet identifying the criteria required under the Program and scope of work. Attached is a matrix of the panel's total scores identifying the RFP's respondents with the highest scored being Westside Community Development Corporation. The Agency desires to assist persons and families of low and moderate income to 8 rehabilitate residential property and improve low and moderate income housing available at affordable i 9 housing cost within the City of San Bernardino ("City"), in accordance with the California Community 10 Redevelopment Law(Health and Safety Code 33000 et seq.; the"Act"), specifically 33334.2; and 11 B. The Agency has established a Job Training and Housing Rehabilitation Program (the "Program")to assist persons and families of low and moderate income throughout the City to improve 12 their homes; and 13 C. The improvements to all homes rehabilitated through the Program shall be completed 14 at no expenses to those residing in such homes, by youths enrolled in the Program who shall receive 15 valuable training and experience in housing component installation and repair; and 16 D. The SB WS CDC has requested the assistance of the Agency to provide funds for the 17 costs of materials, supplies and labor to rehabilitate homes located in the City to be improved through 18 the Program, the addresses of which are to be identified as each home is selected for rehabilitation by 19 SB WS CDC. Selection shall be based upon qualifying resident income, condition of building, health and safety issues and related items; and 20 E Pursuant to Health and Safety Code 33334.2 and 33334.3, the Agency is authorized 21 to use any or all of its powers to use moneys from its Low and Moderate Income Housing Funds (the 22 "Housing Fund") to rehabilitate buildings or structures specifically for the purposes of increasing, 23 improving, and preserving the community's supply of low and moderate income housing available at 24 affordable housing cost to persons and families of low and moderate income; and 25 F. The Agency has determined that its assistance to the SB WS CDC shall be of benefit 26 27 1 28 1 y improving and preserving the supply of low and moderate income housing and fostering community 2 ommitment and pride, thereby eliminating blight in the very neighborhoods where local youths 3 articipating in the Program reside; and 4 G. The Agency desires to provide funding to the SB WS CDC from the Housing Fund to assist the SB WS CDC_in its efforts to rehabilitate and revitalize low and moderate income housing 5 and provide opportunities for inner City youth, 6 NOW, THEREFORE, the parties hereto agree as follows: 7 1. Public Purpose. The purpose of this Agreement is to effectuate the goals of the Agency 8 to increase, improve, and provide low and moderate income housing throughout the City. To 9 implement these goals the Agency shall provide financial assistance to the SB WS CDC_for purposes 10 of rehabilitating properties located in the City. 11 2. Agency Assistance. Subject to the terms and conditions set forth herein, the Agency shall provide financial assistance to the SB WS CDC in an amount not to exceed 12 Thousand Dollars ($50,000,00) (the"Agency Assistance"). 13 3. Use of Funds. The SB WS CDC agrees that the Agency Assistance provided Q14 hereunder shall be used solely for the purpose of reimbursing the SB WS CDC for the cost of materials, 15 supplies, and labor used to complete the improvements described in Exhibit"A" attached hereto and 16 incorporated herein by this reference. 17 The cost of materials, supplies, and labor used to rehabilitate any single property shall not 18 exceed Two Thousand Five Hundred Dollars ($2,500.00)unless there are extenuating circumstances, 19 and then only if agreed to in writing by both parties. If an estimate of the materials, supplies, and labor necessary to rehabilitate any single property exceeds Two Thousand Five Hundred Dollars($2,500.00), 20 the SB WS CDC shall so inform the Agency and if no written agreement is arrived at, said structure 21 can not be rehabilitated under the Program, and should be referred to the Agency's Neighborhood 22 Spirit Program. 23 There shall be imposed a limit of seven hundred and fifty dollars ($750.00) per structure for 24 direct supervisorial labor costs. All other expenditures of Agency Assistance shall be limited to 25 supplies and materials. 26 27 2 28 i 1 4. Property Selection. Selection of a property for rehabilitation shall be upon written 2 equest of the SB WS CDC and prior written consent of the Agency. In the event the estimated cost f repair exceeds Two Thousand Five Hundred Dollars($2,500.00), the SB WS CDC may designate 3 an alternative residential structure located in the City acceptable to the Agency. Approval of an 4 alternative structure shall be solely within the discretion of the Agency. Selection and work progress 5 shall be pursuant to the monitoring process outlined in Exhibit`B", attached hereto and incorporated 6 herein. j 7 5. Term. The term of this Agreement shall commence on the first date written above and i 8 shall continue in full force and effect until November 7, 1998, unless terminated earlier by either party 9 in accordance with Section 19 herein (the"Term"). 6. Disbursement of Agency Assistance. Concurrent with execution of this Agreement,the 10 Agency shall disburse Five Thousand ($5,000.00) of the Agency Assistance to the SB WS CDC—(the 11 «Initial Disbursement") in the form of a check payable directly to the SB WS CDC. i t 12 The remaining Forty Five Thousand Dollars ($45,000.00) of the Agency Assistance shall be 13 disbursed to the SB WS CDC durin.-a the Term of this Agreement in nine (9) installments of Five 14 Thousand Dollars($5,000.00)each(the"Installments"). Following receipt and verification of invoices 15 by the Agency that the Initial Disbursement was used to purchase materials, supplies, and labor to 16 complete the improvements to the selected properties, the rB WS, CDC shall receive its first 17 Installment. The SB WS CDC shall not receive the remaining installments until the Agency receives and approves invoices documenting that the SB WS CDC's use of tl:e most recent Installment is 18 consistent with Section 3 above. Such invoices shall contain: (I) the address of each structure 19 rehabilitated., (ii) a. description of the improvements completed, (iii) an itemized description of the I 20 materials and supplies used to complete such improvements, iv the cost of all materials and supplies PP P P ( ) PP 21 purchased, (v)the names, hours worked, and amount paid to each of the individuals providing labor 22 to the project, including both trainees and supervisors, and (vi)verification that the owner is income 23 qualified. 24 Payment of invoices pursuant to this Agreement shall be made after acceptance and approval 25 by the Agency within thi_�ty(30) days of receipt of invoices. The Agency reserves the right to cause 26 Q 27 28 I he physical inspection of the Properties rehabilitated pursuant to this Agreement to verify invoices eceived before the Agency disburses additional funds from the Agency Assistance to the SB WS CDC. 2 The SB WS CDC acknowledges that the approval and verification process may result in delays 3 of payment of the Agency Assistance and consents to all such delays. The Agency shall exercise due 4 iligence in reviewing the documentation provided by the SB WS CDC and approving the amount of 5 proceeds from the Agency Assistance that shall be disbursed to the SB WS CDC. 6 7. Nondiscrimination. The SB WS CDC covenants for itself, its successors, and assigns, 7 hat in rehabilitating the Properties pursuant to this agreement, the SB WS CDC shall not discriminate 8 gamst any applicant for or participant in the Program on account of race, color, creed, religion, age, ex, marital status, handicap, national origin or ancestry. 9 8. Indemnification. The SB WS CDC shall defend, indemnify, and hold harmless the 10 g enc Y, its officers a g ents employees, and representatives, from and a g ainst any and all actions suits, 11 roceedings, claims, demands, losses, costs, and expenses for injury of any type claimed, including legal 12 osts and attorney fees, arising from or related in any manner to the Properties or performance of this 13 Agreement. 14 9. Insurance. Prior to commencement of rehabilitation of the Properties, the SB WS 15 DC shall obtain a comprehensive liability and property damage insurance policy which shall be 16 aintained during the Term of this Agreement, in an amount equal to One Million Dollars $1,000,000,00) combined single limit per occurrence. Such policy shall protect the Agency and the 17 ity from all claims for damages arising out of the activities of the SB WS CDC under this Agreement. 18 The SB WS CDC shall furnish the Agency with a certificate of insurance countersigned by an 19 authorized agent of the insurance carrier naming the Agency and the City as additional insureds. The 20 certificate of insurance shall contain a statement of obligation on behalf of the insurance carrier to 21 notify the Agency and the City of any material change, cancellation or termination of coverage at least 22 thirty (30) days in advance of the effective date of any such material change cancellation, or 23 termination. Insurance coverage provided by Participant shall be primary and not contributing with 24 any insurance maintained by the Agency or the City and the policy shall contain such an endorsement. 25 10. Notices. All notices and demands of any kind which any party hereto may be 26 27 4 28 1 required to serve upon the other parry under the terms of this Agreement shall be in writing by personal 2 service or by leaving a copy of such notice or demand at the address hereinafter set forth, whereupon service shall be deemed complete and notices and demands shall be deemed to have been received on 3 he date of such personal service; or by mailing a copy thereof by certified or registered mail, postage 4 repaid, with return receipt requested. 5 Service shall be deemed complete and notices and demands shall be deemed to have been I 6 received upon expiration of the third calendar day after the date of mailing, notwithstanding any other 7 date for receipt set forth on any return receipt or the failure of any party to receive a return receipt. 8 The address to which notices and demands may be received may be changed by providing the notices I 9 equired herein. 10 To the Agency: Redevelopment Agency of the City of San Bernardino 201 North"E" Street, Third Floor 11 San Bernardino, California 92401-1507 12 Attention: Agency Administrator 13 To the 14 15 16 17 11. Compliance with City Municipal Code. The Improvements shall be completed in 18 compliance with all zoning, planning, and building code requirements of the City and any other governmental entity having jurisdiction over the Properties. The SB WS CDC shall obtain all 19 necessary permits including building permits, prior to commencement of Improvements. 20 12. Default. Failure or delay by either parry hereto to perform any term or provision 21 of this Agreement shall constitute a default under this Agreement. The injured parry shall give written 22 notice of default, in accordance with Section 10, specifying the default complained of by the injured 23 party. Except as required to protect against further damages, the injured party may not institute 24 proceedings against the party in default until thirty(30)days after giving such notice. Failure or delay 25 in giving such notice shall not constitute a waiver of any default, not shall it change the time of default. 26 27 5 28 ® 1 13 Non-Waiver. Failure to exercise any right the Agency may have or be entitled to, in he event of default hereunder shall not constitute a waiver of such right or any other right in the event 2 of a subsequent default. 3 14. Inspection of Books and Records. The books and financial records pertaining to the 4 se of funds disbursed to the SB WS CDC pursuant to this Agreement shall be retained by the SB WS 5 CDC and available to the Agency for inspection for purposes of performing an audit for a period of 6 five(5)years. The cost of reproduction of any such financial records shall be borne by the Agency. 7 15. Governing Law and Litigation Costs. This Agreement shall be governed by the laws 8 f the State of California. Should any action be instituted to enforce payment or performance under 9 his Agreement, the prevailing party in such action shall be entitled to reimbursement by the other party or all reasonable attorney's fees, court costs, and other costs related to such litigation. The cost, 10 alary and expenses of the City Attorney and members of his office in enforcing this Agreement on 11 ehalf of the Agency, shall be considered as"Attorney Fees" for purposes of this paragraph. 12 16. Entire Agreement. This Agreement constitutes the entire agreement between the 13 k2encv and SB WS CDC parties and may not be amended without the prior written consent of the i14 arties hereto. The parties intend this Agreement to be the final expression of their agreement with 15 espect to the terms herein and a complete and exclusive statement of such terms. No modification, 16 mendment or waiver of any term herein shall be binding unless executed in writing by the parties to 17 e bound thereby. 17. Amendment. This Agreement may be amended as deemed necessary by written 18 instruments duly approved and executed by the parties hereto. Any such amendments or modifications 19 hall be valid,binding, and legally enforceable only if in written form and executed by the parties hereto 20 after the same have been duly approved and authorized for execution. 21 18. Assignment. In no event shall the SB WS CDC assign this Agreement without the 22 prior express written consent of the Agency, which consent may be withheld in the Agency's sole 23 discretion. 24 19. Termination. This Agreement may be terminated by either party by giving the other 25 arty fifteen(15) day s prior written notice at any time after the effective date of this Agreement. 26 27 6 28 r . 1 20. Severability. Roofing Repair: High and Low roofs, standards and gable, various length of overhand. 2. Electrical Repair: 100 amp service, replace box, wiring, riser, breakers. 3. Plumbing_Repair: Fix leaks, clean main line, install water savers, replace sink diverter valves. 4. Flooring,Repair: Repair breaks and cracks, replace the over concrete, replace vinyl over wood, minor carpet repair and replacement. 3. Heating and Cooling Repair: Install vents for gas, install water, heater insulator blanket. 6. Replace/Repair Doors and Windows: Frames,jams, hinges, hollow and solid core doors, rescreening (no burglar alarms, no swinging doors). I = E 7. Handicapped Access and Safety Devices: Grab bars, shower handles, - install ramps. S. Security Devices: Dead bolts, window locks and peepholes. 9 Sanitation and Debris Removal 10. Painting: Exterior walls as needed. Interior walls and ceilings as needed. _ 11. Walkway. Repair: Minor cement and asphalt replacement. 12- Fencing Repairs: Minor repair or replacement of wood or chain link gates. EXHIBIT"B" Project Monitoring The following process shall be used to select properties for rehabilitation and monitor work progress: 1. SB WS CDC identifies candidate properties notifies Agency inspector. 2. Agency inspector schedule site review with SB WS CDC representative, confirms owner eligibility, scope of work, cost estimate, etc. (see attached form) authorizes commencement of work. 3. SB WS CDC completes work, notifies Agency for final inspection. (Note: Agency inspections do not replace those required by the City's Planning and Building Services Department as part of a permit process). 4. SB WS CDC submits form together with supportive information regarding labor and material costs for each property as part of its quarterly request for reimbursement.
