Simjee Current Address: 2660 Twain Drive, #21 San Bernardino, CA 92407 Fees Owed: $353.60 - This property is approximately a 1,200 square foot M/L commercial building located in a commercial area designated as CG, in the downtown area of the City on an approximate 5,400 square foot lot. The owners obtained title to the property approximately November 1996. A complaint was received from the Police Department and an inspection was made the same day by the Code Compliance Division on May 25, 1995. The structure was posted as a "Dangerous Building" and a board-up was ordered. A Notice of Hearing was mailed to property owner on June 8, 1995 regarding the following violations: Vacant Unsecured Structure; Weeds, Dry Brush and Overgrown Vegetation; Trash, Debris and Litter; and Graffiti. On July 6, 1995, the hearing was held with no appearance from any person(s) having an interest in the property. The Board ordered the property owners to maintain the vacant structures boarded to FHA board-up standards and incur the cost of $5,895.21. - A proactive inspection was conducted with the Police Department on March 13, 1997 and a Notice of Hearing was sent to the property owner on June 6, 1997 regarding the following violations: Dangerous Building; Vacant Unsecured Structure; Substandard Building; Unmaintained Landscaping; Weeds, Dry Brush and Overgrown Vegetation; and Trash, Debris and Litter. A hearing was held on June 5, 1997 with an appearance by Nancy Shaffer, having an interest in the property. The Board ordered the property owner to obtain required permits to rehabilitate or demolish the abandoned structure and incur the cost of $353.60. CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT MAYOR AND COMMON COUNCIL MEETING OF NOVEMBER 3, 1997 BACKGROUND 01-30-95 Complaint received from the Police Department regarding overgrown vegetation and trees clogging the drainage system. 05-25-95 Complaint received from the Police Department regarding an open and vacant structure. The property was inspected and posted as a "Dangerous Building" and a board-up contractor was contacted. 05-30-95 A Notice of Hearing was sent to property owner Edith Hougton, 27248 13th St, Highland, CA 92346 by certified mail with a copy to all interested parties. Signed return receipts were received. 06-05-95 A Notice of Pendency was placed on the property. 07-06-95 A hearing was held with no appearance from any person(s) having an interest in the property. The Board accepted staff's recommendation and directed the owners to maintain the vacant structures boarded to FHA board-up standards. The property owner will incur the fees of $5,895.21. 07-13-95 Board of Building Commissioner's Order #2740 was mailed certified to property owner(s) and posted on the property. 10-29-96 Received a request to release a Notice of Pendency. This was denied because the Pre- Permit inspection was not obtained or the fees paid. 03-13-97 A proactive inspection was conducted with the Police Department and observed the property to be open and vacant, with trash and debris, transient activity, and a dangerous building. 04-07-97 New property profile ordered. 04-14-97 A Notice and Order was mailed certified to the new property owner Abdul R. Simjee, 2660 Twain Dr., #21, San Bernardino, CA 92407. 05-14-97 A reinspection was conducted with no change in the condition of the structure. 05-20-97 A Notice of Hearing was mailed certified to the property owner Abdul R. Simjee. 05-23-97 A check was received from Barry Cooper, realtor, for fees of $353.60. The Board accepted staff's recommendation and directed the owners to obtain required permits to rehabilitate or demolish the abandoned unmaintained structure. All work must be completed within 30 days. The property owner will incur the fees of $353.60 which has been paid. 06-12-97 Received Letter of Intent to rehab to commercial use. 06-16-97 Board of Building Commissioner's Order #4197 was mailed certified to property owner(s) and posted on the property. 07-01-97 An appeal was received from Barry Cooper stating that he attempted to obtain rehabilitation permits with Planning and Building Services, but was turned down because the area is zoned for Commercial and not Residential as he intended. APPELLANT STATED GROUNDS OF APPEAL The appellant requires a thirty day extension. APPELLANT'S ACTIONS SOUGHT FROM MAYOR AND COMMON COUNCIL The appellant states that he requires a thirty day extension to rehabilitate the property for commercial purposes. STAFF RECOMMENDATION That the Mayor and Common Council deny the appeal and uphold the Order of the Board of Building Commissioners as described in Order Number 4197 dated June 16, 1997. Based upon the evidence submitted, it was found 6 and determined that the building(s) and or premises located at 363 7 West 13th, 8treet, San Bernardino, California constituted a public 8 nuisance.' 9 SECTION 2 . The Board of Building Commissioners accepted 10 staff' s recommendations . The property owner(s) are hereby 11 directed to comply with the following requirements . Within ten 12 (10) days from the date of this order, the property owner shall 13 obtain required permits to rehabilitate or demolish the abandoned 14 unmaintained structure. All required work must be completed 15 within thirty (30) days from the date of this order. All work 16 completed must be inspected and approved by the Inspection 17 Services Division. To prevent unauthorized entry, the owner (s) 18 shall secure and continuously maintain all structures to FHA Board 19 up standards within ten (10) days, from he date of this order. 20 Owner(s) shall install landscaping were needed and shall maintain 21 existing landscaping to include regular irrigation, pruning and 22 cutting of lawn, and the owners shall remove and continue to 23 maintain property free of weeds, dry brush and overgrown 24 vegetation, and the owner (s) shall remove and continue to maintain 25 property free of trash, debris and any items causing an unsightly 26 appearance or improperly stored items . The property shall meet 27 all applicable codes adopted by the City of San Bernardino. 28 SECTION 3 . Upon the owner (s) of record failure to comply with 1 BOARD OF BUILDING COMMISSIONERS ORDER NO. 4197 2 PAGE 3 3 4 the order of the Board of Building Commissioners within the time 5 specified, the Code Compliance Division shall proceed to initiate 6 abatement action by obtaining an Inspection/Abatement warrant to abate violations noted. If the owner fails to comply with the 7 Board' s order within the time specified, the City may initiate 8 action including demolition, removal of any unauthorized 9 construction and abate the nuisance. 10 11 SECTION 4 . It was determined that the City was required to 12 initiate abatement proceedings and incurred costs in the amount of 13 $353 . 60 . These costs and any future additional abatements shall 14 be the personal obligation of the owner and if unpaid shall be 15 recorded as a special assessment on the county tax record. SECTION S . Upon receipt of an application from the person 16 17 required to conform to the order and by agreement of such person 18 to comply with the order if allowed additional time, the 19 Supervising Building Official may grant an extension of time, not 20 to exceed an additional 120 days, within which to complete said 21 repair, rehabilitation or demolition, if the Supervising Building 22 Official determines that such an extension of time will not create 23 or perpetuate a situation imminently dangerous to life or 24 property. The Supervising Building Official' s authority to extend 25 time is limited to the physical repair, rehabilitation or 26 demolition of the premises and will not in any way affect or 27 extend the time to appeal the notice and order. 28 SECTION 6 . My General Contractor, Richleigh Investments, on June 20th, 1997 attempted to secure permits to rehab the existing structure and they were advised that you would not allow this as you would not want this property repaired as a single family residence as it is in a commercial zoning. The problem you have had was with the existing owner, Abdul Simjee. I represent the Beneficiaries, Rayor and Company and myself on the 14 Trust Deed Of Trust on this property and we are doing this to protect our investment. We are responsible people and we will see to it that the proper work is done to your approval. The Deed Of Trust allows us to come in and do whatever work is necessary to rehab this property to your specifications. It would be a disaster for you to not allow us to do the above as we are innocent parties to the problem that has transpired in the past. I am keeping the property completely boarded up and free from debris and it will be kept in this way during whatever period I am in charge of this property.
