MC-1399 1 2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADOPTING DEVELOPMENT CODE AMENDMENT (ZONING MAP AMENDMENT) 14-11, A 3 CITY-INITIATED REQUEST TO AMEND DEVELOPMENT CODE CHAPTER i 19.19A AND THE CITY'S ZONING MAP TO REMOVE CERTAIN PARCELS 4 LOCATED ALONG WEST BASELINE STREET AND WEST 5TH STREET FROM 5 THE TRANSIT DISTRICT (TD) OVERLAY AND TO ADD CERTAIN PARCELS LOCATED ALONG THE WEST SIDE OF "G" STREET, SOUTH OF COLUMBIA 6 WAY TO THE TD OVERLAY. 7 WHEREAS, the current Development Code was initially adopted in 1991; and 8 WHEREAS, the current General Plan was initially adopted in 2005; and 9 WHEREAS, on March 19, 2014, the Planning Commission of the City of San 10 Bernardino held a noticed public hearing to consider public testimony and the staff report 11 recommending approval of Development Code Amendment (Zoning Map Amendment) 12 DCA/ZMA 14-11, and recommended approval of DCA/ZMA 14-11 to the Mayor and 13 Common Council; and 14 WHEREAS, notice of the public hearing for the Mayor and Common Council's 15 consideration of DCA/ZMA 14-11 at the April 21, 2014 Council Meeting was published in The Sun newspaper on April 10, 2014. 16 17 NOW THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE 18 CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 19 20 SECTION 1. The Mayor and Common Council find that the above-stated Recitals 21 are true and hereby adopt and incorporate them herein. 22 SECTION 2. Findings of Fact. 23 24 1. The proposed amendment will be consistent with the General Policy 2.2.1, which 25 calls for compatibility between land uses and quality design through adherence to the 26 standards and regulations in the Development Code and policies and guidelines in the 27 Community Design Element. The amendment will result in allowing developers to 28 modernize and improve the quality of design of certain properties located adjacent to, or 1 MC-1399 s 1 near the I-215 freeway right-of-way. The TD Overlay prohibits such modernization of these 2 uses and therefore, the properties remain underperforming and/or blighted and abandoned. Adding the properties controlled by Loma Linda University into the TD Overlay will 3 4 provide the University with additional flexibility to meet the City's development standards and design a high-quality project that will be a visual key to the entrance to the City's 5 Downtown area. Thus, the amendment will be consistent with this policy. 6 7 2. The proposed amendment will remove several parcels from the TD Overlay and add 8 several others to the Overlay. However, the underlying development standards of those 9 parcels being removed will not change. Further, the amendments will enable the 10 development/redevelopment of underperforming and blighted parcels with new, high-quality 11 development that will benefit the public interest, health, safety, convenience and welfare of the City, rather than be detrimental to it. 12 13 3. The proposed amendment will not change the underlying land uses or zoning of the 14 subject properties and therefore, the balance of land uses in the City will not be affected by 15 this amendment. 16 17 SECTION 3. Compliance with the California Environmental Quality Act. The 18 Mayor and Common Council finds that the proposed Development Code 19 Amendment/Zoning Map Amendment is exempt from the California Environmental Quality 20 Act (CEQA) pursuant to Section 15061(b)(3) of the CEQA Guidelines, because the effect of 21 the amendment would not result in a significant direct or reasonably foreseeable indirect 22 physical change in the environment. 23 24 SECTION 4. Development Code Amendment (Zoning Map Amendment) 14-11, attached hereto as Exhibits A and B and incorporated herein by reference, is hereby 25 approved. 26 27 SECTION 5. Severability: If any section, subsection, subdivision, sentence, or 28 clause or phrase in this Ordinance or any part thereof is for any reason held to be 2 MC-1399 1 unconstitutional, invalid or ineffective by any court of competent jurisdiction, such decision 2 shall not affect the validity or effectiveness of the remaining portions of this Ordinance or 3 any part thereof.
