2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO REPEALING CHAPTER
3 15.55 OF THE SAN BERNARDINO MUNICIPAL CODE AND CANCELING ITS
ASSUMPTION OF RESPONSIBILITY FOR THE ENFORCEMENT OF THE CALIFORNIA
a MOBILEHOME PARKS ACT PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE
5 SECTION 18300(e), AND RETURNING SAID ENFORCEMENT AUTHORITY TO THE
CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT.

WHEREAS, pursuant to California Health and Safety Code Section 18300, local agencies may
8 assume the responsibility for the enforcement of the Health & Safety Code, Division 13, Part 2.1,
9 Section 18200, et seq., known as the Mobilehome Parks Act; and
10 WHEREAS, the City assumed responsibility for the enforcement of the Act within mobilehome

parks by adoption of San Bernardino Municipal Code Chapter 15.55 (MC-831) in May 1992; and

13 WHEREAS, the amount of statutory fees collected are inadequate to cover the costs of the
14 enforcement program; and
15 WHEREAS, the City is unable to maintain the necessary staffing to effectively administer the
16
enforcement program due to the City's current financial condition.

NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
18
19 SAN BERNARDINO DO ORDAIN AS FOLLOWS:
20 SECTION 1. Chapter 15.55 of the San Bernardino Municipal Code is hereby repealed and the
21 assumption of responsibility for the enforcement of the Health & Safety Code, Division 13, Part 2.1,

Section 18200, et seq., known as the Mobilehome Parks Act, is hereby canceled and returned to the
23

California Department of Housing and Community Development, pursuant to Health and Safety Code
25 Section 18300(e). The Community Development Department is directed to give written notice to the
26 California Department of Housing and Community Development.
27 SECTION 2. Effective Date. This ordinance shall become effective on January 1, 2013.
