Installation of Lighting at Ruben Campos, Johnson,
Mill, Lytle Creek and Nicholson Community Centers
Bids for this project were opened at 2:00 p.m. , Tuesday, 3-30-93.
A total of 11 bids were received, ranging from $83,537.00 to
$139,950 . 00. The low bid of $83,537 . 00 is 31 .68 under the
Engineer' s Estimate of $115, 125. 00.
Below is an estimate of the total project cost, based upon the
actual low bid price:

Consultant' s Design Fee 19,950.00

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO WYATT CONSTRUCTION FOR INSTALLATION OF LIGHTING
3 SYSTEMS AT RUBEN CAMPOS, JOHNSON, MILL, LYTLE CREEK AND NICHOLSON
COMMUNITY CENTERS.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1 . Wyatt Construction is the lowest responsible
7 bidder for: Installation of Lighting Facilities at Ruben Campos,
8 Johnson, Mill , Lytle Creek and Nicholson Community Centers, per
9 Plan No. 8892 . A contract is awarded accordingly to said bidder
10 for the total amount of $83, 537 .00, but such award shall be
11 effective only upon the contract being fully executed by both
12 parties . All other bids, therefore, are hereby rejected. The
13 Mayor is hereby authorized and directed to execute said contract
14 on behalf of the City; a Copy of the contract is on file in the
15 office of the City Clerk and incorporated herein by reference as
16 fully as though set forth at length.
17 SECTION 2. This contract and any amendment or modifica-
18 tions thereto shall not take effect or become operative until
19 fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No
21 oral agreements, amendments, modifications or waivers are
22 intended or authorized and shall not be implied from any act or
23 course of conduct of any party.
24 SECTION 3. This resolution is rescinded if the parties
25 to the contract fail to execute it within sixty (60) days of the
26 passage of this resolution.

This item was continued to 4-19-93, due to a question over the
low bidder being properly licensed.
Wyatt Construction holds a Class "B" License, which is for
buildings, but had been approved for a Class "A" License,
General Engineering. A Class "A" License has now been issued
r to Wyatt Construction, as evidenced by the copy. The firm now
holds dual licenses of both Class "A" and Class "B.'
As a Class "A" Licensed Contractor, Wyatt Construction fully
meets the legal requirements for the project to install
security lighting at various community centers. Therefore, a
contract can now be rded to Wyatt Construction for the low
bid rice.
