Synopsis of Previous Council action:

07-06-92 -- Authorization granted for City to assume responsibility
of a Consulting Engineer and execution of an Agreement
for provision of these services.
12-07-92 -- Resolution No. 92-453 adopted authorizing execution of
an Agreement with URS Consultants, Inc. for Phase I of
services.

On 12-21-92, the City of San Bernardino entered into a contract
with URS Consultants, Inc. relative to providing professional
design services for the Tippecanoe/Del Rosa Avenue Connector.
The services to be provided, pursuant to this Agreement, were
broken down into two phases . Phase i was for development of the
road alignment, with Phase II being preparation of plans,
specifications and estimate.
The Agreement stipulated a Scope of Services for Phase I, and a
fee of $26,917. Also, that upon completion of Phase I, a Scope
of Services and fee will be negotiated for Phase II. The
negotiated Scope of Services and fee will be incorporated into
the Agreement as an amendment.
Services to be provided under Phase I was completed by the
acceptance of the network comprised of Tippecanoe Avenue, Del
Rosa Avenue and "C" Street (inverted "h") as a component of the
Master Plan. The scope of services for Phase II can now,
therefore, be developed.
URS Consultants, Inc. has submitted a draft scope of services and
fee for Phase II. We have met with Mr. Danny Fouladpour to
negotiate the scope of services and fee. The negotiated fee for
Phase II is $210, 850. Therefore, the total, not to exceed fee,
for the improvement of Tippecanoe Avenue, Del Rosa Avenue and "C"
Street, is:
Phase I - $ 26,917
Phase II - 210,850
Total Estimated Fee - $ 237,767
We originally estimated the cost for preliminary engineering for
the Tippecanoe/Del Rosa Connector and Orange Show Road Extension
as $1 . 2 Million. However, SANBAG only had $800,000 to loan. The
fee for the extension of Orange Show Road is $598,611 , which
leaves a balance of $201,389 for the Tippecanoe/Del Rosa project.
Supplemental funding will be needed to fully finance the fee for
Tippecanoe/Del Rosa, as set forth below:
Total Estimated Cost - $ 237 ,767
Total Available Funds - 201,389
Supplemental Funds Needed - $ 36, 378
A request has been submitted to the IVDA Board for the necessary
supplemental funding. This request will be on the IVDA Board
Agenda of 4-14-93 .
We feel the negotiated fee is within the normal range for
projects of this size and complexity of this project. Therefore,
we recommend that the Amendment to the Agreement with URS Con-
sultants, Inc. be approved, subject to the necessary supplemental
funding being approved by the IVDA Board.

URGENCY CLAUSE:
There is a possibility that a federal grant can be obtained to
finance the costs for improving these streets. The state of
readiness will be a factor in securing approval of a grant.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF AN AMENDMENT TO AGREEMENT WITH URS CONSULTANTS, INC.
3 RELATING TO THE PROVISION OF PROFESSIONAL ENGINEERING DESIGN
SERVICES FOR THE IMPROVEMENT OF TIPPECANOE AVENUE, DEL ROSA
4 AVENUE AND "C" STREET.
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. The Mayor of the City of San Bernardino is
7
hereby authorized and directed to execute, on behalf of said
8
City, an Amendment to Agreement with URS Consultants, Inc. ,
9
relating to the provision of professional engineering design
10
services for the improvement of Tippecanoe Avenue, Del Rosa
11 Avenue, and "E" Street, in eonnmection with Norton, A.F.B. , a
12
copy of which agreement is attached hereto, marked Exhibit "A"
13
and incorporated herein by reference as fully as though set forth
14
at length.

SECTION 2 . The agreement shall not take effect until
16
fully signed and executed by both parties. The City shall not be
17 obligated hereunder unless and until the agreement is fully
18
executed and no oral agreement relating thereto shall be implied
19
or authorized.

SECTION 3 . The authorization to execute the above-
21
referenced agreement is rescinded if the parties to the agreement
22 fail to execute it within sixty (60) days of the passage of this
23
resolution.

4 This AMENDMENT TO AGREEMENT is made and entered into this
5 day of , 1993, by and between the CITY OF
6 SAN BERNARDINO, California, a municipal corporation, hereinafter
7 referred to as the "CITY" and URS CONSULTANTS, INC. , a California
8 corporation, hereinafter referred to as "ENGINEER. "
9 WITNESSETH
10 WHEREAS, City and Engineer entered into an Agreement on
11 December 21, 1992 , relative to providing professional design
12 services for construction of the Tippecanoe/Del Rosa Avenue
13 Connector; and
14 WHEREAS, this Agreement was for Phase I, Development of
