SUBJECT: Staff Report
Resolution of Intention: A portion of the North/South Alley between 2nd Street and Rialto.
Avenue, West of"P' Street(Caldwell Alley).
BACKGROUND:
On August 26, 1999, this office received a letter from Metrolink, requesting the closure of a
portion of the north/south alley located between 2"d Street and Rialto Avenue, west of"P' Street
(Caldwell Alley). The purpose of this closure is to rehabilitate this segment of the line to extend
the current Metrolink service into the downtown area and provide San Bernardino residents with
an improved alternative means of transportation. The Caldwell Alley crossing is not a major
arterial and carries little to no traffic at all. Upon completion of the vacation proceedings,
Metrolink will incorporate the appropriate K-rail with fencing to preclude vehicular traffic from
crossing this segment of the track. As shown on the attached map, the adjoining parcels would
have access either from Rialto Avenue, "I" Street or 2nd Street.
On December 6, 1999, authorization to proceed with the proposed vacation and Plan No. 10050
were approved. City Departments, utility companies and all adjacent property owners were
notified of the proposal and were given the opportunity to submit easement reservations and any
comments or conflicts. Several responses were received and all were favorable. Southern
California Edison has requested the reservation of an easement for their existing facilities, which
will be reserved in the Resolution of Intention.
The attached Resolution of Intention sets a public hearing for March 6, 2000. Upon approval, the
Resolution will be published in the Sun, the street posted and adjacent property owners will be
given mailed notification of the public hearing. At the Public Hearing, a Resolution Ordering
Vacation will be submitted for your action.
FINANCIAL IMPACT:
None. The applicant has paid the total amount of$1,000 for the completion of the vacation
proceedings.
RECOMMENDATION:
Staff recommends approval of the attached Resolution of Intention.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO DECLARING ITS
3 INTENTION TO ORDER THE VACATION OF A PORTION OF THE NORTH/SOUTH
ALLEY BETWEEN 2ND STREET AND RIALTO AVENUE, WEST OF "P' STREET
4 (CALDWELL ALLEY).
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
6 SAN BERNARDINO AS FOLLOWS:
7 SECTION 1. That the Mayor and Common Council of the City of San Bernardino
8 hereby declares its intention to order the vacation of a portion of the north/south alley between
9 2"" Street and Rialto Avenue, west of"P' Street(Caldwell Alley).

That portion of that certain North/South Alley, 20 feet wide, as delineated on the map
11 of Wallace Subdivision, as per plat recorded in Book 3 of Maps, Page 38, records of
12 the County Recorder of San Bernardino County, State of California, described as
follows:

Beginning at the intersection of the East line of said alley with the South line of the
14 Burlington Northern Santa Fe Rail Road right of way; thence Northwesterly, along
15 the Northwest prolongation of said South line to the West line of said alley; thence
North, along said West line to the North line of said Rail Road right of way; thence
16 Southeasterly, along the Southeast prolongation of said North line, to said East line of
17 said alley; thence South, along said East line to the point of beginning.
18 SECTION 2. That the Mayor and Common Council of the City of San Bernardino, in
19 vacating the above described portion of said street, elects to proceed under and in accordance
20 with the provisions of the "Public Streets, Highways, and Service Easements Vacation Law",
21
22 being Division 9, Part 3, of the Streets and Highways Code of the State of California.
23 SECTION 3. That the hour of 10:00 a.m., on March 6, 2000, in the Council Chambers
24 of City Hall, 300 North "D" Street, San Bernardino, California, is fixed as the time and place
25 when and where all persons interested in or objecting to the proposed vacation may appear before
26 the said Mayor and Common Council and offer evidence in relation thereto.

3 For further particulars as to the proposed vacation, see that map marked "Plan No. 10050",
4 approved on December 6, 1999, attached as Exhibit W.
5 SECTION 4. Nothing in this Resolution shall in any way affect or disturb any existing
6
7 easements for public utility purposes belonging either to the City of San Bernardino or to any
8 public utility and there is hereby specifically reserved for Southern California Edison, an
9 easement to construct, place, operate, inspect, maintain, repair, replace and remove any overhead
10 or underground electrical transmission and/or distribution structure consisting of wires, cables,
11 conduits, poles, pole anchors and guy wires, manholes markers and necessary fixtures and
12
13 appurtenances and said easement shall include rights of ingress and egress.
14 SECTION 5. That the Director of Development Services of the City of San Bernardino
15 hereby is directed to cause Notices of Street Vacation to be posted as required by said "Public
16 Street, Highways and Service Easements Vacation Law."
17 SECTION 6. That the City Clerk shall certify to the adoption of this Resolution of

19 Intention and shall cause the same to be published once a week for two successive weeks in The
20 Sun, a newspaper published and circulated in the City of San Bernardino, prior to the above date
21 set forth for the public hearing.
