MOTION: That the claims and payroll and the authorization to
issue warrants as listed on the memorandum dated
February 2, 2000, from Barbara Pachon, Director of
Finance, be approved.

MOTION: That the personnel actions as submitted by the Chief
Examiner dated February 2, 2000, in accordance with
Civil Service rules and Personnel policies adopted by
the Mayor and Common Council of the City of San
Bernardino, be approved and ratified.

8. Resolution of the Mayor and Common Council of the City of San
Bernardino in support of Proposition 26 - the Let's Fix our Schools
Initiative. (See Attached) (No cost to the City.) (Resolution not

Development Services
9. Resolution of the City of San Bernardino declaring its intention to
order the vacation of a portion of the north/south alley between 2nd
Street and Rialto Avenue, west of "I" Street (Caldwell Alley). (See
Attached) (No cost to the City -- $1,000 processing fee has
been paid by the petitioner.) Ward 3
NOTE: This resolution sets a public hearing for 10:00 a.m.,
Monday, March 6, 2000.
MOTION: That said resolution be adopted.

10. Resolution of the City of San Bernardino authorizing the execution
of an agreement for professional services with Joseph E.
Bonadiman & Associates, Inc. for the design of a master plan
storm drain in Mt. Vernon Avenue from Base Line Street to 16t"
Street. (See Attached) (Cost to the City -- $41,600 from the
Storm Drain Construction Fund.) (Resolution not available at
time of printing.) Ward 6
MOTION: That said resolution be adopted.
11. Resolution of the City of San Bernardino authorizing the execution
of a Third Amendment to Agreement with the Diocese of San
Bernardino Education and Welfare Corporation relating to
extending the use by the City for a portion of Aquinas High School
Park for public recreational purposes in San Bernardino. (See
Attached) (No cost to the City.) Ward 7
MOTION: That said resolution be adopted.
Parks, Recreation & Community Services
12. Resolution of the Mayor and Common Council of the City of San
Bernardino approving the destruction of certain City records of the
Parks, Recreation and Community Services Department. (See
Attached) (No cost to the City.)
MOTION: That said resolution be adopted.
13. Resolution authorizing the Director of Parks, Recreation and
Community Services Department to apply for and administer a
grant in the amount of $25,000 from California Healthy Cities
Communities and Food for All to establish the San Bernardino
Garden Collaborative to promote improved family nutrition to
under-served San Bernardino residents. (See Attached) (No
additional cost to the City if grant is funded; City's in-kind
contributions of $13,732.75 to come from existing department
budget.) (Resolution not available at time of printing.)

14. Resolution of the City of San Bernardino authorizing the execution
of a purchase order to Crest Chevrolet for two Model Year 2000
Chevrolet 1/4-ton extended cab pickups and one 3/4 ton pickup with
service body for the Fire and Parks and Recreation Departments.
(See Attached) (Cost to the City -- $62,779.19 from the Vehicle
Replacement Fund.) (Resolution not available at time of

15. Initiation of a Development Code Amendment to establish social
service uses/facilities as conditionally permitted uses in multi-
family land use districts. (See Attached)
MOTION: That the Mayor and Common Council direct the
Planning Division to initiate an amendment to the
Development Code to establish social service
uses/facilities as conditionally permitted uses in
multi-family land use districts.
16. Initiation of a Development Code Amendment to revise the
standards related to cellular antennas. (See Attached)
MOTION: That the Mayor and Common Council direct the
Planning Division to initiate an amendment to the
Development Code to incorporate siting and design
standards for cellular antennas.

17. Resolution of the Mayor and Common Council of the City of San
Bernardino authorizing the Mayor to execute a service agreement
with Big Red Apple, regarding the marketing and management of
the San Bernardino Stadium. (See Attached) (Cost to the City --
$36,500 for the remainder of FY 1999/00.) (Resolution not
available at time of printing.) Ward 3

18. Public hearing - relative to vacation of alley and execution of
quitclaim deed for sale of City property generally located on the
east side of "F" Street, between 5th and 6th Streets in the City of
San Bernardino. (See Attached) (Cost to the City -- $1,000 from
the General Fund will be offset by $1,500 revenue to the City
from the sale of the property.) Ward 1
Resolution of the City of San Bernardino ordering the vacation of a
portion of that certain east/west alley located east of "F" Street,
between 511, and 6Lh Streets and reserving public utility easements.
Resolution of the City of San Bernardino directing and authorizing
the execution of a sales and purchase agreement and the execution
of a quitclaim deed for the sale of a portion of City property
generally located on the east side of"F" Street, between 5th and 6th
Streets in the City of San Bernardino.
MOTION#l: That the hearing be closed; and the Findings of
Fact as set forth in the Staff Report from the
Director of Development Services, as to why a
portion of the east/west alley east of "F" Street,
between 5th and 6th Streets, is no longer
necessary for public street purposes, be
approved; and

19. Ordinance of the City of San Bernardino amending Chapter 10.52
of the San Bernardino Municipal Code to establish a forty-five mile
per hour speed limit on Fifth Street between Del Rosa Drive and
two-hundred feet east of Victoria Avenue. FIRST READING (See
Attached) (Cost to the City -- $800 from the General Fund.)

20. Ordinance of the City of San Bernardino amending Chapter 10.52
of the San Bernardino Municipal Code to establish a forty mile per
hour speed limit on Fifth Street between Waterman Avenue and

-- $200 from the General Fund.) Ward 2

MOTION: That the Director of Development Services and the City
Clerk be authorized to proceed with the formation of
Underground Utility District No. 28, along portions of
Base Line Street, east of California Street and portions
of Pennsylvania Avenue, north of 9th Street, pursuant
to San Bernardino Municipal Code Section 13.36; and
that said resolution be adopted.

22. Ordinance of the City of San Bernardino adding Section 3.44.131
to the San Bernardino Municipal Code and establishing a Utility
User's Tax Rebate Program. FINAL READING (Backup material

continued from January 24, 2000, Item No. 8.)
MOTION: That the matter be continued to February 22, 2000.

23. Declaration of default by contractor and cancellation of contract -
installation of street trees along Highland Avenue from "E" Street
to Waterman Avenue (Colarossi Construction) per Plan No. 9845.

MOTION: That the Mayor and Common Council declare
Colarossi Construction in default and cancel the
contract pursuant to Section 6-4 "Default by
Contractor" of the Standard Specifications for project
"Installation of Streetscaping on Highland Avenue from
"E" Street to Waterman Avenue per Plan No. 9845."

24. Resolution of the City of San Bernardino preliminarily determining
that the public convenience and necessity require the formation of
a landscape maintenance assessment district located in the Palm
Avenue and Washington Street Area without compliance with the
Investigation, Limitation and Majority Protest Act of 1931;
declaring its intention to proceed to order work within the district,
to be known as Assessment District No. 1025; preliminarily
approving the Engineer's Report and giving notice of a public
meeting and public hearing. (Backup material was distributed
on January 24, 2000, Item No. 10.)
MOTION: That the matter be continued to February 22, 2000.

25. Resolution of the Mayor and Common Council of the City of San
Bernardino authorizing the execution of an agreement with
Steward Development to lease certain real property for the Area "D"
Community Service Office and repealing Resolution No. 91-268.

MOTION #1: That said resolution be adopted.
MOTION #2: That the Director of Finance be authorized to
amend the FY 1998/99 COPS Option Grant
budget as outlined in the staff report.

R26. Resolution of the Community Development Commission of the City
of San Bernardino approving and authorizing the Executive
Director of the Redevelopment Agency (the "Agency") to execute an
agreement between the Agency and Southwestern Security for
Metrolink Security Services. (Backup material was distributed
January 24, 2000, Item No. R26.)
MOTION: That the matter be continued to February- 22, 2000.
27. PUBLIC COMMENTS ON ITEMS NOT ON THE AGENDA A three-
minute limitation shall apply to each member of the public who
wishes to address the Mayor and Common Council/Community
Development Commission on a matter not on the agenda. No
member of the public shall be permitted to "share" his/her three
minutes with any other member of the public. (Usually any items
heard under this heading are referred to staff for further study,
research, completion and/or future Council/Commission action.)

NOTE: The next joint regular meeting is scheduled for 8:00 a.m.,
Tuesday, February 22, 2000, in the Council Chambers of City Hall,
300 North "D" Street, San Bernardino, California.
NOTICE: Any member of the public may address this meeting of
the Mayor and Common Council/Community Development
Commission on any item appearing on the agenda by approaching
the microphone in the Council Chambers when the item about
which the member desires to speak is called and by asking to be
recognized.
Any member of the public desiring to speak to the Mayor and
Common Council/Community Development Commission
concerning any matter not on the agenda but which is within the
subject matter jurisdiction of the Mayor and Common
Council/Community Development Commission, may address the
body at the end of the meeting, during the period reserved for
public comments. Said total period for public comments shall not
exceed forty-five (45) minutes, unless such time limit is extended
by the Mayor and Common Council/Community Development
Commission. A three minute limitation shall apply to each
member of the public, unless such time limit is extended by the
Mayor and Common Council/Community Development
Commission. No member of the public shall be permitted to
"share" his/her three minutes with any other member of the
public.
The Mayor and Common Council/Community Development
Commission may refer any item raised by the public to staff, or to
any commission, board, bureau, or committee for appropriate
action or have the item placed on the next agenda of the Mayor
and Common Council/Community Development Commission.
However, no other action shall be taken nor discussion held by the
Mayor and Common Council/Community Development
Commission on any item which does not appear on the agenda
unless the action is otherwise authorized in accordance with the
provisions of subdivision (b) of Section 54954.2 of the Government
Code.
Public comments will not be received on any item on the agenda
when a public hearing has been conducted and closed.
