Description) Assessment District 953 Finance: Council Notes: Agenda Item No. �� CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Award of Contract - Landscape Maintenance A.D. 953 per plan No. 6177 - L. Barrios and Associates, Inc. Background: Assessment Districts have been formed to provide for the ongoing maintenance of the landscaping in the designated areas. Contracts are awarded and provide for two one-year extensions of the contract on mutually agreeable terms. This Assessment District has had the same form for the past three years and has been rebid in accordance with the contract provisions. Maintenance areas are grouped with other area to form projects of sufficient size as to insure bids are competitive and all contractors have adequate work to justify coming into the area. The area included in this project is 16" street between Medial Center Drive and California St. The area to be maintained is shown on the attached map. Bids were received and opened at 2:00 PM on Tuesday December 8, 1998. A total of 5 bids were received and ranged from a low of$3,795.00 to a high of$7,444.00. The low bid is 14% below the Engineer's Estimate of $4,440.00. On January 11, 1999, Resolution No. 1999-7 was adopted, awarding the contract to Azteca Landscaping, the apparent low bidder. Azteca has since withdrawn their bid and have forfeited their 10% bid desposit of$379.50. The second lowest bidder was L. Barrios & Associates, in the amount of$3,858.12. L. Barrios & Associates also has the existing contract for this area. The current contract amount is $4,675.00. The new contract amount of$3,858.12 is approximately a 17% decrease, thus no increase in assessments is anticipated. Listed below is the estimated contract cost using the second low bid price: Contract Cost $3,858.12 Incidental Costs (Assessment Engineering, Inspection, Water, and Electricity $1,660.71 TOTAL ESTIMATED ANNUAL COST $5,518.83 Financial Impact Funding for the total estimated cost of$5,518.83 is found in Account No. 254-624-5506 and will be recovered through assessments placed on the parcels within the assessment district. BARRIOS AND ASSOCIATES, INC. FOR THE MAINTENANCE OF LANDSCAPING IN 4 ASSESSMENT DISTRICT 953, CALIFORNIA AND 10 STREETS. 5 WHEREAS, on January 11, 1999, the Mayor and Common Council of the City of 6 San Bernardino adopted Resolution No. 1999-7, awarding a contract for the maintenance of 7 8 landscaping in Assessment District No. 953, California and 16th Streets to AZTECA 9 LANDSCAPE, INC., in the amount of$3,795.00, and rejecting all other bids; and 10 WHEREAS, AZTECA LANDSCAPE, INC., has withdrawn its bid prior to 11 execution of said contract and forfeited its bid deposit in the amount of$379.50; and 12 WHEREAS, it is now necessary to award a contract to the second lowest bidder. 13 14 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 15 SECTION 1. Resolution No. 1999-7, adopted by the Mayor and Common Council of 16 17 the City of San Bernardino on January 11, 1999, entitled: 18 "RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT TO AZTECA LANDSCAPE, INC. FOR THE MAINTENANCE 19 OF LANDSCAPING IN ASSESSMENT DISTRICT 953." 20 is hereby rescinded. 21 SECTION 2. L. BARRIOS AND ASSOCIATES, INC. is the second lowest 22 23 responsible bidder for: MAINTENANCE OF LANDSCAPING IN 24 ASSESSMENT DISTRICT NO. 953, CALIFORNIA AND 16TH STREETS, PER PLAN 25 NO.6177, the lowest responsible bidder, AZTECA LANDSCAPE, INC., having withdrawn 26 their bid. A contract is awarded accordingly to said bidder in a total amount of$3,858.1 2 27 28 2/4/99 1 RESOLUTION RESCINDING RESOLUTION NO. 1999-7 AND AWARDING CONTRACT TO L. BARRIOS AND ASSOCIATES, INC. FOR THE MAINTENANCE OF 1 LANDSCAPING IN ASSESSMENT DISTRICT 953. 2 3 but such award shall be effective only upon being fully executed by both parties. All other 4 bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute 5 said contract on behalf of the City; a copy of the contract is on file in the office of the City 6 Clerk and incorporated herein by reference as fully as though set forth at length. 7 SECTION 2. This contract and any amendment or modifications thereto shall not 8 9 take effect or become operative until fully signed and executed by the parties and no party 10 shall be obligated hereunder until the time of such full execution. No oral agreements, 11 amendments, modifications or waivers are intended or authorized and shall not be implied 12 from any act or course of conduct of any parry. 13 SECTION 3. This resolution is rescinded if the parties to the contract fail to execute 14 15 it within sixty (60) days of the passage of the resolution. 16 17 18 19 20 21 22 23 24 25 26 27 28 1/25/99 2 RESOLUTION RESCINDING RESOLUTION NO. 1999-7 AND AWARDING CONTRACT TO L.
