Background: On November 7, 1990, the Planning Commission approved Tentative Tract No. 14112, a 55- lot single family residential subdivision. On May 18, 1994, authorization was given to extend the time limit for approval of the tentative map. An automatic two-year extension was granted according to the provisions of Section 66452.11 of the Subdivision Map Act, which extended the approval date to May 18, 1996. An additional extension was granted according to the provisions of Section 66452.13 of the Subdivision Map Act, extending the approval date to May 18, 1998. The Planning Commission approved the final extension to May 18, 1999. On May 17, 1999, the Mayor and Common Council approved a motion to continue this item to August 16, 1999. On August 16, 1999, the Mayor and Common Council approved a motion to continue this item to December 7, 1999. On December 6, 1999, the Mayor and Common Council approved a motion to continue this item to March 6, 2000. The required improvement securities and certificates of insurance will be filed prior to June 5, 2000, and the prescribed fees will be paid prior to recordation of the final map. Additionally, the improvement and grading plans have been prepared. The Final Map has been reviewed and was found to be substantially in compliance with the Tentative Map and the Subdivision Map Act. The Developer is requesting an additional continuance to -complete the necessary preparation for recording of the final map", per the attached letter. Therefore, we recommend that the matter be continued to June 5, 2000. Financial Impact- There is no financial impact to the City. Recommendation: Staff recommends that the Mayor and Common Council continue this item to the meeting of June 5, 2000. Century Crowell Communities, LP, based here in San Bernardino, has been requesting a 1 91 311 91 5 Assessment District for its projects in the City of San Bernardino, including the above-referenced tract. As the structure of our proposal to acquire Sterling Heights from its current landowners depends on the Assessment District, we cannot complete our negotiations until we have firmly established the City's position. We hope to be able to do this in the near future, after which we intend to conclude our purchase of the land and proceed to record. Your consideration would be greatly appreciated. "D" Street San Bernardino, CA 92418 RE: Sterling Heights - Tract No. 14112 Dear Mr, Grubbs: j As I believe your records reflect, we are attorneys for and are acting on behalf of the current owners of property known as j Sterling Heights, tentative tract number 14112 . The purpose of this letter is to supplement our correspondence of November 17, 1999, wherein we requested a 90 day extension in which to poet the necessary bonds and complete the final map for recording tentative tract number 14112 . The extension was graciously granted through March 6, 2000 , As indicated in the November 17, 1999, letter, my clients have been in ongoing negotiations with Century Crowell Communities, L.P. ("Century") , based in San Bernardino, California, to work out a possible joint venture on the above-referenced tract. However, negotiations to finalize an agreement between the parties have been forestalled as a result of negotiations between Century and the Economic Development Agency of San Bernardino and the City of San Bernardino concerning the request for establishment of an assessment district or other city aid for the development of tract number 14112, in conjunction with the development of at least one other tract, North Park. It was anticipated that the issue of whether an assessment district would be approved for tract number 14112, and the terms thereof, would have been resolved prior to this time so that we could complete our agreement with Century. This has not been the case. Rather, at a meeting of the City's Ways and Means Committee held on January 26, 2000, which the undersigned attended on behalf Of his clients, the matter of the assessment district was tabled, pending further meetings between the parties . A subsequent workshop of the Ways and Means Committee was held last week, and the matter was referred to the City Council without recommendation. Therefore, no final resolution has been reached, j I Page 2 As a result of the foregoing, the owners of Sterling Heights property (Tract No. 14112) , find it necessary to again request a further 90 day extension in order to finalize their agreement with Century and the City of San Bernardino for development of this property. To date, my clients have advanced substantial funds to Integra Engineering for improvement plans and other items necessary for final map approval. Inasmuch as we are quite close to consummating the agreement with Century and hopefully the City of San Bernardino, we hereby request a further extension of 90 days in which to post the necessary bonds and complete the final map for recording. Century will also be submitting its request for the extension by separate letter.
