Recommended Motion: 1. That the public hearing be closed and the Findings of Fact as set forth in the Staff Report from the Director of Development Services, as to why a portion of the north/south alley between 2nd Street and Rialto Avenue, West of "I" Street (Caldwell Alley), is no longer necessary for public street purposes, be adopted. BACKGROUND: On August 26, 1999, this office received a letter from Metrolink, requesting the closure of a portion of the north/south alley located between 2"d Street and Rialto Avenue, west of"I" Street (Caldwell Alley). The purpose of this closure is to rehabilitate this segment of the line to extend the current Metrolink service into the downtown area and provide San Bernardino residents with an improved alternative means of transportation. The Caldwell Alley crossing is not a major arterial and carries little to no traffic at all. Upon completion of the vacation proceedings, Metrolink will incorporate the appropriate K-rail with fencing to preclude vehicular traffic from crossing this segment of the track. As shown on the attached map, the adjoining parcels would have access either from Rialto Avenue,"P' Street or 2"d Street. On December 6, 1999, authorization to proceed with the proposed vacation and Plan No. 10050 were approved. On February 7, 2000, Resolution of Intention No. 2000-19 was adopted, setting a public hearing for March 6, 2000. Notices were posted along the area proposed for vacation and published in the Sun newspaper. Adjacent property owners were also notified of the public hearing by mail. There appears to be no further necessity for the area proposed for vacation for street purposes, and we recommend the vacation based on the following facts: 1. The proposed vacation has been determined by the Director of Development Services to be of no further necessity to the general public. 2. A finding of consistency with the General Plan was made. 3. There have been no objections by any adjoining property owners. 4. All of the City Departments and Public Utility Companies were notified of the proposal and given an opportunity to respond. Certain easements were requested for existing facilities and have been provided for in the Resolution of Intention and the Resolution Ordering Vacation. FINANCIAL IMPACT: The applicant has paid the $1,000 processing fee. RECOMMENDATION: Staff recommends that the public hearing be closed,the Findings of Facts be adopted and that the attached Resolution Ordering Vacation be adopted. That the Mayor and Common Council of the City of San Bernardino, 8 having heard the evidence offered in relation to the proposed vacation of that certain portion of 9 the North/South Alley between 2"" Street and Rialto Avenue, West of "I" Street (Caldwell 10 Alley), described in Resolution of Intention No. 2000-19, hereby find from all of the evidence 11 12 submitted that such portion of said street proposed to be vacated by said Resolution is 13 unnecessary for present and prospective street purposes. 14 SECTION 2. The Mayor and Common Council of said City do hereby vacate that 15 certain portion of the North/South Alley between 2"" Street and Rialto Avenue, West of"I" Street 16 (Caldwell Alley), more fully described as follows: 17 18 That portion of that certain North/South Alley, 20 feet wide, as delineated on the map of Wallace Subdivision, as per plat recorded in Book 3 of Maps, Page 38, records of 19 the County Recorder of San Bernardino County, State of California, described as follows: 20 21 Beginning at the intersection of the East line of said alley with the South line of the Burlington Northern Santa Fe Rail Road right of way; thence Northwesterly, along 22 the Northwest prolongation of said South line to the West line of said alley; thence North, along said West line to the North line of said Rail Road right of way; thence 23 Southeasterly, along the Southeast prolongation of said North line, to said East line of 24 said alley; thence South, along said East line to the point of beginning. 25 Also described in Resolution of Intention No. 2000-19. 26 27 28 ° , a3 02/10/00 U RESOLUTION ORDERING VACATION THAT CERTAIN PORTION OF NORTH/SOUTH ALLEY 1 BETWEEN 2ND STREET AND RIALTO AVENUE WEST OF°P'STREET(CALDWELL ALLEY) 2 3 SECTION 3. Nothing in this Resolution shall in any way affect or disturb any existing 4 easements for public utility purposes belonging either to the City of San Bernardino or to any 5 public utility and there is hereby specifically reserved for Southern California Edison, its 6 successors, heirs and assigns, an easement to construct, place, operate, inspect, maintain, repair, 7 replace and remove any overhead or underground electrical transmission and/or distribution 8 9 structure consisting of wires, cables, conduits, poles, pole anchors and guy wires, manholes 10 markers and necessary fixtures and appurtenances and said easement shall include rights of 11 ingress and egress; and there is hereby specifically reserved for MCI Worldcom, its Successors, 12 heirs and assigns, an easement to construct, place, operate, inspect, maintain, repair and replace 13 underground and overhead structures consisting of wires, cables and necessary fixtures and 14 15 appurtenances and said easement shall includes rights of ingress and egress. 16 . City Departments, utility companies and all adjacent property owners were notified of the proposal and were given the opportunity to submit easement reservations and any comments or conflicts. Several responses were received and all were favorable. Southern California Edison has requested the reservation of an easement for their existing facilities, which will be reserved in the Resolution of Intention. The attached Resolution of Intention sets a public hearing for March 6, 2000. Upon approval, the Resolution will be published in the Sun, the street posted and adjacent property owners will be given mailed notification of the public hearing. At the Public Hearing, a Resolution Ordering Vacation will be submitted for your action. FINANCIAL IMPACT: None. The applicant has paid the total amount of$1,000 for the completion of the vacation proceedings.
