Background: The City received a request from the City of Highland to evaluate the speed limits on 5`h Street in the area generally located between Del Rosa Drive and Victoria Avenue. The Cities of San Bernardino and Highland share jurisdiction in this section of 5th Street per the attached drawing. The City of Highland requested this evaluation in response to complaints regarding the differing speed limits in this area. The City of Highland posted a forty-five (45)mile per hour speed limit within their jurisdiction, while the City of San Bernardino has a fifty (50) mile per hour speed limit posted in an area within these limits. Other segments of this section of 5`h Street are unposted allowing for a maximum speed limit of fifty-five (55) miles per hour. This adds to the driver's confusion in this area. The City of San Bernardino last surveyed this area of 5th Street in July of 1996. Consequently, the posted speed limit is still valid under the state mandated five-year cycle for surveying speed limits. The surveys taken at that time measured the critical speeds at fifty-four (54) miles per hour, making the posted fifty (50) mile per hour speed limit appropriate within this area. However, due to the confusion created by the City of Highland's adjacent speed limits, it is recommended that the City of San Bernardino adopt a forty-five(45) mile per hour speed limit to be consistent with the adjacent speed limits of the City of Highland. This item was continued from the February 7, 2000 City Council meeting to determine if the recommended forty-five (45) mile per hour speed limit will be legally enforceable, since it is lower than the critical speed. Speed zones are more often established at the first, even, five mile increment below the critical speed. City Attorney and Engineering Staff met and it was confirmed that the recommended speed limit is enforceable. It was also agreed that the justification for the recommended speed zone will be attached to the " Request for Council Action". Consequently, attached is the engineering and traffic survey justifying the forty-five (45) mile per hour speed limit as well as an excerpt from the 1996 version of the Caltrans Traffic Manual regarding procedures for establishing/changing speed zones. Financial Impact: The estimated cost of $ 800.00 for the installation of the speed limit signs will come from general fund Account No. 001-307-5111 (Signing and Striping Materials). This action is considered routine and there will be no major impact to the account. Recommendation: Adopt Ordinance establishing a forty-five (45) M.P.H. speed limit within the unposted areas and lower the speed limit in the posted areas from fifty (50) to forty-five (45) miles per hour, all on the section of 5s' Street between Del Rosa Drive and two hundred (200) feet east of Victoria Avenue. Section 10 . 52 . 040 of the San Bernardino 5 unicipal Code is amended to read: 6 "10 .52 . 040 FORTY-FIVE MILES PER HOUR 7 8 In accordance with and pursuant to the authority of Sections 22357, 22358 , and 22360, of the California Vehicle 9 Code, the Mayor and Common Council do hereby determine and 10 declare upon the basis of an engineering and traffic survey 11 that a prima facie speed limit of forty-five miles per hour 12 hall be established upon the following streets or portions 13 hereof in the City: 14 BASE LINE STREET: Between California Street and Medical �✓ 15 Center Drive. 16 CENTRAL AVENUE : Between Arrowhead Avenue and Tippecanoe Avenue. 17 DEL ROSA AVENUE: Between Marshall Boulevard and Thirty- 18 Ninth Street 19 FIFTH STREET: Between Del Rosa Drive and two-hundred feet east of Victoria Avenue. 20 FORTIETH STREET: Between Kendall Drive and Electric 21 Avenue; Between Waterman Avenue and Golden Avenue. 22 FOURTH STREET: Between Tia Juana Street and Mount Vernon Avenue . 23 HUNTS LANE: Between Barton Road and Commercial Road. 24 LITTLE MOUNTAIN DRIVE: Between Twenty-Seventh Street and 25 Northpark Boulevard. 26 NINTH STREET: Between Waterman Avenue and a point six hundred (600) feet east of Preston Street . © 27 28 -1- ORD: AMENDING CHAPTER 10 .52 OF SBMC TO ESTABLISH A 45 M.P.H.
