STAFF REPORT
SUBJECT:
Authorizing submission of application for Waste Tire Enforcement Grant Funds from the
California Integrated Waste Management Board.
BACKGROUND:
California Integrated Waste Management Board(Board) receives an annual appropriation from the
California Tire Recycling Management Fund to administer the Tire Recycling Act and related
legislation. The Board has allocated funds for the Waste Tire Enforcement Grant Program.
Funds allocated by the Board for the Waste Tire Enforcement Grant are for inspection, compliance
and survey activities at waste tire facilities,tire dealers and auto dismantlers. The intent of this
activity is to develop and implement an effective inspection and compliance program at the local
level that will provide guidance to facility operators, and if necessary,take initial enforcement action
necessary to remediate threats to public health, safety,and the environment.
These activities will enhance the City's current tire enforcement program and compliment
enforcement actions by the State. To date, a total of 77 inspections of local tire dealers were
successfully completed by the City's Environmental Projects staff. Of these inspections, it was
determined that a single site was not in compliance with State laws.
The total number of registered haulers within the City has increased by 60% since last year. In
addition,training was offered to the Police Department on the current waste tire storage and hauling
regulations. Currently,the City is in the final phase of completing enforcement and survey activities
for the 1999/00 Waste Tire Enforcement Grant. The City has noticed a substantial decrease in the
number of illegally stockpiled tires as a result of the program.
Grant funds will be used by the City to continue local monitoring,enforcement, and education
efforts for a third year. This will permit the City to continue the current education and monitoring
of waste tire generators and haulers.
The grant term is from July 1, 2000 through April 1,2002.
FINANCIAL IMPACT:
The amount requested in grant funding is $21,990 for a two year period. There are no matching
funds required by the City. Of this total request,$10,693 per year is used to offset personnel costs
within the Environmental Projects Division. The remaining$604 will be utilized for printing and
distribution of educational materials.
RECOMMENDATION:
Staff recommends adoption of the attached resolution authorizing submission of this application for
grant funds.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
5 CITY OF SAN BERNARDINO AS FOLLOWS:
6 WHEREAS, funds allocated are available from the California Integrated Waste
7 Management Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and
8
9 counties with regulatory authority within the city and county government to perform waste tire
10 enforcement surveys and compliance activities at waste tire facilities; and
11 WHEREAS,the City proposes to implement a Waste Tire Enforcement Program that
12 involves inspection and compliance activities at tire dealers, auto dismantlers, and waste tire
13 facilities that will reduce illegal stockpiling and disposal of waste tires. The City has demonstrated
14 it has sufficient staff resources, technical expertise, and experience with similar projects to carry
15 out the proposed program;
16 NOW,THEREFORE, be it resolved that the Mayor and Common Council of the City
17
18 of San Bernardino authorizes the submittal of an application to the California Integrated Waste
19 Management Board for a Waste Tire Enforcement Grant (attached hereto as Exhibit "A"). The
20 Director of Public Services of the City of San Bernardino, or his designee, is hereby authorized to
21 execute in the name of the City of San Bernardino all necessary contracts, agreements, and
22 amendments for the purposes of securing grant funds and to implement and carry out the
23 purposes specified in the application.
24 The authorization to execute the above referenced is rescinded if it is not issued within
25 sixty(60) days of the passage of this resolution.

NEED
The City of San Bernardino is a full service city with a population of 182,500 people in a
55 square mile area. The City adopted its charter in 1905 and has a strong Mayor form of
government, with a seven-member Council elected by ward.
The City of San Bernardino experiences an on-going social and economic problem
resulting from illegal dumping and stockpiling of tires. This problem includes the
following attributes:
• Annually, the City estimates that 258,000 waste tires may be generated within the
City, of which at least 40V#may illegally transport6d and/or disposed of within the
City.
• On public right-of-ways, approximately 10%ofthe City's right-of-way crew's time is
directed towards the problem of illegal tire dumping. This represents a significant
cost to the City.
The illegal stockpiling and disposal of waste tires within the City of San Bernardino
contributes significantly to the overall problem of blight within the City, resulting in
reduced property values and depressed conditions. When tires are illegally dumped on
private property, it becomes the responsibility for the property owner to remove them. If
the property owner fails to take action, the City, through an abatement process, will
remove the tires and place a lien on the property for the costs of abatement. In some
locations, these property owners are repeatedly victimized by illegal Lire dumping, to the
point that the abatement liens exceed the value of their property. Illegal tire dumping
further contributes to secondary problems such as illegal trash dumping and graffiti. Tire
piles also provide a breeding ground for rodents and mosquitoes. These vectors are
known to carry diseases that threaten public health
The City received funding for a second gram term in 1999 from the C1WMB for the
implementation of a Waste Tire Enforcement Crrant. Site visits to facilities development
and distribution of educations) materials and coordinated cooperation from related
departments were the key elements of this grant. Through the grant, the City was able to
continue using our easy-to-understand brochure that contained in formation on titre
disposal regulations, necessary fire department permits, and options for lire disposal
services. Instead of handing the brochure during the site visit, staff found that it was
more effective to mail the brochure along with a letter to notify the facility of our
upcoming visit. This gave facility managers ample time to gather the required materials
for inspection and also gave them an opportunity to ask questions and discuss the
material with a City staff member prior to an inspection. This approach gave facility
managers plenty of time to prepare for the inspection and the opportunity to address any
issues with non-compliance. Overall, facility managers were appreciative of this method
because the inspections didn't interfere with their business day. However, regular
unscheduled site visits still prove to be the most effective method of ensuring
compliance.

inspection/compliance and survey activities on identified sites within the grant term.
Surveys will be completed on a monthly basis and reports shall be filed with the CfWMB
monthly.
Objective 4—Comp6aoce Activity
The City will review the twenty-two identified waste tire facilities within the City during
the Initial Field Survey to determine current status at each site. In addition, the City will
identify any new or previously undisclosed sites.
Once a site has been determined to accept or store 500 or more tires, the City shall
prepare and issue a Letter of Violation (LOV) to the owner/operator of the site. If a
facility is non-compliant, copies of the LOV shall be forwarded to the City's Code
Compliance and Fire Departments to ensure a complete, thorough review of each site and
a coordinated response to any potential violations, if necessary. Once a facility is
determined to be in compliance with the regulations staff will send a letter notifying
them that there were no violations found during the inspection.
On a weekly basis, the City shall monitor the issuance of the LOVs to ensure the receipt
of Corrective Action Plans (CAP) by the deadlines outlined in the LOV. Upon receipt of
the CAP, the City will forward a copy of the CAP to the CIWMB's Tire and Enforcement
Agency, Permitting and Enforcement Section for review. Upon review and approval of
the CAP, the City will continue to monitor each site to ensure the CAP time schedule is
being met.
A Warning Letter will be issued by the City in the event that the owner/operator of the
site fails to submit a CAP, or fails to comply with the schedule outlined in the CAP. The
Warning Letter will identify the action(s)the owner/operator must undertake to come into
compliance and the deadline for completion
When unable to obtain a CAP or when the owner/operator continually fails to meet the
deadlines set forth in the Warning Letter, the City will refer the file to the CIWMB's Tire
and Enforcement Agency, Permitting and Enforcement Section for additional
enforcement. When necessary the City will coordinate a response against the
owner/operator through the City Attorney's Office for possible civil or criminal
prosecution. This objective will be ongoing throughout the grant term
METHODOLOGY
The City will utilize staff from the Public Services
inspection/compliance and survey activities outlined in this eM to conduct the

Special Waste Coordinator is primarily responsible for the implementation of the
Household Hazardous Waste Program, the Used Oil Prograrn, and the Waste Tire
Program. The Special Waste Coordinator will be continue to be responsible for the
implementation and management of this program when grant funding is no longer
available.

Quafificafionr
The City's Department of Public Services has a full-time permanent staff of 187. The
Department's Refuse Division is comprised of the Automated Residential Collection
Unit, the Subscription Refuse Service Unit, the Street Sweeping Unit, and the Recycling
and Environmental Projects Unit, and Refuse Administration. The Refuse Division is
responsible for the collection of refuse, recyclables, green waste and waste tires from
residential and commercial accounts within the City's corporate boundaries.
In 1995, the City of San Bernardino enacted a local ordinance and designed a program to
deal with the issue of illegal tire disposal within the City. The City adopted the Used Tire
Management Ordinance on June 20,1995, attempting to dose several leaks in the State's
waste tire reporting and manifest programs. The ordinance included an increased local
penalty for illegal tire dumping. Under this program, staff visited all identified sellers of
new and used tires within the City and provided them with information regarding both the
State's waste management programs and the City's ordinance. Field audits of dealers to
ensure compliance with local and state requirements were also planned. The passage of
AB 2108, which changed the point of collection fee to the point of retail purchase on
January 1, 1997, combined with a change in City staff resulted in the City temporarily
suspending the active development of it's Used Tire Management Program.
The City has worked closely with the Tire Enforcement Unit of the CIWMB in order to
seek abatement of illegal tire stockpiles within the City. As a result of this joint effort
several tire piles were abated, either through direct threat of legal action from both the
State and City levels, or through an increased awareness and closer monitoring at the City
level. In addition, the City's residential refuse collection service permits residents to
discard one tire per collection day, with a maximum of four tires in any three-month
period. These tires are collected separate from the refuse and diverted to a local tire
processor. In 1999, the City collected approximately 102 tons or 8160 tires.
Over the past five years the City has coordinated enforcement activities with the
CIWMB's Tire and Enforcement Agency, Permitting and Enforcement Section,
demonstrating the City's ability and capacity to carry out these actions in a timely
manner. Additionally, the City received funding from the CIWMB for the
implementation of a 1999/00 Waste Tire Enforcement Grant_ The City is close to
completion of this grant program
Management Personnel
Sylvia Juarez, Environmental Projects Assistant, has coordinated the City's Waste Tire
Surveillence and Enforcement Program for the past two years. In addition to the Waste
Tire Program Ms. Juarez works with other staff members in coordinating the City's Used
Oil Program and the City's Household Hazardous Waste Program Ms. Juarez has a
Bachelor of Science Degree in Environmental Studies from the California State
University, San Bernardino.
Linda Ceballos, Environmental Projects Coordinator, has over five years of experience in
the development and implementation of grant funded community resource programs for
the City. Ms. Ceballos supervises a staff that includes four full-time Environmental

There are currently 62 tire dealers and 8 dismantlers within the City of San Bernardino;
twenty-two of these facilities have been identified to store more than 500 tires. The
estimated costs include all inspection/compliance and survey activities required to
complete the activities within the grant term. The City believes that the funding is
adequate to accomplish the tasks outlined. In addition to the work statement, a
description is provided summarizing required expenses. A budget itemization is provided
(Exhibit Q.

I am writing this letter in support of continuation of the Waste Tire Grant received by the City of San
Bernardino. The Code Compliance Department has had malty opportunities to see the impact the funding
has had on our City.
In addition training was provided to Code Compliance staff helping us to understand the issues and what
we could do to help. Since then staff has on numerous occasions referred property owners to the program
to assist then in clearing their properties of illegally dtmtped tires. Asa result of the program we have had
several vacant lots cleared of illegally dumped tires and although we still experience illegal dumping of
tires we have seen a reduction of these incidents.
It is very important that we have continued funding for this program;although last years funding has us
headed in the right direction there is still a lot of work to be done.

3 SUBMISSION OF WASTE TIRE ENFORCEMENT GRANT APPLICATION FROM

THE, CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD..
5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

7 WHEREAS, funds allocated are available from the California Integrated Waste
8 Management Board for grants to solid waste Local Enforcement Agencies (LEA)and cities and
9 counties with regulatory authority within the city and county government to perform waste tire
10 enforcement surveys and compliance activities at waste tire facilities; and
11 WHEREAS,the City proposes to implement a Waste Tire Enforcement Program that
12 involves inspection and compliance activities at tire dealers, auto dismantlers, and waste tire
13 facilities that will reduce illegal stockpiling and disposal of waste tires. The City has demonstrated
14 it has sufficient staff resources, technical expertise, and experience with similar projects to carry

17 NOW, THEREFORE, be it resolved that the Mayor and Common Council of the City
18 of San Bernardino authorizes the submittal of an application to the California Integrated Waste
19 Management Board for a Waste Tire Enforcement Gnat The Director of Public Services of the
20 City of San Bernardino, or his designee, is hereby authorized to execute in the name of the City of
21 San Bernardino all necessary applications, contracts, agreements,and amendments for the
22 Purposes of securing grant funds and to implement and carry out the purposes specified in the

Demonstration of Recycling Program

Demonstration of Recycling Program
The City of San Bernardino Public Services Department implemented a curbside,
commingled recycling program for residents in 1995. The City provides curbside,
commingled recycling service to 45,000 single-family residencies within the City.
Residents participating in the program have an opportunity to recycle glass, plastic,
aluminum cans, steel cans, newspaper, mixed paper, cardboard. The City also provides
the opportunity for residents to recycle greenwaste, used tires and used motor oil and
filters. These items are collected curbside for the residents.
In addition to residential recycling the City has also implemented a commingled
recycling program for businesses.
The City's Municipal Code 8.24 sets forth the definition of recyclable materials and
services provided by the City. Resolution 98-228 established rates for City refuse and
recycling services.
