BACKGROUND On February 15, 1999, the Mayor and Common Council approved a project to install an above ground fuel tank at Fire Station 233. Using CDBG funds. The City removed the in-ground fuel storage tank at this location in December 1998,to comply with federal laws. This tank will allow the Fire Department to have fuel on the northwest side of the City to replenish their fire apparatus on an ongoing basis. The project consists of the installation of a 2000-gallon above ground concrete fuel tank. The project also includes a fuel dispenser and all required peripheral items to make a complete installation in compliance with all municipal, state and federal codes. Requests for Bids were mailed to six vendors plus advertised in the newspaper and on the internet. Three bids for the project were received on February 17, 2000. The bids ranged from $25,005.60 to $31,880, with George Bryant Construction, Inc. being the lowest bidder. There were no local San Bernardino businesses identified that could perform this work. Therefore, this project will be 100%reimbursable from the CDBG grant and will be accomplished at no cost to the City. Invoices will be approved by Facilities Management and then given to EDA to pay from CDBG funds. GEORGE BRYANT CONSTRUCTION, INC., is the lowest responsible 10 bidder for the Installation of an above ground fuel tank at Fire Station 233 per Plan No. F00-41. 11 A contract is awarded accordingly to said bidder in a total amount of S25,005.60. Such award shall 12 be effective only upon being fully executed by both parties. All other bids, therefore,are hereby 13 rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the C 14 City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by 15 16 reference as fully as though set forth at length. 17 SECTION 2. This contract and any amendment or modifications thereto shall not take 18 effect or become operative until fully signed and executed by the parties and no party shall be 19 obligated hereunder until the time of such full execution. No oral agreements,amendments, 20 modifications or waivers are intended or authorized and shall not be implied from any act or 21 course of conduct of an a Y party. 22 23 SECTION 3.
