MC-926 2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA 3 ESTABLISHING AND AMENDING CERTAIN LIMITATIONS WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE 4 TRI-CITY REDEVELOPMENT PROJECT 5 6 WHEREAS, the Redevelopment Agency of the City of 7 San Bernardino (the "Agency") , has formulated, prepared and 8 approved the Redevelopment Plan for the Tri-City Redevelopment 9 Project (the "Redevelopment Plan") ; and 10 11 WHEREAS, the Mayor and Common Council of the City 12 of San Bernardino (the "City Council") , approved and adopted the 13 Redevelopment Plan pursuant to a duly enacted Ordinance on June 14 20, 1983 ; and 15 16 WHEREAS, Section 33333 . 6 of the California 17 Community Redevelopment Law has established certain limitations 18 on the incurring and repaying of indebtedness and the duration of 19 redevelopment plans, which limitations apply to every 20 redevelopment plan adopted on or before December 31, 1993 ; and 21 22 WHEREAS, Section 33333 . 6 further provides that 23 unless a redevelopment plan adopted prior to January 1, 1994 , 24 already contains limitations which comply with that Section, the 25 legislative body shall adopt an ordinance on or before December 26 31, 1994, to amend the redevelopment plan either 1) to amend an 27 existing time limit that exceeds the applicable time limit 28 established by that Section, or 2) to establish time limits that - 1 - MC-926 1 do not exceed the provisions of that Section; and 2 3 WHEREAS, the time limit on the effectiveness of 4 the Redevelopment Plan as set forth in Section VIII of the 5 Redevelopment Plan, currently scheduled to terminate on July 2023 6 (forty (40) years from the date of adoption of the Plan) does not 7 exceed the time limit established by Section 33333 . 6 (b) ; and 8 therefore no amendment is required related to such limitation. 9 10 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 11 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS: 12 13 Section 1. The first sentence of the second to 14 last paragraph of Section VI (B) of the Redevelopment Plan which 15 establishes the time limit on establishing loans, advances, and 16 indebtedness, is hereby amended to read: "No loan, advance, or 17 indebtedness to be repaid from such allocations of taxes 18 established or incurred by the Agency to finance in whole or part 19 the Redevelopment Project shall be established or incurred after 20 January 1, 2004" . 21 22 Section 2 . The second sentence of the second 23 to last paragraph of Section VI (B) of the Redevelopment Plan is 24 hereby amended to read: "The Agency shall not pay indebtedness 25 or receive property taxes pursuant to Section 33670 after ten 26 (10) years from the termination of the effective date of the 27 Redevelopment Plan" . Based upon the termination date set forth 28 on the Redevelopment Plan, the Agency shall not pay indebtedness - 2 - MC-926 1 or receive property taxes pursuant to Section 33670 after June, 2 2033 . 3 4 Section 3 . The City Clerk is hereby directed 5 to send a Certified copy of this Ordinance to the Agency. 6 7 Section 4. Effective Date. This Ordinance 8 shall be in full force and effect thirty (30) days after its 9 passage. 10 11 Section 5. Publication. The City Clerk is 12 hereby ordered and directed to certify to the passage of this 13 Ordinance and cause the same to be published once in the Sun, a 14 newspaper of general circulation published and circulated in the 15 City of San Bernardino, California. 16 17 Section 6.
