2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA
3 ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
4 CENTRAL CITY SOUTH REDEVELOPMENT PROJECT

6 WHEREAS, the Redevelopment Agency of the City of San
7 Bernardino (the "Agency") , has formulated, prepared and approved
8 the Redevelopment Plan for the Central City South Redevelopment
9 Project (the "Redevelopment Plan") ; and
10
11 WHEREAS, the Mayor and Common Council of the City of
12 San Bernardino (the "City Council") , approved and adopted the
13 Redevelopment Plan pursuant to a duly enacted Ordinance on May 3,
14 1976; and
15
16 WHEREAS, Section 33333 . 6 of the California Community
17 Redevelopment Law has established certain limitations on the
18 incurring and repaying of indebtedness and the duration of
19 redevelopment plans, which limitations apply to every
20 redevelopment plan adopted on or before December 31, 1993 ; and
21
22 WHEREAS, Section 33333 . 6 further provides that unless
23 a redevelopment plan adopted prior to January 1, 1994, already
24 contains limitations which comply with that Section, the
25 legislative body shall adopt an ordinance on or before December
26 31, 1994, to amend the redevelopment plan either 1) to amend an
27 existing time limit that exceeds the applicable time limit

1 established by that Section, or 2) to establish time limits that
2 do not exceed the provisions of that Section.

4 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
5 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

7 Section 1. The provisions of this Ordinance shall
8 supersede any prior amendments to the Redevelpment Plan.

10 Section 2 . Section IX of the original Redevelopment
11 Plan which establishes the time limit on the effectiveness of the
12 Redevelopment Plan is hereby amended in its entirety to read as
13 follows: "Except for the non-discrimination and non-segregation
14 provision, which shall run in perpetuity, the provisions of this
15 Plan shall be effective and the provisions of other documents
16 formulated pursuant to this Plan may be made effective for forty
17 (40) years from the date of adoption of this Plan by the Mayor
18 and Common Counsel of the City of San Bernardino.

20 Section 3 . A new paragraph shall be added to
21 Subsection B of Section VI of the Redevelopment Plan to read as
22 follows: "The Agency shall not pay indebtedness or receive
23 property taxes pursuant to Section 33670 after ten (10) years
24 from the termination of the effective date of the Redevelopment
25 Plan".
26 Section 4. The City Clerk is hereby directed to
27 send a Certified copy of this Ordinance to the Agency.

1 Section 5. Effective Date. This Ordinance shall be
2 in full force and effect thirty (30) days after its passage.

4 Section 6. Publication. The City Clerk is hereby
5 ordered and directed to certify to the passage of this Ordinance
6 and cause the same to be published once in the Sun, a newspaper
7 of general circulation published and circulated in the City of
8 San Bernardino, California.

10 Section 7. If any part of this ordinance is held to
11 be invalid for any reason, such decision shall not affect the
12 validity of the remaining portion of this Ordinance and the City
13 Council hereby declares that it would have passed the remainder
14 of this Ordinance, if such valid portion thereof had been
15 deleted.
