2 AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO, CALIFORNIA
3 ESTABLISHING AND AMENDING CERTAIN LIMITATIONS
WITH RESPECT TO THE REDEVELOPMENT PLAN FOR THE
4 SOUTHEAST INDUSTRIAL PARK REDEVELOPMENT PROJECT

6 WHEREAS, the Redevelopment Agency of the City of
7 San Bernardino (the "Agency") , has formulated, prepared and
8 approved the Redevelopment Plan for the Southeast Industrial Park
9 Redevelopment Project (the "Redevelopment Plan") ; and
10
11 WHEREAS, the Mayor and Common Council of the City
12 of San Bernardino (the "City Council") , approved and adopted the
13 Redevelopment Plan pursuant to a duly enacted Ordinance on June
14 21, 1976; and
15
16 WHEREAS, Section 33333 . 6 of the California
17 Community Redevelopment Law has established certain limitations
18 on the incurring and repaying of indebtedness and the duration of
19 redevelopment plans, which limitations apply to every
20 redevelopment plan adopted on or before December 31, 1993 ; and
21
22 WHEREAS, Section 33333 . 6 further provides that
23 unless a redevelopment plan adopted prior to January 1, 1994,
24 already contains limitations which comply with that Section, the
25 legislative body shall adopt an ordinance on or before December
26 31, 1994, to amend the redevelopment plan either 1) to amend an
27 existing time limit that exceeds the applicable time limit
28 established by that Section, or 2) to establish time limits that

1 do not exceed the provisions of that Section.

3 BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
4 BERNARDINO, STATE OF CALIFORNIA, AS FOLLOWS:

6 Section 1. Section IX of the Redevelopment Plan
7 which establishes the time limit on the effectiveness of the
8 Redevelopment Plan is hereby amended in its entirety to read as
9 follows: "Except for the non-discrimination and non-segregation
10 provisions, which shall run in perpetuity, the provisions of this
11 Plan shall be effective and the provisions of other documents
12 formulated pursuant to this Plan may be made effective for forty
13 (40) years from the date of adoption of this Plan by the Mayor
14 and Common Council of the City of San Bernardino.

16 Section 2 . A new subparagraph "D" is added to
17 Section VI of the Redevelopment Plan entitled "Limitations" which
18 shall read: The Agency shall not pay indebtedness or receive
19 property taxes pursuant to Section 33670 after ten (10) years
20 from the termination of the expiration date of the Redevelopment
21 Plan.

23 Section 3 . The City Clerk is hereby directed
24 to send a Certified copy of this Ordinance to the Agency.

26 Section 4 . Effective Date. This Ordinance
27 shall be in full force and effect thirty (30) days after its
28 passage.

1 Section 5. Publication. The City Clerk is
2 hereby ordered and directed to certify to the passage of this
3 Ordinance and cause the same to be published once in the Sun, a
4 newspaper of general circulation published and circulated in the
5 City of San Bernardino, California.

7 Section 6. If any part of this Ordinance is
8 held to be invalid for any reason, such decision shall not affect
9 the validity of the remaining portion of this Ordinance and the
10 City Council hereby declares that it would have passed the
11 remainder of this Ordinance, if such valid portion thereof had
12 been deleted.
