HomeMy WebLinkAbout01-15-2002 Minutes (2) MINUTES MAYOR AND COMMON COUNCIL AND COMMUNITY DEVELOPMENT COMMISSION JOINT SPECIAL MEETING JANUARY 15,2002 COUNCIL CHAMBERS NOTICE IS HEREBY GIVEN that the Mayor and Common Council and Community Development Commission of the City of San Bernardino have called a joint special meeting of the Mayor and Common Council and Community Development Commission for 1:30 p.m., Tuesday, January IS, 2002, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The purpose for which this meeting was called was to discuss those items listed below as Agenda Item Nos. 1, 2, 3, and 4. The joint special meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor/Chairman Valles at 3:40 p.m., Tuesday, January IS, 2002, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. RollCall Roll call was taken by City Clerk Clark with the following being present: Mayor/Chairman Valles; Council Members/Commissioners Estrada, Lien, Schnetz, Suarez, Anderson, McCammack; City Attorney Penman, City Clerk Clark, City Administrator Wilson. Absent: Council Member/Commissioner McGinnis. 1. Discuss & take possible action - agreement among City of San Bernardino, San Bernardino Stampede, Inc., Arrowhead Credit Union - name rights of the stadium Council Member/Commissioner Anderson made a motion, seconded by Council Member/Commissioner Suarez, that the Mayor be authorized to execute an agreement on behalf of the City of San Bernardino with the San Bernardino Stampede, Inc., and the Arrowhead Credit Union relative to the name rights of the Stadium, with document changes as delineated by Senior Assistant City Attorney Carlyle and submitted to City Clerk Clark. . The motion carried by the Members/Commissioners Estrada, McCammack. Nays: None. Absent: following vote: Ayes: Council Lien, Schnetz, Suarez, Anderson, Council Member/Commissioner McGinnis. I 1/15/2002 2. Discnss & take possible action - amendment relative to specific provisions in the lease on behalf of the City of San Bernardino with the San Bernardino Stampede, Inc. City Attorney Penman reviewed changes to the document with the Mayor and Council, which were then incorporated into the motion for approval. City Attorney Penman, members of the Council, Larry Sharp of the Arrowhead Credit Union, and Dave Oldham of the Stampede Baseball expressed thanks and appreciation to everyone involved in bringing this partnership together and how it will ultimately benefit the city. Council Member/Commissioner Schnetz made a motion, seconded by Council Member/Commissioner Estrada, that the Mayor be authorized to execute an amendment relative to specific provisions in the Lease on behalf of the City of San Bernardino with the San Bernardino Stampede, Inc., with changes as follows: Page I, third line up from the bottom, where the word "sixty" is crossed out and "45 days" added, it would read instead, "All of the dates for the City's use or City-sponsored use during the minor league baseball season must be provided to Tenant at least 70 days in advance and at least 45 days in advance for nonprofit- sponsored events. Neither the timing nor the type of use shall interfere with or in any way impair Tenant's use. Tenant shall have the right to reschedule any such City event by written notice to the City delivered at least 60 days (35 days for nonprofit-sponsored events) before the event is then scheduled to occur." (Remaining sentences in that paragraph remain the same.) Additionally, under 2.01.1, City Use, the third line up from the bottom of that particular paragraph shall read, "In no event will Tenant impose any charges, fees, or other costs on' City, participants, or attendees for City use or City-sponsored use of its stadium at any time. City shall be responsible for clean up after any City sponsored event." The motion carried by the Members/Commissioners Estrada, McCammack. Nays: None. Absent: following vote: Ayes: Council Lien, Schnetz, Suarez, Anderson, Council Member/Commissioner McGinnis. 3. Discnss & take possible action - assignment of lease from the City of San Bernardino to the Redevelopment Agency of the City of San Bernardino Council Member/Commissioner Schnetz made a motion, seconded by Council Member/Commissioner Lien, that the matter be tabled. The motion carried by the Members/Commissioners Estrada, McCammack.Nays: None. Absent: following vote: Ayes: Council Lien, Schnetz, Suarez, Anderson, Council Member/Commissioner McGinnis. 2 1/15/2002 4. Closed Session Conference with legal counsel - anticipated litigation - initiation of litigation - pursuant to subsection (c) of Government Code Section 54956.9: City v. Stampede Baseball 5. Adjournment At 3:53 p.m. the meeting adjourned. The next joint regular meeting of the Mayor and Common Council and Community Development Commission is scheduled for 8 a.m., Tuesday, January 22, 2002, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California.
