I ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING ORDINANCE
INO. 2431 ENTITLED IN PART "AN ORDINANCE REGULATING THE FENCING,
ICONSTRUCTION AND MAINTENANCE OF SWIMMING POOLS", TO CHANGE THE
DEPTH OF POOLS PERMITTED WITHOUT ENCLOSURES, AND TO REQUIRE POOLS
TO BE ENCLOSED SEPARATELY FROM PARKING AREAS.

I THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Ordinance No. 2431, Section Three, Subsection

(a) is amended to read as follows:

"(a) Each person in possession of land within the City of
10 San Bernardino, as owner, purchaser under contract, lessee,
II tenant, licensee or otherwise, upon which is situated a swimming
12 pool or other out-of-doors body of water or structure designed,
13 constructed or used, or capable of being used, for swimming or
14 bathing, having a depth in excess of 18 inches, shall maintain
15 on the premises, completely surrounding the pool or body of water,
16 a fence or wall not less than four feet in height. There shall
17 be no openings, holes, or gaps in the fence or wall larger than
18 four inches square, except that if a picket fence or other fence
19 constructed of vertical members is maintained, the open space
20 between the pickets or vertical members shall not exceed four
21 inches horizontally and shall be not less than 36 inches vertical-
22 ly. Openings, holes, or gaps shall not be constructed or main-
23 tained in a horizontal series constituting steps or other means
24 of access. A dwelling house or accessory building may be used
25 as part of the required fence or wall."

SECTION 2. Ordinance No. 2431, Section Three, Subsection
27 (b) is amended to read as follows:
