STAFF REPORT
Bids for this project were opened at 2:00 p.m. on Friday,
9-22-89.
A total of 6 bids were received, ranging from $604,320.45
to $785,966.34. The low bid of $604,320.45 is 34.8% under the
Engineer's Estimate of $926,797.00.
Listed below is an estimate of the total project cost,
based upon the actual low bid price.

The underwriters, Stone & Youngberg, will be purchasing
the bonds by negotiated sale, as provided in their Agreement for
Professional Services. The proceeds of these bonds will be used
to finance the costs for this contract, plus incidental fees.
At their meeting of 12-17-87, the City's Environmental
Review Committee determined that this project is categorically
exempt from provisions of the California Environmental Quality
Act.
We recommend that a contract be awarded for the low bid.

RESOLUTION OF THE MAYOR AND COMMON
COUNCIL OF THE CITY OF SAN BERNARDINO
AWARDING A CONTRACT TO RIVERSIDE CONSTRUCTION COMPANY

WHEREAS, on September 6, 1989, the Mayor and Coinmon
Council (the "Cornmon Council") of the City of San Bernardino,
California ("the City"), adopted Resolution No. 89-346, the
Resolution
of
Intention
for
Assessment
District
No.
985,
declaring its intention, pursuant to the provisions of Division
12 of the Streets and Highways Code of the State of California,
the Municipal Improvement Act of 1913, to order the acquisition
and construction of certain public improvements described
therein; and
WHEREAS, Willdan Associates, Inc., the Engineer of Work
(the "Engineer"), has prepared a report pursuant to Sections
10203 and 10204 of said Code, and said report has been confirmed
by the Cornmon Council and is now on file in the office of the
City Clerk of the City of San Bernardino; and
WHEREAS, the Cornmon Council has ordered the publication
of a notice inviting sealed proposals or bids for the construc-
tion of said improvements; and
WHEREAS,
pursuant to
said
notice
inviting sealed
proposals or bids the Cornmon Council did, at the time and place
specified in said notice as the time and place for opening sealed
proposals of bids: 2:00 p.m. September 22, 1989, at the Public
Works Department on the third floor of the City Hall of the City,

WHEREAS, the Director of Public Works/City Engineer has
examined all proposals or bids submitted and has made his report
to the Common Council regarding the proposals or bids submitted;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF .THE CITY OF SAN BERNARDINO, AS FOLLOWS:
SECTION 1. Riverside Construction Company is the lowest
responsible bidder for Improvement of Industrial Parkway, from
Palm Avenue to Cable Canyon Channel, in accordance with Plan No.
7732, for the total amount of $604,320.45, and a contract is
awarded to said bidder accordingly, but such award shall be
effective only upon the contract being fully executed by both
parties; all other bids therefore are hereby rejected; and the
Mayor is hereby authorized and directed to execute said contract
on behalf of the City; a copy of the contract is attached hereto,
marked Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements, amendments, modifications or waivers are in-
tended or authorized and shall not be implied
from any act or
course of conduct of any party.
SECIrION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.

SECTION 4.
Reference is made to Resolution No. 89-346
and to
the Report of the Engineer,. for a full and complete
descriptiori of the improvements, for a description of Assessment
District No. 985, for a description of the bonds to be issued to
represent unpaid assessments and for further particulars. The
work and all proceedings therefor shall be performed under and in
accordance with the Municipal Improvement Act of 1913, Division
12 of the Streets and Highways Code of the State of California.
9 SECTION 5. The City Clerk is hereby directed to publish
10 once in the Sun, a newspaper of general circulation published
11 nearest thereto and circulated in the City of San Bernardino,
12 wherein the Notice of Improvement was published, a notice of this
13 award. Said notice shall contain the matters .and things required
14 by law.
