"-' CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT A petition was received through LAFCO (Local Agency Formation Commission), for the annexation of a 1 acre parcel of land, located at the Southeast coroner of Hill Drive and 3rd Avenue, to the City of San Bernardino. The property is currently vacant land, and the owners/petitioner proposes to build single family homes. Since only one parcel is involved, this represents a 100~ request. LAFCO, however, has indicated to us that the annexation of this parcel would create a small county island, which consists of the parcel to the West of the parcel proposed for annexation. LAFCO has indicated that proposal could be amended to include this parcel, to eliminate the creation of this small island. LAFCO is in the process of contacting the owner of the adjacent parcel for possible inclusion in this annexation. Before the LAFC can issue a Certificate of Filing, Section 99 of'the Revenue and Taxation Code requires that the distribution of property taxes, relative to the proposed boundary changes, be negotiated and agreed upon by all affected local agencies. The County Board of Supervisors shall negotiate with the City, any exchange of property tax revenues on behalf of all affected agencies, except as provided for in Section 99.1 of the Revenue and Taxation Code. Such negotiations between the City and County took place in 1980, when County staff and a committee of City managers agreed upon a formula for property tax transfers, and Resolution 82-325 was adopted June 7, 1982, requesting the Board of Supervisors to direct the establishment of a policy for the formula. The adoption of the attached resolution fulfills the City's compliance with said Section 99 . Exhibit "A" of the resolution, states the actual dollar amounts proposed for transfer and the local agencies affected. A RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN AND AMONG THE CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO" RESULTING FROM THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC 2570. 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Fec~~als. The Mayor and Common Council of the City of San Bernardino hereby find and determine that: A. Pursuant to Section 99 of the Revenue and Taxation Code, prior to the issuance of a certificate of filing by the Local Agency Formation Executive Officer, the governing bodies of all local agencies whose send ce dr'Pd sprvice responsibilities will be altered by a pr'oposed or' iuri sdictional change will negotiate and determine by resoluti on the amount nf property tax revenues to be exchanged between and among such local agenci es. B. Except as provided in Section 99.1 of the Revenue and Taxation Code, in the event that a jurisdictional change would affect the service area or service responsibility of one or more special districts, the Board of Supervisors of the COWlty of San Bernardino shall, on behalf of the district or districts, negotiate any exchange of property tax revenues. C. The Mayor and Common Council of the City of San Bernardino and the Board of Supervisors of the County of San Bernardino have determined the amount of property tax revenues to be exchanged a result of as jurisdictional change described by LAFC No. 2570. Attached is a copy of our recommendations, the resolutions to be adopted and the breakdown of transfers to be made as submited to the Board of Supervisors. When it is approved, the local Agency Formation Commission office will send you a copy showing the action taken by the Board. ' " Senate Bill 180 requires that your city council also adopt a resolution relating to the tax transfer and forward that to the local Agency Formation Commission office. MAYS County Administrative Officer PROPERTY TAX TRANSFER TO THE CITY OF SAN BERNARDINO, LAFC NO. 2570 FROM: RECOMMENDATION: Adopt a resolution adopting a formula for transfer $99 of property tax to the City of San Bernardino as a result of pending annexation. .. BACKGROUND: State law requires that agreement on distribution of property tax relating to proposed boundary changes be reached before the Local Agency Formation Commission issues a Certificate of Filing. On May 19, 1980, the Board approved the formula for property tax transfers whict, had been agreed upon by County staff and a committee of city managers. This resolution provides for continuation of existing County services to the area being annexed to allow the City ample time to identify and secure the resources necessary to serve the annexed territory. This action will determine the share of property tax revenue to be allocated as a result of this jurisdictional change and shall only be effective upon satisfactory completion of the annexation proceedings.
