STAFF REPORT
Bids for the improvements to Perris Hill Park were opened at 2:00
p.m. on Tuesday, 10-3-89.
A total of
$173,331.00,
24.5% under
$199,186.00.
3 bids were recorded ranging from $150,338.00 to
for the Basic Bid. The low bid of $150,338.00 is
the Engineer's Estimate for the Basic Bid of
Three additional alternates were included in the contract
documents, in case sufficient supplemental funds could be
identified. The recommended transfer of $20,000 will provide the
necessary supplemental funds and allow the three additive
alternates to be included in the contract award. The low bidder
submitted a bid of $64,006.50 for the three additive alternates,
which is 20.6% under the Engineer's Estimate of $80,595.00.
Listed below is an estimate of the total project cost, based upon
the actual low bid prices.

CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
The supplemental funds in the amount of $20,000.00 will increase
this amount to $264,365.00.
At its meetings of 11-15-84 and 11-14-85, the Environmental
Revi ew Commi ttee found these improvements to be exempt from the
provisions of the California Environmental Quality Act.
We recommend that a contract be awarded to the low bidder.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CON1RACT TO HUBBS EQUIPMENT AND CONSTRUCTION COMPANY FOR
3 IMPROVEMENTS TO PERRIS HIll PARK.
4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOllOWS:

SECTION 1. Hubbs Equipment and Construction Company

Improvements in Perris Hill Park, in accordance with Plan No.
7556, for the total amount of $214,344.50, and a contract, is
9
awarded to said bidder accordingly, for the Basic Bid and the
three Additive Alternates, but such award shall be effective
only upon the contract being fully executed by both parties;
all other bids, therefore, are hereby rejected; and the Mayor
is hereby authorized and directed to execute said contract on
behalf of the City; a copy of the contract is attached hereto,
marked Exhi bi t "A" and incorporated herei n by reference as
fully as though set forth at length.
SECTION 2.
This contract and any amendment or
modifications thereto shall not take effect or become operative
unti 1 full y si gned and executed by the parti es and no party
shall b eo b 1 i gat e d hereunder until the t i me 0 f s u c h f u 1 1
execution.
No oral agreements, amendments, modifications or
wa i vers are intended or &uthori zed and sha 11 not be i mpl i ed
from any act or course of conduit of any party.
SECTION 3.
This resolution is rescinded if the
parties to the contract fail to execute it within sixty (60)
days of the passage of this resolution.
