CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION
STAFF REPORT
In 1984, the City of San Bernardino entered into a Joint Powers
Agreement with East Va 11 ey Water Di stri ct for the P\u :)()se of
acquiring Southern California Water Company's Highland and Delmann
System Water Service Area. Attached are maps which show the two
serVlce areas. The Highland System is located within East jails;
Water Dlstrict's service area and the Delmann Heights System 13
located wlthin the Water Department's service area. nil; waV31-
system was being acquired to enable the City and the Dlstrlct to
advance the health interests of the public, lmprove flt-e 3afety
1 nter'ests, and further the economi c deve 1 opment opportun 1 t ) e::; of
the areas served by the City and the District.
On November 20, 1986, the authority filed a ComplaHlt ln Eminent
Domain against Southern California Water Company and an order for
prejudgment possession was approved by the San Bernardino Superlor
Court on December 23, 1986. Since January 1, 1987, the '(.Jater
Department and East Valley Water District have" operated and
maintained Southern California Water Company's service area and
prepared for the court trial to establish the value for the water
systems. Each ent i ty has recei ved the revenue and pa 1 \j ~l!:
operating costs for the respective service areas durin'-j this

I n August, 1989, the authori ty f i 1 ed it's statutory set L I amant
offer whlch led to a settlement conference with the presldent of
Southe in Cali forn i a Water Company. On September' 22, 1989, a
negotiated settlement was agreed to by all parties and ~ne final
settlement was approved by the Highland-Delmann Helghts tjuai'ty
Water Supply Authority on October 5, 1989.
~The final judgment in Condemnation By Stipulation is $5.465
million. The cost will be apportioned between the Water Department
and East Valley Water District on the basis of appraised
valuations. It is estimated that East Valley's share is 88% a.lld the
City's share is 12%.
On a comparative basis with other condemnation actions which have
occurred with Southern California Water Company, the negotlated
acquisition cost is less than the other actions. In condemnation
br'ought by Coachella Valley Water District, their acquiSltlon cost
~as $1,800.00 per service connection. In the recently completed
condemnation action brought by the City of B1g Bear~ thelr
acquisltion cost was $2,700.00 per service connection. The
acquisition cost for th1S purchase 1S $1,250.00 per 3erVlce
connection.
On October 20, 1989, the judgment was filed with the San Bernardino
Superior Court. The assets will be divided between the Water
Department and East Va 11 ey and the Joi nt Powers Author', tj W"j ! i flave
concluded its function.
Each agency now begins the process of upgrading these systems to
replace undersized mains, improving the delivery systems of potable
water and enhancing fire protection.
