ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
15.20.050 TO REQUIRE LANDSCAPING PRIOR TO ISSUANCE OF A
3 CERTIFICATB OF OCCUPANCY FOR BUILDINGS VACANT MORE THAN 180 DAYS,
AND DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 15.20.050 of the San Bernardino
7 Municipal Code is amended as follows:
8 "15.20.050 Application Process.
9 A. The owner shall file a written application accompanied
10 by paYment of a fee with the Building Official prior to use or
11 occupancy of the premises or thirty (30) days prior to expiration
12 of an existing certificate of occupancy or temporary cert~ficate
13 of occupancy. The Building Official, upon request of the owner,
14 shall cause an inspection to be made of the premises within ten
15
(10) working days for compliance with City codes.
I f the
16 premises are in compliance with said codes, the Building
17 Official shall issue a certificate of occupancy.

B.
When an inspection discloses that the premises are not
19 in compliance with the codes, the Building Official shall give
20 written notice of each deficiency to the owner. No certificate
21 of occupancy shall be issued to the owner until all deficiencies
22
are corrected.
If the owner fails to correct all said
23 deficiencies within sixty (60) days after the original
24 application was filed, the application shall expire and a new
25' application, plus fees, will be required.

C.
When property is vacant for more than 180 days, the
27 owner shall landscape the property, in accordance with a

1 landscaping plan approved by the Planning Department of the City
2 of San Bernardino, prior to issuance of a Certificate of
3
Occupancy for the building.
Should such landscaping. result in
4 less parking being available than otherwise required by law, the
5 Planning Director may waive up to a ten percent (10%> deviation.

D.
The owner shall be responsible for making the premises
7 available for inspection by the City."

SECTION 2. Urgency.
This is an urgency ordinance which shall become effective
10 immediately upon its adoption. The reasons for the urgency are
11 that reoccupation of previously vacant properties without
12 landscaping upgrade perpetuates a degraded status of properties
13 in the City and that this ordinance is necessary to eliminate
14 blight, to encQurage upgrade of the surroundings of our citizens,
15 to protect against further deterioration which encourages crime,
16 graffiti and lessening of neighborhood pride, and to protect the
17 public health, welfare and safety.
18 I HEREBY CERTIFY that the foregoing ordinance was duly
19 adopted by the Mayor and Common Council of the City of San
20 Bernardino at a meeting thereof, held on the
