ORDINANCE NO.
2 AN ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
12.92.040 TO THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
3 CITY PAYING A PORTION OF THE COST OF REPAIR FOR SIDEWALKS, AND
DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
5 DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 12.92.040 is hereby added to the San
7 Bernardino Municipal Code to read as follows:
8 "12.92.040 Participation by City
9 Notwithstanding other provisions of this Chapter,
10 Streets and Highways Code Section 5611 or any other
11 provision of law the City may pay 1/2 of the cost of repair
12 of a sidewalk in the discretion of the Public S!rvices

Director.
The Public Services Director shall make such
determination based on the cost of the repair, the ability
of the property owner to pay, and the cooperation exhibited
by the property owner. Such determination shall be subject

to appeal to the Mayor and Common Council pursuant to
Chapter 2.64 of this Code."
SECTION 2.
This is an urgency ordinance necessary to
20 protect the public health, safety and welfare which shall take
21
effect immediately upon its adoption.

adequately cover a City the size of the City of San Bernardino to
locate even a majority of such sidewalks.
It is abSOlutely
essential that the citizens of the City have an incentive to
report the existence of such conditions. Where the citizen knows
that he or she will bear the entire cost of such repair there is
a disincentive to make such a report.
But where there is an
opportunity for City contribution such citizens will be more apt
to make such reports. It is essential that such opportUDity be
provided quickly to begin repairing such sidewalks at the
earliest possible date.
I HEREBY CERTIFY that the foregoing ordinance was duly
