HomeMy WebLinkAbout06-Mayor 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 ORDINANCE NO. 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 3.13 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE WAIVER 3 OF FEES FOR CHARITABLE ORGANIZATIONS 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 SECTION 1. Section 3.13.025 is hereby added to the San 6 Bernardino Municipal Code to read as follows: 7 "3.13.025 Waiver or Refund 8 9 The Mayor and Common Council may in their discretion and taking into consideration the information provided pursuant to Section 3.13.020, waive or refund the established fees in a total amount of not to exceed twenty five thousand dollars ($25,000.00) for anyone organization in any twelve month period." SECTION 2. Despite the time limitations provided in Section 3.13.020 the Mayor and Common Council find, declare and provide that during the time that Chapter 3.13 was being prepared, discussed, considered and debated, non-profit corporations were in contact with city offices on the question of waiver or refund of such fees, but paid said fees to the City in order not to delay projects vital to the health and welfare of the residents of the City and with the anticipation that a means of refund would be provided by the City. The payment of such fees have severely impaired the ability of such organizations to continue operating at full strength and to continue providing the necessary services to the residents of the City. The failure, cessation or reduction of said services will result in significant impact on other social agencies and ultimately on the DAB/ses October 17, 1989 1 6 1 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 3.13 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE WAIVER 2 OF FEES FOR CHARITABLE ORGANIZATIONS 3 taxpayers of the City. Therefore on or before April 12, 1990 4 organizations qualifying under Section 3.13.030 may file a 5 request for a refund of any such fees paid to the City between 6 January 1, 1988 and April 12, 1989 and subject to the limitation 7 provided in Section 3.13.025 said fees may be refunded by the 8 Council in its discretion. 9 I HEREBY CERTIFY that the foregoing ordinance was duly 10 adopted by the Mayor and Common Council of the City of San 11 Bernardino at a meeting thereof, held on the 12 day of , 1989, by the following vote, to wit: 13 AYES: Council Members 14 15 NAYS: 16 ABSENT: 17 City Clerk 18 19 20 The foregoing ordinance is hereby approved this day , 1989. of 21 22 W.R.
