The owner was given a five (5) day courtesy notice on May 24, 1989. No volunteer action was taken and a formal legal ten (10) day notice was issued August 15, 1989. Legal notice was mailed to land and registered owners. No action was taken by either party and no appeal was filed. Vehicle was abated August 29, 1989. There was one (1) vehicle towed for a total cost of $138.50. CASE NO. 89 VAP 212-05 75-0254 25 26 - 1 2 3 4 5 RESOLUTION NO. RESOLUTION OF THE CITY OF SAN BERNARDINO ASSESSING CERTAIN PARCELS OF REAL PROPERTY LOCATED WITHIN THE CITY OF SAN BERNARDINO FOR THE COSTS OF ABA TEMENT OF PUBLIC NUISANCES ON SAID PROPERTIES CASE NO. 89 VAP 212-05 WHEREAS, the City of San Bernardino, pursuant to its authority 6 under Chapter 8.36 of the San Bernardino Municipal Code, did lawfully give 7 notice of and thereafter abate public nuisances found to exist on the 8 properties described in Exhibit "A" attached hereto and incorporated in this 9 resolution; and 10 WHEREAS, pursuant to the San Bernardino Municipal Code, the 11 Superintendent of Public Buildings served notice to all property owners of 12 the abatement costs for removing abandoned, wrecked, dismantled, and/or 13 inoperative vehicles or parts thereof from the property; and 14 WHEREAS, opportunity for a hearing before the Board of Building 15 16 17 18 19 20 21 22 23 24 Commissioners to protest the abatement costs was afforded the property owners, with no response forthcoming; NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor and Common Council confirm and adopt as special assessments, the following abatement costs which have been incurred by the City for the abatement of public nuisances found to exist on the following properties: Assessment No. Assessor's No. Property Amount of Address Assessment .l 269-321-27 1818 No. Colorado St. $138.50 27 The legal description of each parcel IS detailed in Exhibit "A" . 28 WO:mal September 1, 1989 1 SECTION 2. The above assessments shall be paid to Public 2 Buildings/Parking Control, basement of City Hall, 300 N. "D" Street, San 3 Bernardino, CA. 92418, within thirty (30) days after notice of this 4 resolution is mailed to all parties with an interest in the above properties. 5 All assessments not fully paid in thirty (30) days shall become a lien on the 6 property pursuant to the San Bernardino Municipal Code and shall be 7 collected as a special assessment thereon. 8 SECTION. 3. If the above assessment is not paid as hereinabove 9 provided, the City Clerk is directed to file a certified copy of this 10 resolution with the Auditor of the County of San Bernardino, State of 11 California, directinG that said assessment be entered as a lien against the 12 property as it appearG on the current assessment rolls.
