STAFF REPORT
Bids for the rehabilitation of pavement on South "E"
Street were opened at 7:00 p.m. on Tuesday, 9-12-89.
A total of 5 bids were received, ranging from $354,998.50
to $440,872.00. The low bid of $354,998.50 is 33.8% under the
Engineer's Estimate of $536,553.00.
Listed below is an estimate of the total proj ect cost,
based upon the actual low bid price:

An amount of $676,800 has been allocated, under Account
No. 242-362-57668, to finance the costs that will be incurred for
this project. Federal-Aid Urban Funds will be used to finance
86% of the total cost.
At their meeting of 10-27-88, the City's Environmental
Review Committee found that this project to be exempt from
provisions of the California Environmental Quality Act.
We recommend that a contract be awarded to the low
bidder.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A
CONTRACT TO FONTANA PAVING, INC. FOR PAVEMENT REHABILITATION ON
SOUTH "E" STREET, FROM SANTA ANA RIVER TO ORANGE SHOW ROAD.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
1.
SECTION
Fontana
Paving,
is
Inc.
the
lowest
responsible bidder for Rehabilitation of Paving on South "E"
Street, from Santa Ana River to Orange Show Road, in accordance
wi th Plan No. 7609, for the total amount of $354,998.50, and a
contract, is awarded to said bidder accordingly, but such award
shall be effective only upon the contract being fully executed by
both parties; all other bids therefore are hereby rejected; and
the Mayor is hereby authorized and directed to execute said
contract on behalf of the City; a copy of the contract is
attached hereto, marked Exhibit" A" and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifica-
tions thereto shall not take effect or become operative until
fully signed and executed by the parties and no party shall be
obligated hereunder until the time of such full execution. No
oral agreements,
amendments,
modifications or waivers are
intended or authorized and shall not be implied from any act or
course of conduct of any party.
SECTION 3.
This resolution is rescinded if the parties
to the contract fail to execute it within sixty (60) days of the
passage of this resolution.
