In response to that concern, a Verdemont Area Public Works Financing Plan has been developed to raise the revenue to finance the installation of public works improvements on the existing streets. This approach would allow the improve- ments to be installed at this time, before the area is fully developed. Improvements will be installed as depicted on the map included in the Financing Plan. The improvements include full width paving (on the established grade), curbs and gutters, sidewalk, street lights, water mains, sewer mains, and possibly landscaping. These improvements would basically be constructed on the existing quarter mile grid streets. The sale of development rights to the general public will be subject to a recall provision, whenever they are needed for a proposed development. Rights will be recalled on the basis that .the last sold will be the first recalled. Any person that has a right recalled will be paid at the current rate, but at least 15% more than the amount paid to purchase the right. We recommend that a public hearing on the proposed Verdemont Area Public Works Infrastructure Financing Plan be set for 10: 00 a.m. at the Council meeting of 10-16-89. This will allow for input by property owners and members of the development community. 9-21-89 75-0264 9/21/89 1 RESOLUTION NO. 2 RESOLUTION OF THE CITY OF SAN BERNARDINO ADOPTING THE VERDEMONT AREA PUBLIC WORKS INFRASTRUCTURE FINANCING PLAN. 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RECITALS WHEREAS, the Verdemont Area is experiencing a rapid rate of development; and WHEREAS, the existing public works infrastructure system was installed many years ago to serve the few low density residential units in the area; and WHEREAS, the existing streets are not paved to the planned ultimate width or grade, and are not improved with curbs sidewalk, landscaping, sewer and and :Lights, gutters, street water service; and WHEREAS, the existing public works infrastructure system lS not adequate to accommodate the ever increasing volumes of pedestrian and vehicular traffic that are generated by the new developments; and WHEREAS, developers are hampered by the absence of fully improved streets, which necessitate conditions of approval that dictate off-site improvements to provide the second means of dedicated and paved emergency access and to provide water and sewer service to their developments; and WHEREAS, the absence of a fully improved street system is an impe.diment to the marketing activities for the new residential units; and WHEREAS, it lS imperative that an acceptable plan be adopted to provide the necessary financing to construct a complete system of public works infrastructure in the Verdemont 16 17 18 19 20 21 22 23 24 25 26 27 28 9/21/89 1 2 3 4 5 6 7 8 Area; and WHEREAS, an Engineering Study has been prepared to identify the required public works infrastructure improvements and determine the amount of fee for the development rights to provide the necessary revenue finance to the identified improvements. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS FOLLOWS: SECTION L. ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION 15.73 TO THE SAN BERNARDINO MUNICIPAL CODE TO REQUIRE THE PURCHASE OF DEVELOPMENT RIGHTS AS A CONDITION FOR ISSUANCE OF A BUILDING PERMIT IN THE VERDEMONT AREA. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN 5 BERNARDINO DO ORDAIN AS FOLLOWS: 6 SECTION 1. Section 15.73 is added to the San Bernardino 7 Muncipal Code to read as follows: 8 9 "Acquisition of Development Rights 10 A. No building permit shall be issued within the 11 Verdemont Area without the applicant first having secured a 12 development right for each proposed Single Family Dwelling Unit 13 or equivalent Single Family Dwelling Unit for Commercial or 14 Industrial Development. A written application, along with the 15 fee(s) established by resolution, shall be submitted to the 16 Director of Public Works/City Engineer, and a Purchase Agreement 17 executed, for every development proposed wi thin the Verdemont 18 Area. 19 Verdemont Area Defined 20 B. The Verdemont Area lS defined as that area of the 21 City of San Bernardino delineated by the Verdemont Area Plan 22 adopted by the Mayor and Common Council in November, 1986. 23 C. Exemptions. The issuance of building permits for the 24 repair, renovation or addition less than 25%, of existing single 25 family homes shall be exempt from the requirement to acquire 26 development.. rights. BOX 3925 ONTARIO, CA 91761 (714) 988-4167 September 29, 1989 Members of the City Council City of San Bernardino Dear Honorable Members of the City Council: We have an approved Conditional Use Permit number 89-4 for the development of a Mobile Home Park on Kendall Road at Pine. The approval was based upon, among other things, a review of the. impact this development would have on city services, infrastructures, and related items. After having made this review, the city approved the development with the imposition of certain conditions. These conditions included reducing the density by nearly 50%, increasing the open space requirements, improving and widening of Kendall Road with street lights, sidewalks, landscaping, traffic signalization and imposition of a wind requirement that all structures withstand 110 mph winds. Additionally, adjacent property was donated to the city to be' used as a public park. This project is not within the specific area of your concern but was included only because of the road definition which should be changed. This project is designed to provide affordable housing. All interior roads, sewers, water system and other utilities are privately owned and maintained by the mobile home park, not the city. The added conditions have already increased the cost of the project and further additional charges or assessments would destroy the affordability of the project. Based on the approval previously given by the council, we have incurred a great deal of costs in developing engineering plans, which are nearly complete. National Prebuilt Homes located in San Bernardino, has been retained by us as the manufacturer of the homes to be built in accordance with the conditions imposed by the city. They have engineered and scheduled their production in anticipation of this project. To delay or defeat this project would severely impact this company and their employees. In summary, we are in the midst of a development which has been Ir: -2- recently approved and conditioned to the point that the application of a moratorium and added costs would defeat the affordability of the housing offered and the viability of the project.
