Backl!round: On December 6, 2004, the Mayor and Common Council adopted a resolution approving an agreement with TY Lin International to provide professional engineering services in the amount of $249,050 for the preparation of a Project Study ReportlProject Report (PSR/PR) for the University Parkway/Interstate 215 Interchange Southbound Loop Entrance Ramp project. On July 16, 2007, the Mayor and Common Council approved Amendment No. I to the agreement with TY Lin International in the amount of$180,329 to compensate the consultant for extra work required, due to changes imposed by CaItrans. Geometricians in Sacramento reviewed the concept design submitted by TY Lin International and the City for a flyover ramp and required the new ramp to merge into mainline 1-215, south of the existing ramp's connection to the mainline. This required a significant realignment of the connector ramp in order to meet CaItrans' requirements and also increased the environmental footprint of the project, necessitating additional biological, noise and cultural studies to complete the environmental process. CaItrans Traffic Operations Division also required more extensive traffic analysis of the new connector ramp and the impacts on the existing street intersections, as well as impacts on mainline 1-215. On February 19,2008, the Mayor and Common Council approved Amendment No.2 to the agreement with TY Lin International in the amount of $37,68 I to compensate the consultant for extra work required to conduct a Value Analysis (V A) as required by Caltrans for the project. The V A consisted of a 5-day "brainstorming" session in April 2008 with bridge design experts from CaItrans, TY Lin International and the City to determine the optimal means of solving the congestion problem that is occurring on University Parkway due to queuing of traffic approaching the 1-215 Freeway southbound on-ramp. In April 2008, CaItrans advised that they were unable to provide full time staffing for the 5- day period of the V A, so staff obtained a proposal from TY Lin International to provide an expert panel of bridge engineers, traffic engineers and construction estimators for the Value Analysis (VA). On May 19, 2008, the Mayor and Common Council approved Amendment No.3 to the agreement with TY Lin International in the amount of $27,906 to provide the necessary expert staffing for the VA. 2 CITY OF SAN BERNARDINO - REOUEST FOR COUNCIL ACTION STAFF REPORT - Continued During the Value Analysis, Caltrans made it clear that they would not support the alternative preferred by the City, which consisted of constructing a direct connector southbound on-ramp (also called flyover) from University Parkway due to the excessive approach grade and limited stopping sight distance. This change has necessitated refocusing efforts toward construction of a southbound loop ramp at the southwest quadrant of the interchange. Unfortunately, this alternative will require significant right-of-way acquisition. Staff also learned late last year that due to the introduction of $5 million in Federal Safety Demonstration funds, known as SAFETEA-LU funds, Caltrans will no longer accept a combined PSR/PR. This means that a separate PSR must be approved before work can begin on the PR. Preparation of the PSR alone is almost as complex as preparing the combined report because the combined report is a streamlined process where few impacts are anticipated. Although this is a setback for the project, some of the work done so far can be incorporated in the new documents. Unfortunately, much of the work done on the direct connector southbound on-ramp will not be reusable. In particular, a geometric study done at the request of Caltrans will be of no value since Caltrans now refuses to accept the direct connector on- ramp as a primary alternative. However, it can still be used as one of the alternatives studied in the PSR. TY Lin International has submitted the attached request for Amendment No. 4 to their Agreement, revising the scope of services and increasing the funding amount by $36,900. This funding will be sufficient for TY Lin International to complete the PSR and obtain approval by CaItrans and Federal Highway Administration (FHW A) of the preferred alternative for the project. Subsequent to approval of the PSR (approximately January 2010), the Consultant will submit an additional request for an amendment authorizing them to proceed with the PR. Staff anticipates that the PSR can be completed and approved by Caltrans by January 2010. Once approved, the City can proceed with the PR and environmental document. These documents are expected be completed by 201 I. Based on estimates provided by the Consultant, construction may start as early as 2013 and be completed by 2014. Financial Impact: Adequate funding to cover the cost of this amendment is available in Account No. 129-367- 5504-7240 "SS04-19 University Parkway/I-215 Freeway Combined Project Study Report/Project Report and Freeway Loop." The primary cause of the increase is a new requirement from Caltrans that longer merge lanes be provided for traffic entering the 1-215 Freeway southbound. Adequate funding is available for this Amendment to Professional Services Agreement with TY Lin International; however, supplemental funding in the approximate amount of $11,000,000 will need to be identified prior to construction. Staff has nominated this project for stimulus or earmark funding through the offices of Congressman Lewis and Congressman Baca. Also, a $500,000 allocation may become available from the 2009 Omnibus Spending Bill. Recommendation: Adopt Resolution. 4 1 RESOLUTION NO. WITNESSETH: A. WHEREAS, on December 6, 2004, the Mayor and Common Council adopted Resolution No. 2004-383 approving Agreement for Professional Services in the amount of $249,050.00 with Consultant to provide a Project Study ReportlProject Report and the supporting studies and documents for the University Parkway/Interstate 215 Interchange Southbound Loop entrance ramp project hereinafter referred to as "Project"; and B. WHEREAS, Amendment No.3 extended the term of said Agreement for Professional Services to July 16, 2009; and F. WHEREAS, changes to the scope of services have occurred that were beyond the control of Consultant and the City and will require Consultant to perform additional work and incur additional costs not anticipated at the time of execution of the original Agreement for Professional Services; and G. WHEREAS, changes to the scope of services will result in a continuing need for the services of the Consultant beyond the current expiration date; and - I - Amendment No.4 to Agreement for Professional Services with TY Lin International. H. WHEREAS, staff concurs that the work for which additional compensation is requested was not included in the original Agreement for Professional Services as amended; NOW THEREFORE, the parties hereto agree as follows: I. Un International will provide overall execution and financial management of the project, including City of San Bernardino and Caltrans coordination, tracking progress of the work, preparing monthly invoices, biweekly project status reports and conducting project meetings. TYU will prepare monthly status reports to update the City on the progress to date; work to be accomplished in the next period; and potential problems of a technical nature or forecasted budget/schedule requirement. TYU will also prepare and update a project schedule and distribute it to all project team members. Structure Advance Planning Study The draft PSR will be submitted to the City and Caltrans for review. Upon receiving and incorporating comments, a final PSR will be prepared and submitted for approval. Task 3.2 Alternative Analvsis In consultation with City staff, TYU will develop three alternatives for detailed consideration. Each alternative will be evaluated for impacts to right- of-way, traffic, access, sight distance, existing utilities, local and regional drainage, safety, freeway operations, constructability, and other critical issues. Once the alternatives are developed, a senior level TYU engineer will perform a Value Engineering Analysis to identify and evaluate alternative project solutions and provide recommendations to the city. Task 3.3 Cost Estimates TYU will prepare preliminary quantities and cost estimate for the build alternatives. The estimate will include costs for structure, roadway, traffic and signing, drainage, utility relocations, and right of way. Costs for preliminary engineering, design, environmental, right of way support and construction support will also be included. Task 3.4 Exhibits and Geometric Base maDS Geometric drawings will be prepared for each build alternative. The geometric drawings will include plan, profile, and typical cross sections in llx17 formats, depicted on an aerial photograph and/or topography map. Task 3.5 Rioht of Wav Data Sheets / Utilitv Assessment Right of Way data sheets will be prepared for the build alternatives using Caltrans requirements. The data sheets will include the right of way requirements and assessments of the cost of acquisitions. The TYU will identify utility companies involved in the project. Utility needs will be assessed based on the geometriC drawings of build alternatives. The information and cost related to the utility needs will be documented in the Right of Way Data Sheet. This TMP will identify construction staging and traffic handling issues to a degree sufficient to verify constructability and feasibility of traffic handling for the preferred alternative. Task 3.7 Preliminarv Structures Advance Plannina Studv lAPS) Preliminary Structure Advance Planning Study (APS) will be prepared for the proposed alternatives in accordance with the requirements in Caltrans' Bridge Memo to Designers 1-8. This effort will be used to establish final alignment and profile, support locations, bridge depth, and other key characteristics of the structure. Utilizing Caltrans' Bridge Advance Planning Studies Guide, square foot cost factors will be used to develop cost estimates for the structure. A technical memorandum will also be prepared to accompany the drawing, and will discuss key issues affecting design or construction of the proposed structure. Task 3.8 Storm Water Data Reoort ISWDR) TYU will prepare a SWDR for inclusion in the PSR. The preparation of the SWDR will follow Ca/trans Storm Water Quality Handbooks Project Planning and Design Guide (May 2007). Deliverables: . Draft Project Study Report (PSR) . WITNESSETH: A. WHEREAS, on December 6, 2004, the Mayor and Common Council adopted Resolution No. 2004-383 approving Agreement for Professional Services in the amount of $249,050.00 with Consultant to provide a Project Study Report/Project Report and the supporting studies and documents for the University Parkway/Interstate 215 Interchange Southbound Loop entrance ramp project hereinafter referred to as "Project"; and B. WHEREAS, on July 16,2007, the Mayor and Common Council adopted Resolution No. 2007-257 approving Amendment No.1 to Agreement for Professional Services with Consultant to provide additional design, environmental and traffic engineering services for the Project; and C. WHEREAS, on February 19, 2008, the Mayor and Common Council adopted Resolution No. 2008-60 approving Amendment No.2 to the original Agreement for Professional Services with TY Lin International to provide PSR/PR documents.for the University Parkway!lnterstate 215 Interchange Southbound Loop entrance ramp project (SS04-19). D. WHEREAS, on May 19,2008, the Mayor and Common council adopted Resolution No. 2008-152 approving Amendment No.3 to the original Agreement for Professional Services with TY Lin International to provide PSR/PR documents for the University Parkway/Interstate 215 Interchange Southbound Loop entrance ramp project (SS04-19); and E. WHEREAS, Amendment No.3 extended the term of said Agreement for Professional Services to July 16, 2009; and F. WHEREAS, changes to the scope of services have occurred that were beyond the control of Consultant and the City and will require Consultant to perform additional work and incur additional costs not anticipated at the time of execution of the original Agreement for Professional Services; and G. WHEREAS, changes to the scope of services will result in a continuing need for the services ofthe Consultant beyond the current expiration date; and -1- Amendment No.4 to Agreement for Professional Services with TY Lin International. H. WHEREAS, staff concurs that the work for which additional compensation is requested was not included in the original Agreement for Professional Services as amended; NOW THEREFORE, the parties hereto agree as follows: 1. Each alternative will be evaluated for impacts to right- of-way, traffic, access, sight distance, existing utilities, local and regional drainage, safety, freeway operations, constructability, and other critical issues. Once the alternatives are developed, a senior level TYLl engineer will perform a Value Engineering Analysis to identify and evaluate alternative project solutions and provide recommendations to the city. Task 3.3 Cost Estimates TYLl will prepare preliminary quantities and cost estimate for the build alternatives. The estimate will include costs for structure, roadway, traffic and signing, drainage, utility relocations, and right of way. Costs for preliminary engineering, design, environmental, right of way support and construction support will also be included. Task 3.4 Exhibits and Geometric Base maDS Geometric drawings will be prepared for each build alternative. The geometric drawings will include plan, profile, and typical cross sections in llx17 formats, depicted on an aerial photograph and/or topography map. Task 3.5 Rioht of Wav Data Sheets / Utility Assessment Right of Way data sheets will be prepared for the build alternatives using Caltrans requirements. The data sheets will include the right of way requirements and assessments of the cost of acquisitions. The TYLl will identify utility companies involved in the project. Utility needs will be assessed based on the geometric drawings of build alternatives. The information arid cost related to the utility needs will be documented in the Right of Way Data Sheet. Task 3.7 Preliminary Structures Advance Plannino Studv lAPS) Preliminary Structure Advance Planning Study (APS) will be prepared for the proposed alternatives in accordance with the requirements in Caltrans' Bridge Memo to Designers 1-8. This effort will be used to establish final alignment and profile, support locations, bridge depth, and other key characteristics of the structure. Utilizing Caltrans' Bridge Advance Planning Studies Guide, square foot cost factors will be used to develop cost estimates for the structure. A technical memorandum will also be prepared to accompany the drawing, and will discuss key issues affecting design or construction of the proposed structure. Task 3.8 Storm Water Data Report ISWDR) TYLI will prepare a SWDR for inclusion in the PSR. Task 3.3 Cost Estimates TYU will prepare preliminary quantities and cost estimate for the build alternatives. The estimate will include costs for structure, roadway, traffic and signing, drainage, utility relocations, and right of way. Costs for prelimin"ary engineering, design, environmental, right of way support and construction support will also be included. Task 3.4 Exhibits and Geometric Base maDS Geometric drawings will be prepared for each build alternative. The geometric drawings will include plan, profile, and typical cross sections in llx17 formats, depicted on an aerial photograph and/or topography map. Task 3.5 Richt of Wav Data Sheets I Utilitv Assessment Right of Way data sheets will be prepared for the build alternatives using Caltrans requirements. This effort will be used to establish final alignment and profile, support locations, bridge depth, and other key characteristics of the structure. Utilizing Caltrans' Bridge Advance Planning Studies Guide, square foot cost factors will be used to develop cost estimates for the structure. WHEREAS, on July 16,2007, the Mayor and Common Council adopted Resolution No. 2007-257 approving Amendment No.1 to Agreement for Professional Services with Consultant to provide additional design, environmental and traffic engineering services for the Project; and C. WHEREAS, on February 19, 2008, the Mayor and Common Council adopted Resolution No. 2008-60 approving Amendment No.2 to the original Agreement for Professional Services with TY Lin International to provide PSR/PR documents for the University ParkwaylInterstate 2 I 5 Interchange Southbound Loop entrance ramp project (SS04- I 9). D. WHEREAS, on May 19,2008, the Mayor and Common council adopted Resolution No. 2008-152 approving Amendment No.3 to the original Agreement for Professional Services with TY Lin International to provide PSR/PR documents for the University ParkwaylInterstate 215 Interchange Southbound Loop entrance ramp project (SS04-19); and E. WHEREAS, Amendment No. 3 extended the term of said Agreement for Professional Services to July 16, 2009; and F. WHEREAS, changes to the scope of services have occurred that were beyond the control of Consultant and the City and will require Consultant to perform additional work and incur additional costs not anticipated at the time of execution of the original Agreement for Professional Services; and G. WHEREAS, changes to the scope of services will result in a continuing need for the services of the Consultant beyond the current expiration date; and -1- Amendment No.4 to Agreement for Professional Services with TY Lin International.
