Description) Council Notes: Finance: ~so Z009-ltJ7 Agenda Item No. /3 5-q...o'1 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report SUBJECT: Resolution rescinding the rejection of certain access and drainage easements offered to the City on Parcel Map No. 17375, generally located on the northeasterly corner of Cajon Boulevard and University Parkway, and accepting said easements. BACKGROUND: On March 19, 2007, Parcel Map No. 17375, for the area generally located on the northeasterly corner of Cajon Boulevard and University Parkway, was approved, along with various agreements. This map was relative to an industrial development by Hillwood Enterprises, L.P. and consists of 6 developable parcels and various lettered lots. There were various irrevocable offers of dedication of easements made to the City on the map, including right of way, water and public utilities, drainage and access easements. All of the easements were accepted by the City except for drainage and access. The non-acceptance of these easements implied a rejection by the City. Pursuant to Section 66477.2(a) of the California Government Code, offers of dedication that have been rejected shall remain open and may be accepted at a future date. The rejection of the drainage and appurtenant access easements was largely due to a retention basin across Lot D of the map not meeting the City's standards at that time. Hillwood has since completed the various improvements to the basin as required, and the City can now accept the drainage and appurtenant access easements. The maintenance of the basin will be carried out under Assessment District No. 1057, approved on November 19, 2007 by Resolution No. 2007- 460. The attached map shows the location ofthe various easements to be accepted by the City. The State of California will be acquiring a portion of the most northerly section of Lot D at a future date, as part of the 1-215 widening project and will be realigning the channel. Hillwood will be submitting a lot line adjustment to include the realigned channel as part of the Lot D easement area, and is shown as "future easement" on the attached map. The attached Resolution rescinds the City's rejection of the drainage and access easements and accepts these easements, as set forth on Parcel Map No. 17375. FINANCIAL IMPACT: None. Maintenance of the drainage basin will be paid for through Assessment District No.1 057. RECOMMENDED MOTION: Adopt Resolution. Attachments: . Maps .
