Marzullo Interim Executive Director SUBJECT: Targeted Employment Area Boundaries for the San Bernardino Valley Enterprise Zone DATE: April 14, 2009 SvnoDsis of Previous Commission/Council/Committee Action{s): On August 21, 2006, the Mayor and Common Council of the City of San Bernardino ("Council") authorized the submittal of a multi-jurisdiction application to the California State Department of Housing and Community Development ("HCD") for designation of the San Bernardino Valley Enterprise Zone ("SBVEZ"), along with approving a Memorandum of Understanding among the Cities of Colton and San Bernardino, the County of San Bernardino, and the Inland Valley Development Agency ("IVDA"), as parties to the SBVEZ application. On January 22, 2008, the Council authorized the submittal of a boundary modification to HCD to modifY the original SBVEZ application boundary. The boundary modification, along with HCD's conditions of approval, had to be approved by HCD prior to the signing of the MOU with HCD to obtain final designation of the SBVEZ. On November 17, 2008, the Council authorized the Resolution approving a Memorandum of Understanding with the HCD to receive final designation for the San Bernardino Valley Enterprise Zone. P\Agendas\Comm Dev Commission\CDC 2009\04-20-09 EZ Targeted Employment Area SR.doc COMMISSION MEETING AGENDA Meeting Date: 04/20/2009 Agenda Item Number: ..RLf~ ECONOMIC DEVELOPMENT AGENCY STAFF REPORT RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE PROPOSED TARGETED EMPLOYMENT AREA BOUNDARIES FOR THE SAN BERNARDINO VALLEY ENTERPRISE ZONE BACKGROUND: On August 21, 2006, the Mayor and Common Council of the City of San Bernardino ("Council") authorized the submittal of a multi-jurisdiction application to the State Department of Housing and Community Development ("HCD") for the designation of the San Bernardino Valley Enterprise Zone ("SBVEZ"), along with approving a Memorandum of Understanding ("MOU") between the City of Colton and the City of San Bernardino ("City"), the County of San Bernardino ("County"), and the Inland Valley Development Agency ("IVDA") as parties to the SBVEZ application setting forth the duties and responsibilities for each jurisdiction. Additionally, the MOU addressed the proposed budget for the first five years of the SBVEZ. On January 10,2007, HCD issued the SBVEZ conditional designation status retroactive to October 15, 2006. This date coincides with the expiration date of the Agua Mansa Enterprise Zone ("AMEZ"), and since a portion of the former AMEZ overlaps the SBVEZ, HCD allowed the SBVEZ to use October 15, 2006, as the official designation date. On January 10, 2008, all conditions were completed and submitted to HCD for final approval. On January 22, 2008, while HCD was preparing the SBVEZ's MOU with HCD, the City authorized the submittal of a boundary modification to HCD to modify the original SBVEZ application boundary. The boundary modification enabled the City to expand its portion of the SBVEZ. On October 16, 2008, the boundary modification was approved by HCD. On November 17, 2008, HCD's MOU was approved by the Council. On March 5, 2009, HCD signed the MOU and issued the SBVEZ its final designation status to take effect on October 15,2006. CURRENT ISSUE: Senate Bill No. 2023, which was signed into law by Governor Wilson on September 27, 1997, was designed to strengthen the California Enterprise Program. A provision of this legislation allows each enterprise zone to designate a Targeted Employment Area ("TEA"). Enterprise Zone employers that hire any TEA resident will be able to claim a State tax credit for those persons hired. The TEA is composed of census tracts where at least 51 percent of each tract's residents are low- and moderate- income, as defined by the United States Department of Housing and Urban Development ("HUD"). The legislation requires that census data that was available at the time of the original zone application in 2006 be used, thus 2000 census data was used to determine eligible census tracts. Since the City, the City of Colton and the County of San Bernardino are parties to the SBVEZ, the Resolution must approve the eligible Census Tract locations within all three jurisdictions. The attached map shows the Census Tracts as listed in the Resolution. ENVIRONMENT AL IMPACT: The SBVEZ land use designations and project description conform to the City's General Plan Program Environmental Impact Report, certified November I, 2005. No further environmental analysis is required. FISCAL IMPACT: Approval of this recommendation will have no impact on the City's General Fund. CC({J)[P 2 RESOLUTION OF THE MA YOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE PROPOSED TARGETED EMPLOYMENT AREA BOUNDARIES FOR THE SAN BERNARDINO VALLEY ENTERPRISE ZONE 3 4 5 WHEREAS. the purpose of the Enterprise Zone program is to stimulate business and 6 industrial gro\Vth in depressed areas of the State by relaxing regulatory controls that impede private 7 investment and in March 2006. the California State Department of Housing and Community 8 Development ("HCD") issued a Request for Proposals to fill twenty-three (23) vacant enterprise 9 zone designations: and 10 WHEREAS. on August 21. 2006. the Mayor and Common Council of the City of San 11 Bernardino ("Council") authorized the submittal of a multi-jurisdiction application to HCD for 12 designation of the San Bernardino Valley Enterprise Zone ("SBVET) in addition to approving a 13 Memorandum of Understanding among the City of Colton and the City of San Bernardino ("City"), 14 the County of San Bernardino ("County"), and the Inland Valley Development Agency, as parties 15 to the SBVEZ application setting forth the duties and responsibilities for each jurisdiction; and 16 WHEREAS. on March 5. 2009. HCD issued the SBVEZ its final designation status to take 17 effect on October 15,2006; and 18 WHEREAS. the Redevelopment Agency of the City of San Bernardino ("Agency") has been 19 delegated the responsibility to carry out the duties of said application on behalf of the City; and 20 WHEREAS. THEREFORE. IT IS HEREBY RESOLVED, DETERMINED AND ORDERED BY 7 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS 8 FOLLOWS: 9 Section 1. The Council hereby finds and determines that the facts and circumstances set 10 forth in the Recitals hereof are true and correct in all respects.
