The project site is located on the east side of "G" Street, approximately 160 feet north of 29th Street (Exhibit 1 - Location Map). The project site is currently utilized by Faith Bible Church as overflow parking for the church sanctuary and school facility located at 2898 North "G" Street. The site, located on the cuI-de-sac end of "G" Street, is improved with asphalt paving, parking stall striping, wheel stops, and parking lot lighting. To the east and south of the site are existing single-family residences in the RS, Residential Suburban land use district. Existing development within a 500-foot radius of the project site is predominately single-family residential. To the west of the proposed monopine site is the Faith Bible Church, owner of the project site. The church campus contains several buildings, a parking lot and playground improvements. To the north of the project site is the 259 freeway, which connects the 1-215 and 1-210 freeways. On September 18, 2008, the Planning Commission approved CUP No. 08-09 to permit construction and operation of a wireless telecommunications tower disguised as a pine tree, with associated equipment (Exhibit 2 ~ Planning Commission Staff Report). During the Planning Commission hearing, participants spoke both in opposition and in favor of the proposal. Members of the public opposed to the project questioned the need for new wireless infrastructure, objected to the aesthetic impacts to the neighborhood, and stated concern regarding maintenance of the facility. Some also cited their concern with the potential health impacts of such facilities. However, the Planning Commission informed the public during the hearing that only the Federal Government has jurisdiction over decisions based on the environmental effects of RF emissions, pursuant to the Telecommunications Act of 1996, Section 704(a)(7)(B)(iv), which states: AppeallVo.08-05 Hearing Date: January 20, 2009 Page 2 "No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." Speakers in favor of the project cited the lease revenue benefits for the church and school. The Planning Commission voted unanimously to approve the application. Commissioners Durr, Heasley, Mulvihill, Munoz, and Sauerbrun were in attendance. Commissioners Coute, Longville, Rawls and Hawkins were absent. The appellant filed Appeal No. 08-05 (Exhibit 3) on September 29, 2008, to request that the Mayor & Common Council overturn the Planning Commission's approval of the proposed wireless telecommunications facility. The appellant states in the appeal that the existing telephone infrastructure (including landline service) adequately serves the area. Additionally, the appellant questions the appropriateness of such facilities in a residential neighborhood, stating concerns regarding impacts on the integrity of the neighborhood. The appellant has also provided a petition of several members of the public stating their opposition to the project and several form statements of similar substance (Exhibit 4). As noted in the Planning Commission Staff Report (Exhibit 2), the proposed project conforms to applicable Code requirements for the design of telecommunications facilities, including limitations on height and location criteria. As provided in the project plans and conditions of approval, the developer will be responsible for installing an equipment enclosure and screening landscaping, and for providing regular maintenance of the facility. Staff recommended approval of the project, noting that a monopine would blend in well with the adjacent freeway landscaping. Accordingly, the Planning Commission approved CUP No. 08-09, concluding that the project is consistent with applicable General Plan policies and applicable provisions the Development Code. FINANCIAL IMPACT No financial impact is anticipated; the appropriate application fees have been paid. RECOMMENDATION That the hearing be closed and that the Mayor & Common Council deny Appeal No. 08-05 and uphold the Planning Commission's approval of Conditional Use Permit No. 08-09, based on the Findings of Fact contained in the Planning Commission Staff Report. CUP 08-09 tillg Date: September 16, 2008 Page 1 PROTECT DESCRIPTION The project site is located on the east side of "G" Street, approximately 160 feet north of 29th Street, in the RS, Residential Suburban land use district (Attachment A - Location Map). The applicant requests approval of a Conditional Use Permit under authority of Development Code ~19.20.030(C)(7) to construct and operate a 75-foot high wireless telecommunications tower, camouflaged as a pine tree, with the installation of associated equipment (Attachment B - Site Plan and Elevations). SETTING & SITE CHARACTERISTICS The site is irregularly shaped and comprised of several parcels. The site is currently utilized by Faith Bible Church as overflow parking for the church sanctuary and school facility located at 2898 North "G" Street. The site is improved with asphalt paving, parking stall stripping, wheel stops, and parking lot lighting. The lot is located on the cul-de-sac end of "G" Street. To the east and south of the site are existing single-family residences in the RS, Residential Suburban land use district. Existing development within a 500-foot radius of the project site is predominately single-family residential. To the west of the proposed monopine site is the Faith Bible Church, owner of the project site. The church campus contains several buildings, a parking lot and playground improvements. To the north of the project site is the 259 freeway, which connects the 215 and 210 freeways. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQAl Tne project is exempt from environmental review pursuant to the California Environmental Quality Act (CEQA) Section 15303 for new construction of small structures. PROTECT ANALYSIS The project, a request to construct and operate a new 75-foot high telecommunications tower, is subject to several provisions of the City of San Bernardino Development Code. These provisions include but are not limited to the following: ~19.20.030(3) - Property Development Standards - Telecommunication Facilities, Chapter 19.14 - Freeway Corridor Overlay District, Chapter 19.03 - Residential Districts, and Chapter 19.36 - Conditional Use Permits. Section 19.20.030(3) contains specific development criteria for new telecommunications facilities (Attachment B). In addition to construction of the proposed facility, the project includes installation of new landscaping for visual screening and to allow the project to blend in with the existing landscape. The improvements are proposed to be installed near the "E" Street off ramp of the northbound 259 freeway. The applicant will utilize the existing parking lot pavement, which is in good condition, for vehicular access to the monopine and equipment. . . CUP 08-09 ting Date: September 16, 2008 Page 2 The proposed tower and equipment enclosure locations comply with the 25-foot landscape buffer required by the Freeway Corridor Overlay District. The proposed tower will be disguised as a 75-foot high pine tree, which usually requires a Development Permit. The Development Code requires a Conditional Use Permit for this project because the site is located in a residential land use district. The proposed development plan complies with all applicable development standards, including height, placement and landscaping. The proposed tower will be camouflaged as a natural object, the equipment will be screened from view, and the site will be enclosed with a wrought iron fence with perimeter landscaping. The site is only partially visible from 29th, "G" and "E" Streets, or from adjacent residences. The view from the 259 freeway will be obscured by existing mature trees in the freeway landscaping. Therefore, the aesthetic condition of the project area will remain unaffected by construction of the proposed telecommunication facility. FINDINGS 1. The praposed use is conditionally permitted within, and would not impair the integrity and character of the subject land use district and complies with all of the applicable provisions of the Development Code. The proposed 75-foot high telecommunications tower is conditionally permitted in the RS, Residential Suburban use district under the authority of Development Code s19.20.030(3) for placement of telecommunications antennas in residential land use districts. The proposed tower will be camouflaged as a natural object, a pine tree, and will be screened from view by existing and proposed landscaping. The project is consistent with the applicable provisions of the Development Code for development of telecommunications facilities, including standards for height, placement, design and landscaping. Development of telecommunication infrastructure is essential to providing coverage and capacity for wireless telecommunications services. Therefore, the proposed use would not impair the integrity or character of the subject land use district. 2. The praposed use is consistent with the General Plan. The proposed facility is consistent with a number of General Plan goals and policies. General Plan Policy 9.8.1 (Utilities) provides for the continued development and expansion of telecommunications systems. General Plan Goal 2.2 (Land Use) promotes development that integrates with and minimizes impacts on surrounding land uses. Operation of the antenna and tower would not be apparent to the surrounding residential neighborhood, and would provide for continued development of the wireless telecommunications system. The proposed monopine design would also be consistent with Community Design Policy 5.2.4 for screening of above-ground infrastructure support structures. . . CUP 08-09 ting Date: September 16, 2008 Page 3 3, The approval of the Conditional Use Permit for the proposed use is in compliance with the requirements of the California Environmental Quality Act and Section 19.20.030(6) of the Development Code. The project is exempt from CEQA under Section 15303 for new construction of small structures. Staff conducted a review of the proposed project to confirm that the categorical CEQA exemption is applicable. 4. There will be no potentially significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored. There are no anticipated negative impacts to environmental quality and/ or natural resources. The project site is fully developed, and is located in a predominately urbanized area characterized by existing public services, buildings, pavement and ornamental landscaping. 5. The location, size, design, and operating characteristics of the proposed use are compatible with the existing and future land uses within the general area in which the proposed use is to be located and will not create significant noise, traffic or other conditions or situations that may be objectionable or detrimental to other permitted uses in the vicinity or adverse to the public interest, health, safety, convenience, or welfare of the City. The location, size, design, and operating characteristics of the proposed facilities are compatible with the existing and future land uses on the church site and in the surrounding residential neighborhood. The proposed tower will be camouflaged as a pine tree and installed with live landscaping to blend the project site with its surroundings. This design will ensure aesthetic compatibility with surrounding properties. The existing condition of the project site, located on a large church campus with full site improvements and mature landscaping, make it ideal to accommodate the proposed facility with adequate buffering to ensure that the project will not be objectionable or detrimental to other permitted uses, nor in any way adverse to the public interest, health, safety convenience or welfare of the City. 6. The subject site is physically suitable for the type and densityjintensihj of use being proposed. The site contains ample buildable area for construction of the proposed telecommunication tower and associated equipment. The proposed development plan complies with all applicable provisions of the Development Code, including height limits, setbacks and landscaping requirements. Therefore, the site is physically suitable for the proposed facility. . . CUP 08-09 ling Date: September 16, 2008 Page 4 7. There are adequate pravisions for public access, water, sanitation, and public utilities and sen,ices to ensure that the proposed use would not be detrimental to public health and safety. There are adequate provisions for public access, public utilities, and public services for the proposed project. The site is already developed and served by existing public streets and a full range of public utilities and services. All applicable codes will apply to the construction and operation of the proposed facility to ensure that the use will not be detrimental to public health and safety. CONCLUSION The proposal satisfies all Findings of Fact required for approval of Conditional Use Permit No. 08-09. RECOMMENDATION Staff recommends that the Planning Commission approve Conditional Use Permit No. 08-09 based upon the Findings of Fact contained in this Staff Report, and subject to the Conditions of Approval (Attachment C) and Standard Requirements (Attachment D). ATTACHMENT C CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO. 08-09 1. This permit or approval authorizes installation and operation of a 75-foot high monopine telecommunication facility and accessory equipment at an existing church site located at 2898 North G Street. The project site is located on east side of G Street, approximately 160 feet north of 29th Street in the RS, Residential Suburban land use district. 2. Within two years of conditional use permit approval, commencement of construction shall have occurred or the permit/ approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/approval shall become null and void. However, approval of the Conditional Use Permit does not authorize commencement of construction. All necessary permits must be obtained prior to commencement of specified construction activities included in the Conditions of Approval and Standard Requirements. Expiration Date: September 16, 2010 3. The review authority may grant a one-time extension, for good cause, not to exceed 12 months. The applicant must file an application, the processing fees, and all required submittal items, 30 days prior to the expiration date. The review authority shall ensure that the project complies with all Development Code provisions in effect at the time of the requested extension. 4. In the event this approval is legally challenged, the City will promptly notify the applicant of any claim, action or proceeding and will cooperate fully in the defense of this matter. Once notified, the applicant agrees to defend, indemnify and hold harmless the City of San Bernardino (City), the Economic Development Agency of the City of San Bernardino (EDA), any departments, agencies, divisions, boards or commission of either the City or EDA as well as predecessors, successors, assigns, agents, directors, elected officials, officers, employees, representatives and attorneys of either the City or EDA from any claim, action or proceeding against any of the foregoing persons or entities. The applicant further agrees to reimburse the City for any costs and attorneys' fees which the City may be required by a court to pay as a result of such action, but such participation shall not relieve applicant of his or her obligation under this condition. The costs, salaries, and expenses of the City Attorney and employees of his office shall be considered as "attorneys fees" for the purpose of this condition. . . CUP 08-09: Attachment C Septmeber 16, 2008 Page 2 As part of the consideration for issuing this permit, this condition shall remain in effect if this Conditional Use Permit is rescinded or revoked, whether or not at the request of applicant. 5. Construction shall be in substantial conformance with the plan(s) approved by the Director, Development Review Committee, Planning Commission or Mayor and Common Council. Minor modification to the plan(s) shall be subject to approval by the Director through a minor modification permit process. Any modification which exceeds 10% of the following allowable measurable design/ site considerations shall require the re-filing of the original application and a subsequent hearing by the appropriate hearing review authority if applicable: a. On-site circulation and parking, loading and landscaping; b. Placement and/ or height of walls, fences and structures; c. Reconfiguration of architectural features, including colors, and/ or modification of finished materials that do not alter or compromise the previously approved theme; and, d. A reduction in density or intensity of a development project. 6. No vacant, relocated, altered, repaired or hereafter erected structure shall be occupied or no change of use of land or structure(s) shall be inaugurated, or no new business commenced as authorized by this permit until a Certificate of Occupancy has been issued by the Department. A temporary Certificate of Occupancy may be issued by the Department subject to the conditions imposed on the use, provided that a deposit is filed with the Department of Public Works prior to the issuance of the Certificate, if necessary. The deposit or security shall guarantee the faithful performance and completion of all terms, conditions and performance standards imposed on the intended use by this permit. 7. This permit or approval is subject to all the applicable provisions of the Development Code in effect at the time of approval. This includes Chapter 19.20 - Property Development Standards, and includes: dust and dirt control during construction and grading activities; emission control of fumes, vapors, gases and other forms of air pollution; glare control; exterior lighting design and control; noise control; odor control; screening; signs, off-street parking and off-street loading; and, vibration control. Any exterior structural equipment, or utility transformers, boxes, ducts or meter cabinets shall be architecturally screened by wall or structural element, blending with the building design and include landscaping when on the ground. . . The project shall comply with all applicable requirements of the Public Works Division, Building Division, Fire Department, Police Department, Municipal Water Department, Public Services Department, and the City Oerk's Office. 9. The project shall comply with the requirements of other agencies, as applicable (e.g. California Board of Equalization; Federal Communications Commission; etc.). 10. The applicantjoperator(s) and property owner shall ensure that the communications tower and related equipment shall be removed within 3 months after the use is abandoned. 11. Submittal requirements for permit applications (building, site improvements, landscaping, etc.) to the Building/Plan Check Division and/or the Public Works/Engineering Division shall include all Conditions of Approval (Attachment C) and Standard Requirements (Attachment D) issued with this approval. 12. The applicant, tower operator(s), and property owner(s) shall be responsible for regular maintenance of the site (at least monthly, or sooner as needed to properly maintain the site and property). Vandalism, graffiti, trash and other debris shall be removed within 24 hours. The management shall take a photograph of any graffiti and provide it to the Police Department prior to removing the graffiti. 13. The use of barbed wire, electrified fence, or razor wire in conjunction with any fence, wall, roof, hedge, or by itself is prohibited per Development Code Section 19.20.030 (8)(C)(1). 14. If a generator or fuel tank is proposed in the future, approval from the Planning Division shall be required, as well as issuance of Fire Department and Building Division permits prior to installation. 15. The operation of the antenna shall not cause interference with any electrical equipment in the surrounding neighborhoods (e.g., television, radio, telephone, computer, inclusive of the City's trunked 800MHz public safety radio system, etc.) or with Police or Fire Department communications equipment unless exempted by Federal Regulations. If notified by a City official that the antenna is creating interference, the use of the antenna shall cease immediately and remain out of use until the problem is resolved. 16. The 75-foot monopine shall be constructed according to the approved elevations and the related equipment shall be painted to match the surroundings. . . The proposed monopine tower shall resemble a pine tree with heavy branch coverage (e.g. minimum of heavy density branches, branches beginning approximately 15 feet above ground level) and standard size/ color pine needles. Pine branches shall extend beyond the antennas for adequate concealment, to the satisfaction of the Director. Antennas shall be painted green or covered to match the pine branches. 18. The pole/trunk shall be covered with simulated pine bark cladding (e.g. dark brown or similar) painted to replicate a live pine trunk. 19. Five live 48" box trees (of a compatible evergreen species) and shrubs shall be provided around the enclosure with a permanent and automatic irrigation system. On-site landscaping and trees shall be maintained in accordance with the provisions of the Development Code. 20. All Conditions of Approval and Standard Requirements shall be completed prior to final inspection. 21. Gentleman; please be advised that our appeal is based on the fo - llowing factors. As priorly stated in the meeting in the city council chambers on Tuesday Sept. 16, at 7:00 P.M. 1.- There is no need at the present time for such cellular tower, because aHth'ilt telephone landlines in existence in the neighbor- hood, fUDction tol:;>ring a highly acceptable residencialservice. 2.- NOwaday~, with the wide usage of cellular phone units, we in the neighborhoo<l, have been enjoying this service at leastfoX'th last 15 years, ina very adequate manner, without the aid of a cellular tower, so, we do not see the need for this tower at this time. Therefore, we, the "Concerned Neighbors. Committee, do no.t agree with the installation of this cellular tower in this propo- sed site. 3.'- It is also our general fee1:i.ngin the neighborhood of opposi- tionto this project, because, we, as the" Concerned Neighbors Committee, would like to preserve the integrity of our properties as they are today, We do not want an extraneous entity to upset our livestyles. 4.- We also feel violated in our right to accept or reject a deve lopment of this magnitude, which we all know full well, it will not bring a benefit to our neighborhood, but, it may well be de- trimental to our future generations. 5.- We, the" Concerned Neighbors Committee ", flatlY disagree with the purpose of this project, when we know, that it only brings financial gains and profits to the entity allowing the ins tallation of this monopine cellular tower(THE FA!TH BIBLE CHURCH) on its property. Thus, we assert that if the church is in a fin- ancial bind, the neighborhood , should not be used as a venue to provide for the church the solution to its financial needs.More- over, there are many other means, alternatives,events and activi- ties on which the church might get involved to raise its much needed funds, without sacrificing the stability this neighborhood. After all, we, The" Concerned Neighbors Committee, are ONLY int- erested in preserving the well being of our families. 6.- We, " the Concerned Neighbors Committee" also agree, that if these monopine cellular towers, are so appealing, and do not nega tively affect the value of the properties in the neighborhood, we invite the church officers, the CEOs and regional managers of thi telephone service providers, to each of them, take one of these cellular towers and have them installed right on their backyards, so, that they will each benefit from the amenities that this mono pine cellular towers bring to their neighborhoods. , . .
