The IVDA was formed in response to the federal government's decision to close the Norton Air Force Base (the "Air Base"). Under the California Health and Safety Code Community Redevelopment Law (the "Law"), specific authority was granted to these jurisdictions to form a redevelopment project area ("Redevelopment Project Area") within the territory surrounding, adjacent, or in proximity to the Air Base. As provided by Section 33492.40, et seq., of the Law, the IVDA's prime purpose and function as a joint powers authority is to provide the mechanism and funding to: (l) acquire the Air Base and facilitate its successful reuse; (2) ensure that adequate access exists to and from the major transportation systems and the Air Base; (3) promote economic development within the area surrounding the Air Base; and (4) provide funding for affordable housing. The Law requires the IVDA to set aside twenty percent (20%) of the tax revenues allocated into a special housing fund for the purpose of expanding the supply of housing available to persons or households of low- or moderate-income. The IVDA is currently setting aside the full twenty percent (20%) of the tax increment revenue it receives into the Housing Fund and allocating each of its Participating Jurisdictions their share of the housing set-aside revenues generated by their portions of the Redevelopment Project Area. In return, each of the Participating Jurisdictions has assumed the responsibility to spend these Housing Funds to improve and increase the supply of affordable housing in those portions of the Redevelopment Project Area located within their individual communities in accordance with the Law. The County is thus limited to expending the IVDA Housing Fund monies within certain County unincorporated areas primarily surrounded by either the City or the City of Highland. The other County unincorporated area of the IVDA Redevelopment Project Area is the area commonly referred to as the "donut hole" and it is presently unsuitable for housing development due to its industrial and commercial zoning. The Participating Jurisdictions have been receiving Housing Fund monies from the IVDA since 1992. The County last expended these funds in 1994 at the Casa Ramona senior housing facility with the consent of the City. The County currently has a balance of $5,642,660 in IVDA Housing Funds. ----------------------------------------------- ----------------------------------------------- --------------------------- ---------------------------------------------------------------------- P:\AgendasIConun Dev Commission\CDC 2009\01-05-09 Cooperative Agreement Concept - 3rd Street Corridor SR.doc COMMISSION MEETING AGENDA Meeting Date: 01105/2009 Agenda Item Number: /2../ q Economic Development Agency Staff Report Cooperative Agreement Concept - 3rd Street Corridor Page 2 CURRENT ISSUE: The IVDA has proposed that the County portion of these remaining IVDA Housing Funds be made available for a property acquisition/land assembly project in the County unincorporated area north of 3rd Street between Waterman Avenue and Tippecanoe Avenue. On December 10,2008, the IVDA approved proceeding with the adoption of a Cooperative Agreement for this project. The IVDA will enter into a Cooperative Agreement with the Agency, with County consent, to grant the necessary jurisdiction and authority for the Agency to acquire the necessary parcels for a community redevelopment project. The IVDA and the Agency will coordinate with County Public Works and Flood Control to vacate "Little Third Street" and transfer the underlying fee title to the Agency, in addition to allowing for either relocation or undergrounding of the City Creek By-Pass Channel that separates 3rd Street from "Little Third Street" in the area west of Tippecanoe A venue. The City will then agree to annex the area upon completion of the land assembly project and prior to the issuance of any building permits for new development within this area. Additionally, the City will be allowed to commence Code Enforcement activities in this area as a part of the overall community improvement project. Until a formal annexation of this area occurs, the County portion of the Housing Funds generated in this area will likewise be used by the Agency in the land assembly project. ENVIRONMENTAL IMP ACT: Categorically exempt under the California Environmental Quality Act ("CEQA"), Section 1530 I. FISCAL IMPACT: There is no fiscal impact to the Agency or the City. RECOMMENDATION: That the Mayor and Common Council and the Community Development Commission adopt the attached Motions. L Emil A.
