Description: N/A f?[;'() 2tXJ,F. <I.r( Finance: Agenda Item No. /2. 11./~ --DI CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution approving an Agreement with Placo San Bernardino, LLC for provision of space for temporary parking for Metrolink riders during realignment of Viaduct Blvd. (SS07-32) and construction of the Metrolink Parking Structure (GB04-19). Background: On September 2, 2008, the Mayor and Common Council approved the FY 2008/09 Capital Improvement Program, which included several projects, related to construction of a Metrolink Parking Structure at the Santa Fe Depot. Project No. SS07-32 is for the realignment of Viaduct Boulevard between 2nd Street and 3rd Street and Project No. GB04-19 is for construction ofa 350 space parking structure for use of Metrolink Riders. The plans and specifications for the realignment of Viaduct Boulevard have been completed and staff plans to receive bids in December of 2008. The Metrolink Parking Structure (GB04-19) has lagged about 6 months behind due to a requirement that was recently imposed by Caltrans for an Air Quality Analysis. This requirement was a surprise to City staff and should have been brought to our attention much earlier in the process. Staff requested that the requirement be waived, but Caltrans refused the request. During construction of both the Viaduct Boulevard realignment and the construction of the parking structure, approximately 70 parking spaces at the Metrolink Station will be displaced for a period of at least 6 months. There is a serious shortage of existing parking for Metrolink riders and the loss of 70 spaces will severely impact the ability of riders to find parking. In order to alleviate the parking impact, staff investigated an auxiliary parking area consisting of approximately 70 existing parking spaces at several locations near the Metrolink Station, including the Carousel Mall. Two locations were investigated on the south side of 2nd Street between "K" Street and Mt. V ernon Avenue. Both locations on 2nd Street would require substantial improvements to provide an adequate parking area. Placo San Bernardino, LLC, owner and operator of the Carousel Mall, has generously agreed to provide spaces for an auxiliary parking lot at no cost to the City (See attached letter dated September 23, 2008). This location offers excellent security and no improvements will be needed. Placo San Bernardino LLC has provided 4 options for the auxiliary lot. A map showing the location of the spaces is attached to the Agreement. While any of the options will meet the City's needs, the Agreement has been drafted for option I, which is staff s preferred option. Option 1 is located at the southeast comer of "G" Street and 3rd Street and is preferred due to its nearness to 3rd Street, which is the planned route for a proposed shuttle service. Staff is currently working with Omnitrans to provide the shuttle service between the auxiliary parking lot and the Metrolink train station. Staff expects to finalize the details of the shuttle service in the next few weeks. A copy of the proposed Agreement is attached to the Resolution as Exhibit "A". Staff feels this Agreement provides the best location for an auxiliary parking lot in terms of security, proximity, convenience for the riders, and least cost to the City. The locations that were investigated on 2nd Street near the Depot would require considerable improvements at the City's cost and would not offer comparable security as the Carousel Mall location. Placo San Bernardino, LLC is offering this location for a period of 6 months between March I, 2009 and August 31, 2009. The realignment of Viaduct Boulevard is expected to start construction in March 2009 and be completed in August 2009. Based on the latest schedule for the parking structure, staff expects approval of the environmental document in April 2009. That will allow advertisement for construction bids in May of 2009 to begin construction in October of 2009. Since the original Agreement will have expired, it will be necessary to negotiate a new Agreement for an auxiliary parking area with Placo San Bernardino, LLC prior to start of parking structure construction. The estimated completion date for construction is October 2010. Financial Impact: There will be no financial impact due to the recommended action. Recommendation: Adopt Resolution. City Engineer City of San Bernardino 300 North "D" Street San Bernardino, CA 92418 RE: Temporary Parking for Metrolink Riders Dear Mr. Eisenbeisz: Placo San Bernardino, LLC does not object to the temporary use of approximately 70 parking spaces by the City of San Bernardino as proposed in your letter dated August 14, 2008 in the area delineated as Option 1 on the attached Exhibit A, subject to the following conditions: 1. The use will be temporary for a period of six months commencing March 1, 2009 and ending August 31, 2009, for the purpose of parking Metrolink riders displaced by the construction of a parking structure at the Santa Fe Depot/Metrolink location on West Third Street. 2. Pursuant to the Reciprocal Easement Agreement recorded December 24, 1970, Section 13.1, the City shall hold harmless Placo San Bernardino, LLC and all other Parties from any claims or judgments arising from the use of the parking area including, but not limited to, the temporary use set forth in paragraph one above. Further, the City will provide evidence of insurance as required by Section 13.2(b) of the Reciprocal Easement Agreement. 3. The City agrees not to damage or penetrate the parking areas with any fencing or signage, and to confine the temporary parking as outlined herein to the Option 1 area designated on the attached Exhibit A. 4. Placo San Bernardino, LLC shall, in its sole discretion, have the right to relocate the temporary parking area to one of the areas shown as Option 2, 3 or 4 as designated on the attached Exhibit A. In order to construct the project, it will be necessary to close off approximately 70 surface parking spaces for a period of 4 to 6 months. As you are probably aware, parking for Metrolink riders is not currently meeting the demand and displacement of 70 spaces will adversely impact the ability of the public to utilize this important alternative to the personal vehicle. In order to compensate for the loss of spaces, we are studying the possibility of providing an auxiliary parking lot served by a shuttle. The purpose of this letter is to propose utilization of the surplus parking area located at the southeast comer of"O" Street and 3,d Street. Attached are aerial photos of two possible parking areas. Either location would be satisfactory for our purposes. We would propose to construct a temporary fence or other barrier to limit the area to one point of access. Also a sign would be installed to indicate that the area is reserved for Metrolink parking.
